90 The minutes of a regular Meeting of the City Council. Austin, Tex, March 02, 1891. Hon. Henry H. Linn, President of the Board of Aldermen, presiding.
Roll Call. Roll Called. Present. Aldermen Carleton, Glass, Jackson, Linn, North, Phillips, Platt, Wingfield, Ziller - 9. Absent - Aldermen Anderson, Assmann, Graham, Hume, Morris, Newton, Nitschke, Schneider, Schuban, Dutar, Townsend - 11.
Call of Council. Alderman Ziller moved a call of the Council which was duly adopted, and the marshal sent after the absentees.
Recess. Alderman Ziller also moved that the Council take a recess of five minutes. Carried.
Roll At the expiration of the recess the roll was again Called, which resulted as follows: Present - Aldermen Carleton, Glass, Jackson, Linn, Nitschke, North, Phillips, Platt, Schuban, Townsend, Wingfield, Ziller - 12.
Called. Absent - Aldermen Anderson, Assmann, Graham, Hume, Morris, Newton, Schneider, Dutar - 8.
Call Susp'd. Alderman Carleton moved to suspend the Call. Carried. Alderman Carleton then moved to adjourn. The motion was lost.
Minutes. The minutes of the meeting of the City Council, which was held on the 16th day of February 1891, were adopted as printed.
St. near San Gabriel. & 22 1/2 st. A petition of citizens requesting that a street be opened - the next to San Gabriel Street on the West - through Parrington farm, and opening into 19th Street on the South and 24th Street on the north; also, 22 1/2 Street Westward to the proposed new Street, was presented and referred to the Street Committee.
Bar Assn. Copy Charter & Ords A petition from John Dowell, president Austin Bar Association, requesting the Council to donate one Copy of the Ordinances and Charter of the City to the law library in the District Court room, was read and granted.
Sts. 10th Ward. Alderman Glass presented a petition from Citizens, requesting that Certain Streets in the 10th Ward be repaired. Referred to the Street Committee.
Ald. Morris & Newton. Aldermen Morris and Newton entered the Council room and answered to their names.
A. A. Brewer. Alderman Glass presented a petition from A. A. Brewer, requesting that Certain pound fees, amounting to $3.00, paid by him, be remitted. Granted.
Frizell. The report of Chief Engineer Frizell, showing the progress made on the dam and the Railroad to the same during the month of February, 1891, was read and Ordered filed. It stated that the Excavation for the Canal and gate house is nearly completed. The earth excavation for the dam is approaching completion. The great labor for transporting the stone from the quarry and preparing them for use, the river force, as well as for quarrying rock and Copes is now well organized and operating satisfactory.
Est &c. [illegible] per Voucher #1, for $9,136.18, in favor of Bernard Corrigan, Contractor, for work done on the dam during the month

91 of February, 1891, was read and laid over. The following was read and laid over:
R. R. to dam. (Office of Board of Public Works.) Austin, Texas, Feby. 27, 1891. The following resolution was adopted by the Board of Public Works at a meeting held on Thursday, February 26th 1891: "Resolved, that the President of the Board be requested " to ask the City Council to authorize the Board of Public Works " to lease the Austin dam railroad for a term not " exceeding five years, and at a rental of not less than six " per centum per annum on the total cost of the road. " The lessee to keep the road in good repair at his own expense, " and the road to be operated by the lessee with dummy engines " or electricity, until the completion of the water and " electric light works after which time it is to be operated " by electricity alone." Reports of Officers. The reports of the City Marshal, City Physician and City Sexton for the month of February, 1891, were read and referred to their respective Committees. The reports of the City Treasurer from February 2 to March 2, 1891: General Fund: Balances Feb. 2 $7,577.70 Receipts to March 2 17,198.01 Total $24,775.71 Disbursements: Paid Warrants $11,907.32 Balances March 2 12,868.39 Total $24,775.71 (Referred to finance Committee.

92 Foltz Sewer. presented a report stating that the improvement asked for, was made. The report was adopted. Alderman Phillips for the Street Committee, to whom was referred an Ordinance entitled "An Ordinance granting F.W. Foltz the right to lay a sewer pipe along Bowie Street" presented a favorable report on the same, which was adopted.
Alley in Blk. 69. Alderman Phillips, for the Committee on Streets, to whom was referred an Ordinance entitled "An Ordinance appropriating five thousand dollars to improve the alley running north and south through block No. 69," presented a favorable report thereon with the recommendation that the amount be reduced to five hundred dollars. The report was adopted.
Jno. F. Wells. Alderman Carleton for the Committee on Claims and Accounts, to whom was referred a Claim from John F. Wells, for $70 damages caused by establishing Small Pox Camp adjoining to farm land Controlled by him, presented a report recommending that fifty dollars be paid him in full settlement of all Claims against the City, and a resolution to that effect offered by the Committee was adopted.
R. L. Hood. Alderman Carleton, for the Committee on Claims and Accounts to whom was referred petition of R. L. Hood asking that the Assessor and Collector be directed to remit certain taxes erroneously assessed against him, presented a report recommending the granting of the petition, and also a resolution instructing the Assessor and Collector to strike from the list of property assessed against R. L. Hood the item of $2,500 loaned money. The resolution was adopted.
Cemetery Comtee. Alderman Ziller, Chairman Cemetery Committee, asked that further time be given said Committee in which to prepare a report concerning the establishment of a new Cemetery. Granted.
School land. Alderman North, for the Special Committee to whom was referred an Ordinance entitled, "An Ordinance authorizing and confirming the sale by the City of Austin and its Board of School Trustees, of its interest in the Wm Heffler, P. Coulter and John Lowery Surveys, in Victoria and Calhoun Counties, Texas, to Louis Focater," presented a report recommending the passage of the same. Adopted. The last above named Ordinance was then taken up on its second reading and read, after which
" a motion was made to suspend the rules and place the Ordinance on its third reading, which was adopted by a vote of two-thirds of the whole Council. It was then read a third time, and on motion passed.
Foltz Sewer. An Ordinance granting F. W. Foltz the right to lay a sewer pipe along Bowie Street, was taken up on its second reading and read, after which a motion was made to suspend the rules and place it on its third reading, which was adopted by a vote of two-thirds of the whole Council. The Ordinance was accordingly read, and on motion passed.

93 moved to amend the Caption and Section One of the Same by striking out "$1.00" and inserting in lieu thereof "$500." The amendment prevailed and a motion was then made to suspend the rules and place the Ordinance on its third reading, and that it do pass, both of which were adopted by the following vote: Yeas - Aldermen Carleton, Glass, Jackson, Linn, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schulenberg, Townsend, Wingfield, Ziller - 15. Alderman Morris moved a Call of the Council which was duly adopted. Ald. Carleton. Alderman Carleton was excused. Alderman Platt moved that the Call be suspended Carried Alderman Wingfield moved that the Council adjourn. The motion was lost. A. D. Bell. On motion A. D. Bell was confirmed as pound Master of the City, beginning February 18, 1891. City Cemetery Alderman Ziller presented An Ordinance, appropriating the Sum of $25.00 for the purpose of purchasing a strip of ground to widen the Street in front of the West Entrance to the Cemetery. It was read the first time, after which a motion was made to suspend the rules and place the Ordinance On its second reading, which was lost by the following Vote: Yeas - Aldermen Glass, Jackson, Linn, Morris, Newton, Nitschke, Phillips, Schneider, Schulenberg, Townsend, Wingfield, Ziller - 12. Nays - Aldermen North, Platt - 2. Apprvd accts. Alderman North introduced An Ordinance; appropriating the Sum of $1.238.56 for the purpose of paying approved accounts. It was read the first time after which a motion was made to suspend the rules and place the Ordinance On its second reading, which was lost by the following Vote: Yeas, Aldermen Glass, Jackson, Linn, Morris, Newton, Nitschke, North, Phillips, Schneider, Schulenberg, Townsend, Wingfield, Ziller - 13. Nay - Alderman Platt - 1. Mech. Salaries. Alderman North also offered an Ordinance appropriating the Sum of $3.350.00 for the purpose of paying Officers and regular employes of the city for the month of March, 1891. It was read the first time, after which a motion was made to suspend the rules and place the same on its second reading, which was lost by the vote as last above, Ald Platt Alderman North also presented an Ordinance to make an appropriation of the sum of $9.133.13, to pay the amount due contractor [illegible] No. 11 for making the dam across the Cascade [illegible]. its second reading, which was lost by the vote as last above set forth. Alderman Mervis moved a call of the Council, which was agreed to by a rising vote of 7 to 5. Alderman Mervis moved to suspend the call. Adopted. Alderman Dehuben introduced an ordinance authorizing and instructing the Water and Light Committee to arrange with the Austin gaslight and coal Company for the placing of gas lamps in the city where the Committee may deem proper. Referred to the water and Light Committee. Alderman Mervis moved that the Council stand adjourned until 8 o'clock p.m. March 2, 1891. Carried. Milton Mervis, City Clerk.

Austin, Tex, March 3, 1891. Hon John McDonald, mayor, presiding. Roll Called: Present-Aldermen Glass, Jackson, Morris, Zilker-4. Absent Aldermen Anderson, Assmann, Carleton, Graham, Hume, Linn, Nalle, Newton, Nitschke, North, Phillips, Platt, Schneider, Schutze, Duton, Townsend, Wingfield - 16. Called. Alderman Morris moved a Call of the Council, which was duly adopted. Call of Council. Roll Second Roll Call. Present-Aldermen Glass, Graham, Jackson, Linn, Morris, Phillips, Platt, Schneider, Duton, Wingfield, Zilker-11. Called Absent Aldermen- Anderson, Assmann, Carleton, Hume, Newton, Nitschke, North, Schutze, Townsend-9. On motion the Call of the Council was suspended. On motion the following named Ordinances where taken up Corrigan. Est. #4. on their second readings and read: "An Ordinance to make an appropriation of the Sum of nine thousand One hundred and thirty Eight dollars and Eighteen Cents, to pay amount due the Contractor on Estimate No. 4 for building the dam across the Colorado river." March Salaries. "An Ordinance appropriating the Sum of three thousand three hundred and fifty dollars for the purpose of paying officers and regulars employed by the City for the month of March." Cemetary. "An Ordinance appropriating the Sum of twenty five dollars for the purpose of purchasing a strip of ground to widen the street in front of the West entrance to the Cemetary." Apprvd. acct's. "An Ordinance appropriating the Sum of $1238.56 for the purpose of paying approved accounts." Amendment - a.w.L+T.Co Alderman Morris moved to amend the last named Ordinance by inserting the Sum of $509.19 for the Austin Water, light and Power Co., in payment for street lights furnished the City during the month of February. The motion prevailed and the Caption of the Ordinance was changed to conform thereto. R.R. to site of dam. Alderman Morris introduced an Ordinance authorizing the Board of Public Works to lease the City railway now being constructed across the City and to the site of the proposed dam on the Colorado river. It was read and laid on the table subject to call. Alderman Linn moved that Council stand adjourned. Lost. Alderman Phillips moved a Call of the Council which was duly adopted. arrest absent aldermen. Alderman Morris moved that the marshal and policemen be instructed to arrest absent aldermen if to be found, and bring them before the Council chamber. Carried. Aldermen Phillips moved that Aldermen Assmann and Schutze be excused. Adopted. Alderman Glass moved that the Council stand adjourned. Adjourned to meet the 1st Thursday in March 1891. Carried. Absent- Aldermen - Addmann, Carleton, Glass, Graham, Hume, Newton, Platt, Wingfield - 8. An Ordinance appropriating the sum of $25.00 for the purpose of purchasing a strip of ground to widen the street in front of the West entrance to the Cemetery, was taken up on its third reading and read and passed. Alderman Glass entered the Council and answered to his name. An Ordinance appropriating the sum of $3350 for the purpose of paying Officers and regular employees of the City for the month of March, 1891, was taken up on its third reading and read, and on motion, passed by the following Vote: Yeas - Aldermen - Anderson, Glass, Jackson, Linn, Morris, Nitschke, North, Phillips, Schneider, Schulher, Suter, Townsend, Ziller - 13. Alderman Glass presented an Ordinance appropriating the Sum of $35.00 to refund pound fees to one – Brewer. It was read the first time, after which motions were made to Suspend the rules and place the Same on its Second and third readings, both of which were adopted by a vote of two thirds of the whole Council. The Ordinance was accordingly read and on motion, passed. On motion, the Council then adjourned. Milton Morris, City Clerk.
