Austin's New Cemetery Plan & Fire Chief Vote 1891

Fire Department Leadership: August Jiller was officially confirmed as chief of the Austin Fire Department after receiving 63 votes in an election held the previous day.

Cemetery Expansion: The city council approved a proposal from Drake, Stein and associates to establish a new municipal cemetery on 120 acres of land outside the city. The company would maintain the grounds, set burial prices, and donate 10 acres for pauper burials.

Street Infrastructure: The council approved street repairs in the 10th Ward and authorized $450 in funding for materials and labor, plus approved opening a new street west of San Gabriel extending from Carrington Farm.

Public Services Funding: Passed two ordinances allocating $5,000+ to pay accumulated interest on city waterworks and electric light bonds.

Property Matters: Granted a tax refund of $8.75 to H.J. Perkins for overpayment and referred a damage claim from John Chenneville (whose basement was flooded when a street was raised) to committee for review.

110 The Minutes of a Regular Meeting of the City Council. Austin, Texas, April 20, 1891. Hon. Henry A. Linn, President of the Board of Aldermen, presiding. Roll Called- Present- Aldermen Glass, Hume, Jackson, Linn, North, Phillips, Wingfield, Jiller - 8. Called. Absent- Alderman Anderson, Assmann, Carleton, Graham, Morris, Newton, Nitschke, Platt, Schneider, Schuber, Sutor, Townsend - 12. Call of Alderman Jiller moved a Call of the Council which was duly adopted. He then moved that the Council take a recess of ten minutes. Carried. 2d After the Expiration of the recess the roll was again Called Roll and resulted as follows: Present- Aldermen Anderson, Assmann, Glass, Hume, Jackson, Linn, Nitschke, North, Phillips, Platt, Townsend, Wingfield, Jiller - 13. Call. Absent- Aldermen Carleton, Graham, Morris, Newton, Schneider, Schuber, Sutor - 7. Call Suspended. Alderman Jiller moved to Suspend the Call of the Council. Adopted. Minutes. The minutes of the meeting of the City Council which was held on the 6th day of April, 1891, were adopted as printed. Election- Fire Dept. Alderman North moved that the regular order of business be suspended and that the returns of the election for chief of the Austin fire department which was held on the 19th day of April, 1891, be canvassed. The motion prevailed. " It was then moved that the Chair appoint three tellers to canvass said returns. The motion Carried and the Chair appointed Aldermen North, Anderson and Wingfield. Aldermen Sutor and Schuber entered the Council and answered to their names. Covert & McCaty agts. for A petition was received from Covert & McCaty, agents for H.J. Perkins, H.J. Perkins. requesting the Council to remit $8.75 which was overpaid to the City for taxes for 1890, on lot 35, and 8 feet of lot 34 and 8 feet of lot 36, in block 22½, Division D. On motion of Alderman Platt the petition was granted. Jno. Chenneville. A petition from John Chenneville which was presented at the last meeting of the City Council and laid on the table Subject to Call was taken up and referred to the Committee on Claims and Accounts together with a bill attached thereto. It is a claim for damages to the basement of his house caused by the Street being raised and forcing the water into his premises. Election Fire Dept. The Committee appointed to canvass the returns of the Election for Chief of the Austin fire department presented a report as follows: For Chief: August Jiller received 63 votes. 2. [illegible] [illegible] 22 Votes It was then moved that Mr. August Jiller be --- Page break --- 111 Confirmed as chief of the Austin fire department for the Ensuing term and the motion prevailed. Hashold [illegible]. The city Engineer presented an Estimate of the Cost of Connecting the city and County hospital with the State Sewer. The Cost is placed at $486. On motion of Alderman Nitschke the Estimate was referred to the finance Committee. Mrs. Didelot Alderman Phillips for the Street Committee, presented an unfavorable report on the petition of citizens of the Tenth ward requesting the Council to permit Mrs.Didelot to Complete her house where the same is now partly Constructed. The report was adopted by a rising Vote of 9 to 3. Alderman North moved that the city marshal be instructed to see that the report of the Committee is Complied with. Carried. Petition for Streets Alderman Phillips for the Street Committee, also near San Gabriel & presented a report on a petition of Citizens requesting 22½ Streets. that a street be opened next to San Gabriel on the West, through Carrington farm, into 19th Street on the South, and 24th street on the north; also 22½ Street Westward to the proposed new street. The report recommends that the petition be granted, provided it costs the city nothing. The report was adopted. Streets - 10th Ward. Alderman Phillips for the Street Committee, also offered a favorable report on a petition of citizens asking that Certain streets in the Tenth ward be repaired. The report was adopted. Alderman Schneider entered the Council and answered to his name. Cemetery- New- Spl. Alderman Dutton for the Special Committee on Comtee. report. Cemetery presented the foregoing report. To the Hon. mayor and City Council of the City of Austin: Gentlemen:- your Special Committee appointed at the last regular meeting, April 6th, 1891, to whom you referred two propositions from different parties, looking to the establishment and maintenance of a new Cemetery for the use and benefit of the City of Austin, beg leave to report that we have performed the duty so assigned us, and now respectfully Submit the following as the result of our investigation, Viz: That we accept the proposition of Messrs. Drake, Stein, et.al., provided, that the Street Car franchise be a matter for future Consideration and that one Cemetery lot only, Shall be Saleable to any one person, Except where more Space becomes necessary for interments. Respectfully Submitted, (Mrs.) J. Dutton, Chairman Special Cemetery Committee. Ja. Jackson. Alderman [illegible] moved that the report be [illegible] to come up as new business. The motion prevailed by a rising --- Page break --- 112 Vote of 9 to 11. Shot for streets An Ordinance appropriating the Sum of $450 for material and in 10. Ward. Work on Streets in Tenth Ward, was taken up on its Second reading and read. Alderman Dchuber moved to lay it on the table which was lost by a rising vote of 6 to 8. A motion was then made to suspend the rules and place the Ordinance on its third reading, which was lost by the following Vote: Yeas- Aldermen Anderson, Alsemann, Glass, Jackson, Linn, Nitschke, Phillips, Platt, Sutter, Wingfield-10. Nays- Aldermen Hume, North, Schneider, Schuler, Townsend, Ziller-6. Street near Cherice's Alderman Platt by unanimous Consent presented a Store. Ned Green. petition from Ned Green asking that Certain repairs be made on East 6th Street near Cherice's Store. It was referred to the Street Committee. Cemetery-New Proposal. The following proposal for a City Cemetery was read: Frank Stainton & others. To the Hon. Mayor and City Council of the City of Austin: We the undersigned make the following proposition, to-wit: 1. We will furnish for a city Cemetery One hundred and twenty acres of land being out lots 17 and 18 in division C. of the City of Austin, and 40 acres adjoining the same on the north. This land is of Easy access by both the Eastern Triskville and Cameron roads and by the Austin & Northwestern railway and within less than One-half mile of the Electric railway as now operated. It drains to the East of the City; its Soil Surroundings are Exceptional for Cemetery purposes. 2. We will incorporate a Company under the laws of the State to be Known as the "Austin City Cemetery Company," and will Sub-divide, plat and put upon the market, for Sale for burial purposes Said land at prices (for the next five years) not to Exceed the prices Established in Art. 15 of Revised Ordinances of the City of Austin. We will Establish proper drives, Walks and roadways through the land and from time to time as necessities require improve and beauty the grounds, and will also donate to the city ten acres of land to be used Exclusively for the burial of paupers. 3. Provided the city of Austin will agree to accept and dedicate Said land as a City Cemetery and will not accept or dedicate any other land for a Cemetery until the land above described is reasonably and fairly exhausted for Cemetery purposes. 4. That the Company Shall be allowed to use its own description in laying out and beautifying the grounds, the drives and Walks to be of convenient width. 5. That the Sexton Shall be appointed by the Company and Confirmed by the Council and his acts Controlled by the law as it now Exists. Respectfully, John B. Luton, W. P. Westpomary, Sam Amidon, A. M. Thomson, D. A. Thomson, --- Page break --- James H. Robertson, and associates. The report of the Special Committee on Cemetery above set forth was again read. Cemetery Com. [illegible] Alderman Assmann moved that the report of the Special report. Cemetery Committee be adopted. Alderman Ziller moved as a substitute that the words "Evahe, Sitia et. al, be stricken from the report and that the words "Hamilton, Retan and others" be inserted in lieu thereof. The Chair ruled that the motion was out of Order. The motion made by Alderman Assmann was then adopted by the following vote: Yeas - Aldermen Assmann, Glass, Jackson, Linn, Nitschke, North, Platt, Schuber, Suter, Townsend, Wingfield - 11. Nays - Aldermen Anderson, Hume, Phillips, Schneider, Ziller - 5. Alderman Ziller moved that the proposition of Messrs. Hamilton, Recter and others be accepted. The Chair ruled that the motion was out of order. City Clock. Alderman Nitschke introduced a resolution which was adopted, instructing the Chairman of the Committee on Markets to advertise for bids for winding and keeping in repair the City Clock, from May 1st to Jan1st next. Interest on W&E Bonds Alderman North offered an Ordinance Entitled, "An Ordinance appropriating the sum of five thousand dollars for the purpose of paying interest on the four hundred (400) Waterworks and Electric Light Bonds of the City of Austin due and payable April first, 1891. It was read the first time after which motions were made to suspend the rules and place the same on its second and third readings and that it do pass, all of which were duly adopted by the following vote: Yeas - Aldermen Anderson, Assmann, Glass, Hume, Jackson, Linn, Nitschke, North, Phillips, Platt, Schneider, Schuber, Suter, Townsend, Wingfield, Ziller - 16. " Alderman North also introduced an Ordinance Entitled, "An Ordinance appropriating the sum of One hundred and Thirty Six and 60/100 dollars for the purpose of paying the interest accrued on twenty (20) Waterworks and Electric Light Bonds of the City of Austin." It was read the first time after which motions were made to suspend the rules and place the same on its second and third readings, both of which were adopted by a vote of two-thirds of the whole Council. The Ordinance was upon this read and the motion passed. Alderman North moved that a Special Committee of three be appointed by the Chair to draft the Ordinance in accordance with the report of the Special Cemetery Committee and the proposed remit thereunto. --- Page break --- 114 The motion prevailed and the Chair appointed Aldermen North, Schneider and Glass.
