Aldermen Lisin, Nitschke. – 2. Called. Minutes The minutes of the meetings of the City Council which were held on the 18th and 19th days of May 1891 were read and adopted as presented. Petitions and Memorials. Herndon, E. W. A petition was received from E. W. Herndon asking that the street in front of No 304. West 8th Street be graded. It was read and referred to the Street committee. Hoge, Mrs. W. N. A petition from Mrs. W. N. Hoge concerning the sale of her cow at the city pound, was received and referred to the committee on claims and accounts. Wells, J. S. Duane, F. E. Claims were received from J. S. Wells ($100.) and F. E. Duane ($50.), for damages because of the use of farm land on account of its being so near the Cemetry as to make the cultivation of the same dangerous. They were read and referred to the Committee on Claims and accounts. Flume, R. A. A claim was received from R. A. Flume for $300. damages caused to his property by the cutting down of the street in front of the same. It was read and referred to the Street Committee. Graves, N. S. Dr. N. S. Graves, City Physician, was granted leave of absence for Three weeks from June 8. 1891. Seekatz, R. On the recommendation of the Mayor the fine assessed in the recorders Court against R. Seekatz, was remitted. Kinney, H. B. Alderman Sutor presented a claim from H. B. Kinney, for $29.70 damages to rock wall, caused by overflow. It was read and referred to the Street Committee. Palmer, C. C. Alderman Phillips presented a claim of $100. from C. C. Palmer, policeman, for extra services rendered the city, on account of small pox, and moved that the Mayor be authorized to draw a warrant in payment of the same. Referred to the finance committee. Reports of Committees. Roy, W. C. Alderman Schneider, for the fire committee, presented an unfavorable report on a petition from W.C. Roy, requesting permission to erect a frame building on the Northeast corner of Heart No. 180, in the fire limits. The report was adopted. Haralson, W. H. Alderman Carleton, for the Committee on Claims and Accounts, presented a report stating your committee to whom was referred the petition of W. H. Haralson have considered the same and recommend that the same be granted. The report was adopted by the following vote: Yeas - Aldermen Anderson, Carleton, Glass, Graham, Jackson, Moiris, Newton, Reich, Phillips, Pluett, Schneider, Suter, Townsend, Wingfield - 15 --- Page break --- 139 Hart, Ranss. Nays, Aldermen, Dime, Schutze, Gillen- 3 Alderman Pendleton, for the committee on claims and accounts to whom was referred, the claim of Ranss Hart asking for compensation for property destroyed because same was supposed to be infected by small pox germs, submitted an unfavorable report thereon. It appearing that the applicant Hart, received back from the authorities in charge of the small pox camp, clothing and other property greatly in excess of the goods so taken from him. Alderman Phillips moved to again refer the petition to the committee on claims and accounts. Lost. The report was then adopted. Achilles, A.H. Alderman Carleton, for the Committee on claims and accounts, to whom was referred a claim from A.H. Achilles, for $150. damage done to a house of his caused by a defective gutter or sewer, submitted a report thereon recommending that the claim be referred to the Street Committee and Superintendent of Streets. The report was adopted. Wards. Alderman Morris introduced the following report. Austin Texas June 1. 1891. To the Hon Mayor and Board of Alder- men of the City of Austin: Your Special Committee appointed to report on the city wards beg leave to report that they have given the subject careful consideration and as the result of their work submit the accompany- ing ordinance and recommend its passage. In order that the legal status of the Council might not be brought in question on its acts passed, your Committee thought it best not to change the ward lines that any alderman will live in a different ward under the new apportionment from that from which he was elected. We have, therefore, as far as practicable, followed the boundaries of lines as established under the old city charter and so revised the same as to take in the additional territory embraced in the present city limits. These slight changes made necessary in the lines of wards as established under the old charter with a view of equalizing as near as practicable --- Page break --- 140 the population of each ward. The ordinance contained in this report was laid over to be taken up as next business. Bannan, J.B. The report of the finance committee on the petition of Jas. B. Bannan asking that he be relieved from an assessment of $92.75 wrongfully assessed against him as administrator for the year 1890, which was read and laid over at the last meeting of the council, was again taken up and on motion adopted. New Business. Wards. An ordinance entitled "An Ordinance to divide the City of Austin into wards, to establish the same and fix the boundaries thereof and to provide for the election of aldermen from the Eleventh ward," and which was introduced with the report of the Special committee on wards' boundaries, was taken up and read in full. A motion was then made to suspend the rules and place the same on its second reading, which was adopted by a vote of two thirds of the whole council. The ordinance was then read by caption after which a motion was made to suspend the rules and place the same on its third reading, which prevailed by a vote of two thirds of the whole council. The ordinance was again read by caption and on motion passed by the following vote: Yeas. – Aldermen Anderson, Aue, Blume, Graham, Jackson, Morris, Newton, Phillips, Phillips, Schneider, Schuker, Sutor, Townsend, Springfield – 14. Nays. Aldermen Castleman, Glass, Place, Zilker. – 4. Jud. Comttee. By Alderman Zilker, introduced a resolution which was adopted, instructing the City Treasurer to transfer the sum of $180. --- Page break --- 141 Stiles, E. P. Cemetery. from the Cemetery fund to the general fund. Alderman Herndon moved to reconsider the vote, by which the City Council at its last regular meeting accepted the proposition of E. P. Stiles and associates to establish and maintain a cemetery. The following ordinances were then introduced. Interest. By Alderman North, an ordinance appro- priating the sum of five thousand dollars for the purpose of paying interest on the 400 water works and Electric light bonds of the city of Austin from April 1st to July 1st 1891. It was read the first time after which a motion was made to suspend the rules and place the same on its second reading which was adopted by a vote of two thirds of the whole council. The ordinance was then read a second time by caption after which a motion was made to suspend the rules and place the same on its third reading which prevailed by a two thirds vote of the whole Council, and on motion passed by the following vote: Yeas, Aldermen Andrews, Brenneke, Herndon, Glass, Graham, Hense, Judson Morris, Newton, North, Phillips, Platt, Schneider, Shuler, Sutor, Townsend, Wingfield, Geilen — 18. Approved acct's. By Alderman North an ordinance appropriating the sum of $5,704.49 for the purpose of paying approved accounts. It was read the first time after which a motion was made to suspend the rules and place the same on its second reading which was adopted by a vote of two thirds of the whole Council. The ordinance was then read a second time by caption. Survey of City line. Alderman North then moved to amend the same by deducting from the caption and body of the ordinance the item of $53.55 for the purpose of paying for the survey made of the City line. The amendment was lost by a rising vote of 5 to 12. Alderman Geilen then moved to amend the caption and body of the ordinance by deducting the item of $974.80 to pay the St. Louis Stamping Co. for signs used by the city during 1890 for flushing the gutters. Lost. --- Page break --- 142 Haralson, W. H. The amendment prevailed by a rising vote of 10 to 6. Alderman Carleton then moved to amend the caption and section one of the ordinance by inserting the sum of $107.90 for the purpose of paying the claim of W. H. Haralson for medical attendance and medicine while he was sick with the small pox. The amendment was adopted. The caption was changed by striking out the sum of "$5,704.40" and inserting instead "$3,089.59 A motion was then made to suspend the rules and place the ordinance on its third reading which was adopted by a vote of two thirds of the whole council. The ordinance was then read by caption a third time and on motion passed by the following vote: Yeas -- Aldermen Anderson, Assmann Carleton, Glass, Graham, Hamer, Jackson, Morris, Newton, North, Phillip, Plato Sutor, Townsend, Wingfield -- 15. Nays -- Aldermen Schneider, Schubert, Ziller -- 3. Corrigan, B. Est.. No. 7 J 34. Alderman North, an ordinance appropriating the sum of $4,759.96 for the purpose of paying Estimate No 7 in favor of Bernard Corrigan under his contract with the city of Austin dated Nov 7. 1890. for constructing the dam. It was read the first time after which a motion was made to suspend the rules and place the same on its second reading, which prevailed by a vote of two thirds of the whole council. The ordinance was then read by caption a second time, after which a motion was made to suspend the rules and place the same on its third reading, which prevailed by a vote of two thirds of the whole council. The ordinance was then read a third time by caption and on motion passed by the following vote: Yeas -- Aldermen, Anderson, Assmann, Carleton, Glass, Graham, Hamer, Jackson, Morris, Newton, North, Phillip, Plato, Schneider, Schubert, Sutor, Townsend, Wingfield, Ziller -- 18. Nays -- None. Cemetery fund Alderman Ziller moved that the Cemetery Receipts be authorized --- Page break --- 143 to remove the dead house to the Backside of the Cemetery. Carried. By Alderman North an ordinance appropriating the sum of one thousand four hundred, and fourteen and 30/100 Dollars, for the purpose of paying for labor and material for the railroad to the site of the dam. It was read the first time after which a motion was made to suspend the rules and place the same on its second reading, which was adopted by a vote of two thirds of the whole council. The ordinance was then read by caption after which a motion was made to suspend the rules and place the same on its third reading, which was adopted by a vote of two thirds of the whole council. The ordinance was then again read by caption and on motion passed by the following vote.
