The Minutes of a regular meeting of the City Council Austin, Tex; Oct. 6, 1890. Hon. John McDonald, mayor, presiding.
(Roll Roll Call. Present- Aldermen Anderson,Assmann, Carleton, Graham, Hume, Jones, Metz, Morris, Nitschke, North, Phillips, Plath, Townsend, Wingfield, Ziller- 15. Call. Absent- Aldermen Jackson, Linn, Newton, Schneider, Schuler- 5. Aldermen Newton and Schneider entered the Council and answered to their names. Minutes. The minutes of the meeting of the City Council which was held on the 15th day of September, 1890, were read and adopted. Fire limits. A petition from the owners of block 173, on west side of Congress avenue, requesting that said block be included within the fire limits, was read. W.H. Firebaugh Alderman Plath presented a protest from W.H. Firebaugh against the cutting down of West 9th Street in front of his house. Referred to the Street Committee. Hospital Alderman Anderson presented a report from the City engineer which he had requested him to make Concerning the Condition of the flues in the City and County Hospital. The report states that the flues are very defective and that they should be torn down and rebuilt, which will cost about $300. The report was laid over to be taken up with an Ordinance Covering the matter Frank Lotis Alderman Carleton presented a petition from Frank Chili stand. Lotis and others requesting the Council to reconsider its action in ordering the removal of the Coffee, lunch and Chili Stand owned by Frank Lotis from the Corner of Fourth and Colorado streets. Alderman Plath moved that the Council reconsider the vote by which the resolution ordering the removal of said stand was adopted. Carried. Alderman Jones then moved to lay the resolution on the table. Adopted. Lights Alderman Morris introduced a petition from citizens requesting that an electric light be placed at the Corner of Tenth and Colorado Streets to furnish light for persons who attend the First Baptist Church and all citizens who pass that way. Alderman Morris also presented a resolution directing the placing of the light as requested. Alderman Jones moved to amend the resolution by adding one light to be placed in the Tenth Ward, at a point where a light is much needed. Carried. Alderman Nitschke then moved to amend the resolution by adding one light to be placed at the Corner of Trinity and 19th Streets. Adopted. Alderman Carleton moved to refer the resolution to the Committee on water and light. Lost. The resolution as amended was then adopted.

Weld R Alderman Phillips presented a claim from Weed & Rosengreen for $25.00. for damages to horse, Caused by going through a bridge on East Sixth street, Aug. 11. Laid over. C. A. Newing Alderman Anderson offered a proposal from Chas. A. Newning stating that he would pay the city $200 per acre for the land south of the river known as the pest ground. Alderman Carleton then Asked unanimous Consent of the Council, which was given, to the Consideration of "An Ordinance authorizing and requiring the mayor of the City of Austin to sell to Chas. A. Newning block 18 in Swisher's addition on south side of Colorado river, Containing about seven acres of land". It was read and Alderman Carleton moved to refer the proposal and Ordinance to the finance Committee. Lost- Yeas, 7; Nays 9. Motions were then made to suspend the rules and place the Ordinance on its second and third readings both of which were adopted by the following Vote- Yeas- AldermenAnderson, Altmann, Carleton, Abraham, Hume, Jones, Metz, Newton, Nitschke, Phillips, Platt, Townsend, Wingfield, Ziller - 14. Nays- Aldermen- Morris, Narth, Schneider - 3. The Ordinance was then accordingly read and on motion passed. Hackmen Alderman Anderson, by request, presented a protest from some of the owners of hacks against the operation of the Ordinance recently passed by the Council establishing stands for hacks. It was laid over to be taken up later with an Ordinance on the subject. City Officers reports Reports of the following City Officers were presented read and referred to their appropriate Committees; City Physician; City Sexton, City Marshal, City Clerk, City Treasurer. Robards Tax. The Committee on Claims and accounts reported favorably on the proposal of N. S. Walton, agent for Mattie Robards Mayor, to Compromise the back taxes due the City on Certain lots in outlet 55, division D, and outlet 44, division D. The report recommends that the proposition to pay the City $35 and costs of sale be accepted, and that the mayor execute proper releases of city taxes up to and including the year 1889. The report was adopted. " Alderman Morris, at his request, was excused from Voting on the question. Art 153 Penal O. The Committee on Ordinances, to whom was referred an Ordinance Hosp. entitled, "An Ordinance Amending Art 153 of Title IV, Chapter 1, of the Revised Penal Ordinances of the City of Austin," Submitted a favorable report thereon, and it was read and laid over to be taken up with the Ordinance named therein. The last named ordinance was then taken up on its second reading and read, after which a motion was made to Confine the operation of the provisions of the Ordinance to the territory lying between the river and Orange street and Waller Creek and School Creek. The motion was lost. Alderman Abraham moved to amend the Ordinance by adding that it shall take effect from and after January 1, 1891. Carried.

A motion was then made to suspend the rules and place the Ordinance on its third reading, which was lost by the following Vote - Aldermen Anderson, Assmann, Carleton, Graham, Hume, Jones, Merris, North, Platt, Townsend Wingfield - 11. Nays - Aldermen Metz, Newton, Nitschke, Phillips, Schneider, Ziller- 6.
Hospital flues Alderman Anderson introduced an Ordinance appropriating the sum of $300 to repair the flues of the City and County hospital. It was read first time after which motions were made to suspend the rules and place the Ordinance on its second and third readings, both of which were adopted by a vote of two-thirds of the whole Council and it was accordingly read and on motion passed.
W.W.+ E.L. Fund Alderman Morris introduced an Ordinance appropriating the sum of $5000 out of the special fund to build a water and light system to continue the preliminary work of building the dam. It was read first time after which motions were made to suspend the rules and place the Ordinance on its second and third readings and that it do pass, all of which were adopted by the following Vote and duly complied with - yeas- Aldermen Anderson, Assmann, Carleton, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Townsend, Wingfield, Ziller - 17.
Bd. Pub. Wks. Alderman Morris also presented an Ordinance entitled "An Ordinance to amend and to Condense into one Ordinance an Ordinance entitled 'an Ordinance to Create a board of public works of the City of Austin, and to prescribe the powers and duties thereof, and amendments thereto." It was read first time after which a motion was made to suspend the rules and place the Ordinance on its second reading which was adopted by the following Vote - yeas - Aldermen Anderson, Assmann, Carleton, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Schneider, Townsend, Wingfield, Ziller - 16. Nay- Alderman Platt. The Ordinance was then read a second time, after which a motion was made to suspend the rules and place the Ordinance on its third reading which was adopted by the following Vote- Yeas - Aldermen Anderson, Assmann, Carleton, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Schneider, Townsend, Wingfield, Ziller - 16. Nay- Alderman Platt. The Ordinance was then read a third time and on motion passed. Alderman Morris also offered an Ordinance entitled

Hacks - Stand "An Ordinance to repeal Section One (1) and two (2), and to amend Section three (3) four (4) and five (5) of an Ordinance entitled 'An Ordinance prohibiting drivers of hacks and other Vehicles and other persons from entering the depot grounds of the International and Great Northern Railroad Company and the Houston and Texas Central Railroad Company in the City of Austin for the purpose of receiving or discharging freight or passengers, except in the place and in the manner as provided by this Ordinance, and to provide a penalty for the Violation of this Ordinance,' approved Sept 18, 1890." Alderman Carleton moved to refer it to a special Committee of three. The motion was lost. A motion was then made to suspend the rules and place the Ordinance on its second reading, which was adopted by a vote of two-thirds of the whole Council and the Ordinance was accordingly read. A motion was then made to suspend the rules and place the Ordinance on its third reading which was lost by the following Vote- yeas- Aldermen Assmann, Graham, Shume, Jones, Morris, Newton, Phillips, Plath, Schneider, Townsend, Wingfield, Ziller, 12. Nays - Aldermen Anderson, Carleton, Metz, Nitschke, North, 5. City Council. Alderman North moved that the City Council shall hereafter begin its regular meetings at 8 oclock p.m. Adopted. Oct. Salaries. Alderman Shume introduced An Ordinance appropriating the sum of $3200 for the purpose of paying the Salaries of Officers and regular employees of the City for the month of October 1890. It was read first time, after which motions were made to suspend the rules and place the ordinance on its second and third readings and that it do pass, all of which were adopted by the following Vote and were duly complied with - Yeas- Aldermen Anderson, Assmann, Carleton, Graham, Shume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Plath, Schneider, Townsend, Wingfield, Ziller 17. Apprit. Alderman Shume also presented An Ordinance appropriating the Sum of $2002.81 for the purpose of paying approved accounts. It was read first time after which a motion was made to suspend the rules and place the Ordinance on its second reading which was adopted by a vote of two-thirds of the whole Council. Ward + 3. Alderman Phillips moved to amend it by inserting $25 to pay Ward & Rose [illegible] for damages to horse. Carried. 4... Alderman Anderson offered an amendment adding $13.9 to be used in purchasing wood for the hospital. Adopted. Motions were then made to suspend the rules and place the ordinance on its third reading and that it do pass, both 4

which were adopted by the following vote - yeas Aldermen Anderson, Assmann, Carleton, Graham, Hume, Jones, Metz, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Townsend, Wingfield, Ziller - 17.
Stre't hands. Alderman Hume offered An Ordinance appropriating $227.85 to pay extra funds for working the streets during the month of September, 1890. It was read first time after which motions were made to suspend the rules and place the Ordinance on its second and third readings, both of which were adopted by a vote of two-thirds of the whole Council and the Ordinance was accordingly read and on motion passed. Alderman Hume also introduced
Water Co. An Ordinance making an appropriation of the sum of $2,042.10 to pay the Austin Water Light and Power Company for water furnished for flushing the gutters, etc. It was read first time after which motions were made to suspend the rules and place the Ordinance on its second and third readings, both of which were adopted by a vote of two-thirds of the whole Council and the Ordinance was accordingly read. On motion the Ordinance was then passed by the following vote - yeas - Aldermen Anderson, Assmann, Carleton, Graham, Hume, Jones, Metz, Newton, Nitschke, North, Phillips, Platt, Townsend, Wingfield, Ziller - 15. Nay - Alderman Morris.
Lights. Alderman Hume presented An Ordinance appropriating the sum of $1,562.49 to pay the Austin Water Light and Power Company for light furnished the city for the months of July, August, and September, 1890. It was read first time after which a motion was made to suspend the rules and place the Ordinance on its second reading which was adopted by a vote of two-thirds of the whole Council. The Ordinance was then read a second time. Alderman Morris moved to strike out $1,562.49 and insert in lieu thereof $800. Alderman Jones moved to table the amendment. Carried. A motion was then made to suspend the rules and place the Ordinance on its third reading which was adopted by a vote of two-thirds of the whole Council and the Ordinance was read and on motion passed by the following vote - yeas Aldermen Anderson, Assmann, Graham, Hume, Jones, Metz, Newton, Nitschke, Phillips, Platt, Townsend, Wingfield, Ziller - 13. Nays - Anderson Carleton, Morris, North - 3. The Council then adjourned Milton Morris City Clerk.
