The Minutes of a Called Meeting of the City Council.
Austin, Texas, May 06, 1891.
Hon John McDonald, mayor, presiding.
Roll Roll Called. Present- Aldermen Glass, Linn, Morris, Call. North, Schuber, Townsend, Wingfield, Ziller - 8. Absent- Aldermen Anderson, Assmann, Carleton, Graham, Hume, Jackson, Newton, Nitschke, Phillips, Platt, Schneider, Sutor - 12.
Call of Council. Alderman North moved a Call of the Council, which was duly adopted.
2d Roll. Second Roll Call. Present- Aldermen Carleton, Glass, Graham, Linn, Morris, Newton, Nitschke, North, Phillips, Schuber, Sutor, Townsend, Wingfield, Ziller - 14. Call. Absent- Aldermen Anderson, Assmann, Hume, Jackson, Platt, Schneider-6. Call Suspt. Alderman Linn moved to Suspend the Call of the Council. Adopted. Call of Council The following Call was then read: read. Mayor's Office, Austin, Texas, May 6, 1891. To the Board of Aldermen of the City of Austin: Gentlemen: I hereby Call a Special meeting of the City Council of the City of Austin, to assemble at the city hall at 5 o'clock p.m. this the 6th day of May, 1891, for the purpose of making an appropriation to defray the expenses of the Small Pox Camp, and also for the purpose of further Considering an Ordinance now pending before the Council making an appropriation of $5579.41 out of the Water and Light fund for the purpose of paying for the Construction of the railroad to the Site of the dam, and to Consider such other matters as I may present for your Consideration. John McDonald, Mayor.
Officers Report of Service. Austin, Texas, May 6, 1891. I hereby Certify that Aldermen Assmann, Carleton, Glass, Graham, Linn, Morris, Newton, Nitschke, North, Phillips, Schneider, Schuber, Sutor, Townsend, Wingfield, and Ziller have been duly Served by reading the above Call to each of them and that a true copy of the Same has been Served by leaving at the place of business of Aldermen Anderson, Hume, Jackson and Platt, they being out of the City. John Clenneville, Police Officer.
Mayors messge. The Mayor presented the following message: Austin, Texas, May 6, 1891.
Hon City Council: Gentlemen: I have the honor to inform you that I have had a certified copy of the new City Charter prepared, and it is now in the hands of the printer, who was to have finished it today, but now promises that it will be ready for distribution tomorrow. I respectfully Submit herewith the official opinion of Hon. Geo. W. Pendleton, City attorney, concerning the assessment of the property added to the City by the new Charter, and I recommend that the City Engineer be instructed to make Surveys and mark the lines

of the present city limits, and that the Assessor and Collector be authorized to list and assess all property within such limits, and enumerate the inhabitants. It will be necessary to furnish a map and other data to the United States postal authorities, in order that proper arrangements may be made for the Extension of the Letter Carrier System over the newly acquired territory. Your obedient Servant, John McDonald, Mayor. Cit[illegible] City Atty. The following opinion of the City Attorney was read: [on lay][illegible] Austin, Texas, April 28 1891. [illegible] Hon. John McDonald, Mayor, Austin, Texas: Dear Sir:- Replying to your late favor, I beg to say that in my opinion the City Council of Austin has the power and that it is its duty to levy a tax on all property real and personal situated within the Corporate limits of said City at the date the tax is levied. Very Respectfully, Geo. F. Penderter, City Attorney.
$1000- Small Pox. Alderman Linn presented an Ordinance entitled: An Ordinance appropriating the Sum of One thousand dollars for the purpose of maintaining a place for the Care of persons affected with Small Pox. It was read the first time, after which motions were made to suspend the rules and place the Ordinance on its Second and third readings, and that it do pass- all of which were adopted by the following vote: Yeas- Aldermen Carleton, Glass, Graham, Linn, Morris, Newton, Nitschke, North, Phillips, Schuber, Sutor, Townsend, Wingfield, Ziller- 14.
R.R. to Dam$5519.41 An Ordinance appropriating the Sum of $5519.41 out of the water and light fund, for the purpose of paying for the Construction of the railroad to the site of the Dam, was taken up on its second reading and read. Alderman Morris then moved a Call of the Council, which was adopted. Alderman Linn moved to Suspend the Call. Adopted Alderman Carleton moved that the rules be suspended and that the last above named Ordinance be placed upon its third reading. The motion was lost by the following vote: Yeas- Aldermen- Carleton, Graham, Newton, North, Phillips, Schuber, Sutor, Townsend, Wingfield- 9. Nays- Aldermen Glass, Linn, Morris, Nitschke, Ziller- 5. Call of [illegible]. Alderman North moved a Call of the Council which was duly adopted. Call of [illegible] Alderman Morris moved to suspend the Call. Carried. [illegible] Alderman Morris then introduced a resolution directing the City Engineer to survey and mark the boundary lines of the City as Established by the new Charter. The resolution was read, and on motion of Alderman Morris laid on the table Subject to Call.

R.R. to Dam $5517.41 Alderman Linn moved to reconsider the vote by which the Council refused to suspend the rules and place on its third reading an Ordinance appropriating $5517.41 for the purpose of paying for the Construction of the railroad to the site of the dam. The motion prevailed and it was again moved to suspend the rules and place the Ordinance on its third reading and the motion was again lost by the following vote: Yeas- Aldermen Carleton, Graham, Linn, Morris, Newton, Nitschke North, Phillips, Schuber, Sutor, Townsend, Wingfield, Tilley -13. Nay- Alderman Glass. Alderman Nitschke then moved that the Council stand adjourned until 5 o'clock p.m. Thursday, May 7th 1891. Adopted.

The minutes of an adjourned Called meeting of the City Council. Austin, Texas, May 7, 1891. Hon. John McDonald, mayor, presiding. Roll Called. Present- Aldermen Anderson, Carleton, Glass, Jackson, Linn, Morris, North, Schuler, Townsend, Ziller - 10. Absent- Aldermen Assmann, Graham, Hume, Newton, Nitschke, Phillips, Platt, Schneider, Suter, Wingfield - 10. Alderman Morris moved a Call of the Council which was duly adopted. Alderman Ziller moved to suspend the Call of the Council and it was agreed to. The roll was again Called and showed the following result. Present- Aldermen Anderson, Carleton, Glass, Jackson, Linn, Morris, North, Platt, Schuler, Suter, Townsend, Ziller - 12. Absent- Aldermen Assmann, Graham, Hume, Newton, Nitschke, Phillips, Schneider, Wingfield - 8. Alderman Graham entered the Council and answered to his name. R.R. to Dam $5517.41. The pending business being an Ordinance entitled "An Ordinance appropriating the sum of $5517.41 out of the Water and light fund for the purpose of paying for the Construction of the railroad to the site of "the dam", it was taken up on its third reading and read by Caption, and on motion passed by the following Vote: Yeas - Aldermen Anderson, Carleton, Graham, Jackson, Linn, Morris, North, Platt, Schuler, Suter, Townsend, Ziller - 12. Nay - Alderman Glass. Alderman Linn moved that the Council Stand Adjourned. Adopted. Milton Morris, City Clerk.
