115 The Minutes of a Regular meeting of the City Council Austin, Tex, May 04, 1891. Hon. John McDonald, mayor, presiding. Absent- Aldermen- Assmann, Graham, Humes, Jackson, Linn, Morris, Newton, Nitschke, Phillips, Schneider, Schuler, Sutor, Townsend, Wingfield- 14. Call of Council. Alderman Carleton moved a call of the Council. Carried. Ald. Townsend & Graham enter. Aldermen Townsend and Graham entered the Council and answered to their names. Recess. Alderman Graham moved that the Council take a recess of fifteen minutes. Adopted. 2d Roll After the Expiration of recess the roll was again Called and recounted as follows: Call. Kennedy fine On the recommendation of the mayor and City Recorder remitted. the fine and Costs assessed in the Recorder's Court against J.E. Kennedy were remitted. Jas. B. Barron. A petition was received from Jas. B. Barron asking the City Council to correct an assessment made against him as administrator for the year 1890 by the board of appraisers and equalization. E. 1st Street Bridge. The City Engineer submitted a report which states that he has had the bridge on East First street, over Waller Creek, nailed up, it being unsafe for travel, and that it will Cost about $125 to repair the same! Referred to the Street Committee. Committee Reports: Jas. O'Reilly. Alderman Carleton, for the Committee on Claims and accounts, to whom was referred the petition of Jas. O'Reilly praying for the refunding to him of the Sum of $19.55 taxes overpaid by him for the year 1890, Submitted a report recommending the granting of the petition and the same was adopted. W. H. Harralson. Alderman Carleton, for the Committee on Claims and accounts, to whom was referred the application of W.H. Haralson for moneys paid out by him for treatment and medicine as a Small Pox patient, after he had gone to the Small Pox Camp Submitted a report recommending that the Claim - $107.90 - be paid. The report was lost by the following Vote: Yeas- Aldermen Carleton, Plott and Sister 3. Nays- Aldermen Anderson, Glass, Graham, Newton, Nitschke, Hanth, Phillips, Schuler, Townsend, Wingfield, Jiller 11. Alderman Carleton, for the Committee on Claims and Accounts, to whom was referred the petition of John Chenneaille asking for relief on account of damage Sustained by him by reason of the raising of the grade of a Certain Street [illegible] named, [illegible] a report recommending that Said petition be referred to the Street Committee, on the [illegible] related to Street [illegible] was [illegible] adopted by a [illegible] [illegible] M. [illegible] Alderman Colton, of the Committee on Claims and Accounts, to [illegible] the petition of [illegible] [illegible] asking the City [illegible] to [illegible] him [illegible] of moneys paid out [illegible] for the purchase of [illegible] [illegible] [illegible] [illegible] from the [illegible] [illegible] of the City. --- Page break --- 118 and for costs and fees paid out by him in suit brought to recover said Cattle from him; offered a minority report thereon, recommending that the petition be not granted, as a purchaser at such sales takes with free notice that he only gets such title as the city can confer. The report was adopted by a rising vote of 9 to 11. Hydrant. Alderman Anderson, for the Committee on water and light, presented an unfavorable report on an Ordinance providing for the erection of a hydrant on the corner of 22½ and Mary Ann streets. The reason assigned for the report is that the financial condition of the city at this time will not permit the expenditure of $504.00, the cost of erection of the proposed hydrant. The report was adopted. Cemetery. Aldermen North, for the Special Cemetery Committee, appointed at the last meeting of the City Council to draft an Ordinance in accordance with the proposal of Messrs. Drasle, Stein et al; to Establish a cemetery, and the report of the Special Cemetery Committee adopted at said meeting accepting said proposal, presented a report, stating that Messrs. Drasle, Stein et al., had withdrawn their proposition to the City which withdrawal does away with the necessity of drawing an Ordinance on the subject. The report was adopted. Unfinished Business. $450° for 10th Ward Streets. An Ordinance, appropriating the sum of four hundred and fifty dollars for material and work on streets in Tenth Ward, was taken up on its second reading. Alderman Glass offered the following amendment thereto: "Strike out after the word purchase in fourth line all the remainder of section first, and add in place of same: Repairing the wooden bridge across Walton Creek on First Street, and to purchase sewer piping for nine street crossings for drainage, placed as follows: Four Crossings on East Third street, East of East Avenue; two Crossings on East Second Street, in same locality, also three Crossings on East First street, in same locality, and for placing said piping in position under said Crossings". " Alderman North moved to lay the amendment on the table which was lost by a rising vote of 6 to 7. " Alderman Carleton then moved to refer the amendment and Ordinance to the Street Committee, and the motion was carried by the following Vote: Yeas - Aldermen Anderson, Carleton, Graham, North, Schober, Duter, Townsend, mayor - x. Nays- Aldermen Glass, Newton, Kilsdale, Phillips, Slatt, Wingfield, Jiller - 7. New Business. The following Ordinances were introduced. $2000 for [illegible]. By Alderman North, An Ordinance appropriating the sum of two thousand one hundred and [illegible] and 41-100 dollars, out of the water and light fund, for the purpose of paying, as in consideration of the said road to the side of the law. It was not the wood lines [illegible] 10[illegible] 2 action was made to adopted the [illegible] and prove the same on this present reading which was lost by the following vote: 11 yeas - Aldermen Anderson, Carleton, Graham, Newton, Kilsdale, --- Page break --- North, Phillips, Schuben, Suiter, Townsend, Wingfield, Zillon - 12. Nays - Aldermen Glass and Platt - 2. Alderman Platt moved to reconsider the vote by which the Council failed to suspend the rules and place the last named Ordinance on its Second reading. Carried. It was then moved that the rules be suspended and the said Ordinance be placed on its second reading. The motion was again lost. Yeas - Aldermen Anderson, Carleton, Graham, Newlon, Nitschke, North, Phillips, Platt, Schuben, Suiter, Townsend, Wingfield, Ziller - 13. Nay - Alderman Glass - 1. Alderman Schneider entered the Council and answered to his name. By Alderman North, An Ordinance Entitled an Ordinance repealing Article 375, Chapter One, title Seventeen of the revised Civil Ordinances of the City of Austin. It was read the first time after which a motion was made to suspended the rules and place the same on its second reading which was adopted by a vote of two- thirds of the whole Council, and the Ordinance was read by Caption. A motion was then made to suspend the rules and place the ordinance on its third readings which was adopted by a vote of two-thirds of the whole Council and the Ordinance was again read by Caption, and on motion passed. By Alderman North, An Ordinance authorizing and Confirming the Sale by the City of Austin and its Board of School Trustees, of its undivided one half interest in the Mewry Irvine and Wm B. Belawn Surveys in Victoria County, Texas, to H. P. Jordan and A. G. Austin. It was read the first time and on motion referred to a Special Committee of three. The Chair appointed Aldermen Schneider, Carleton and Townsend as such Committee. By Alderman North, An Ordinance to repeal an Ordinance entitled An Ordinance appropriating the sum of five thousand dollars to pay the interest accrued on the bonds of the City issued for Constructing a water and light system for the City of Austin, approved December 18, 1893. It was read the first time and referred to the Committee on Finance. By Alderman North, An Ordinance appropriating the sum of five thousand dollars for the purpose of paying interest on the eleven hundred (1100) water works and Electric light Bonds of the City of Austin due and payable January first, 1891. It was read the first time and referred to the Finance Committee. By Alderman North, An Ordinance appropriating the --- Page break --- 120 Sum of 2410.39 for the purpose of paying approved accounts. It was read the first time, after which a motion was made to suspend the rules and place the same on its second reading, which was adopted by a vote of two-thirds of the whole Council. The Ordinance was read by Caption, after which Alderman Jas. O'Reissy. Carlton moved to amend Section One thereof by inserting therein the sum of $19.55, to refund to Jas. O'Reilly taxes over paid by him for 1890. Carried. The Caption and Section One were changed to Conform to the amendment by striking out the sum of $2410.57 and inserting instead $2430.14. A motion was then made to suspend the rules and place the Ordinance on its third reading, which was adopted by a vote of two thirds of the whole Council. The Ordinance was again read by Caption, and on motion, passed by the following vote: Yeas- Aldermen Anderson, Carlton, Glass, Graham, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuber, Suter, Townsend, Wingfield, Ziller -15. B. Corrigan Estimate By Alderman North, An Ordinance appropriating the sum of #6. five thousand four hundred and Seventy Six 55/100 dollars, out of the water and light fund, for the purpose of paying Estimate No. 6 of Bernard Corrigan's Contract of November 7, 1890, with the City. The Ordinance and Estimate named therein were read, Alderman Glass then moved that the Ordinance lie over until the next meeting of the Council last. A motion was then made to suspend the rules and place the Ordinance on its second reading, which was adopted by a vote of two-thirds of the whole Council. The Ordinance was read by Caption, after which a motion was made to suspend the rules and place the same on its third reading, which was adopted by a vote of two-thirds of the whole Council. The Ordinance was again read by Caption, and on motion, passed by the following vote: Yeas- Aldermen Anderson, Carlton, Graham, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Suter, Townsend, Wingfield, Ziller - 14. Nay- Alderman Glass. Swearingen, W.M. The resignation of W. M. Swearingen as a member of the Board of Public Works was received, read and accepted. Capital Ice Co. Alderman Carlton introduced an Ordinance authorizing the Capital Ice Company to use the premises on the river Note in Austin, Texas, leased to it by the City December 9, 1891, for the further purposes of a tanning and general manufacturing business. It was read the first time after which a motion was made to suspend the rules and place the same on its second reading, which was adopted by a vote of two-thirds of the whole Council. The Ordinance was then read by Caption after which a motion was made to suspend the rules and place the same on its third reading, which was adopted by a vote of two-thirds of the whole Council. The Ordinance was again read by Caption and on motion --- Page break --- Passed. Council met : future at 6:30 p.m Mrs Siddal. Alderman North moved that hereafter the City Council shall meet in regular session at 8:30 o'clock, p. m., instead of 8 o'clock p. m. Carried. Alderman Wingfield moved that Mrs. Siddal be permitted to so brace her house now partly Constructed in the Tenth Ward as to enable her to move the same back to the proper line. the same to be done under the Supervision of the City Engineer.
