150 The minutes of a regular meeting of the City Council. Austin, Texas, July 06, 1891. Hon. John McDonald, mayor, presiding. Roll Roll Called: Present: Aldermen Anderson, Assmann, Carleton, Glass, Hume, Jackson, Linn, Marris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Duton, Townsend, Wingfield, Ziller. — 19. Called. Absent — Alderman Graham. City Clerk relieved Alderman Marris moved that Mr. Neil McAshin be requested temporarily. to relieve the City Clerk temporarily from attendance upon the Council, to enable him to complete the general appropriation Ordinance. Carried. Minutes. Alderman Carleton moved that the minutes of the meeting of the City Council which was held on the 15th day of June, 1891, be adopted as printed. Carried. Election returns Alderman North moved that the regular Order of business 11th Ward. be dispensed with, for the purpose of canvassing the returns of the election held in the 11th Ward, June 2d, 1891, for the purpose of electing two aldermen, and that three tellers be appointed for that purpose. The motion carried, and the chair appointed Aldermen Carleton, Ziller and Schneider. Alderman North moved that the Council take a recess until the Committee is ready to report. Carried. The Council was soon called to order to receive the report of the tellers, which was as follows: R. Weyerman Robert Weyerman received 39 Votes. H. J. Sketchum H. J. Sketchum received 38 Votes. Elected. The Mayor then declared Robert Weyerman and H. J. Sketchum duly elected. Ald. Graham. Alderman Graham entered the Council and answered to his name. A motion was made that a Committee of three be appointed to Escort the Aldermen elect to the bar of the Council. The motion prevailed, and the Chair appointed Aldermen Phillips, North and Nitschke, who retired, but soon reappeared at the bar of the Council, accompanied by the aldermen elect, Robert Weyerman and H. J. Sketchum, to whom the Mayor administered the oath of office They then took seats in the Council Chamber. Petitions, Memorials, Etc. Are Light. By Alderman Glass, a petition of citizens, requesting that the are light now located at the intersection of Congress Avenue and Second Street, be removed to the intersection of Congress avenue and First Street. Referred to the Water and Light Committee. Bone Yard. By Alderman Glass, a petition of citizens, asking that the “bone yard” be removed outside of the city limits. Referred to the Committee on Sanitation and a report. City Revenue On the recommendation of the Mayor and Aldermen then the Council remitted the fine assessed in the Police Court against W. C. Bridge - Cost. Referred to Finance Committee. By Jas. P. Frizell, Chief Engineer, for the month of June, 1891, was read and referred to the Committee on water and lights. By the City Engineer: Report of probable Cost of bridge to be built on the Fishville road near the Southwest Corner of Hyde Park:- Amount $44.00. Alderman Phillips moved that the City Engineer be instructed to have the bridge mentioned built as as possible. Carried. Reports of Committees. Alderman Phillips, for the Street Committee, requested further time in which to report on Various Claims referred to Said Committee. Adopted.
Police Com. on Marshals reports. By Alderman Graham, for the police Committee, report on the city Marshals reports for the months of March, April and May, 1891. The reports of the Committee State that the reports of the Marshal have been examined and found Correct. Laid over without action.
Painting Signs art. 112 a By Alderman North, for the Ordinance Committee, a report on an Ordinance to amend Chapter Two, Title III, of the Revised Penal Ordinances of the City of Austin, by adding thereto another Article to be known as Article 112 a, of Chapter Two, of Title III, of Said Ordinances, relative to painting Signs on Sidewalks. The report recommends the passage of the Ordinance with the following amendment: "Provided, that the provisions of this article shall not apply to persons doing or causing Said acts to be done on Sidewalks abutting premises owned or Controled by them". The report was laid over to come up with Said Ordinance, named therein.
Slaughter Pens. By Alderman Jackson, for the Committee on Sanitation and Sewerage, report on a Communication from the Sanitary Inspector calling for instructions concerning Slaughter pens, that were taken into the City by the passage of the new Charter. The report recommends that all slaughter pens in the City be removed beyond the limits of the City by Jan. 1, 1892. Alderman Graham moved as a Substitute for the report that the report be recommitted with instructions to the Committee to report an ordinance to regulate said pens within the City limits. This was Carried.

State Sewer. The report of the Committee was then adopted. By Alderman Jackson, for the Committee on Sanitation and Sewerage, a report on a communication from the Sanitary Inspector concerning the unhealthy condition of the mouth of the State Sewer. The report States that it will cost about $50 to repair the same but does not recommend that the sum be appropriated to repair it as the Sewer belongs to the State. Alderman North moved that the City Clerk be instructed to hand a certified copy of the Communication from the Sanitary Inspector and the report of the Committee thereon to Gen. W. P. Hardeman, Superintendent of public buildings and grounds and respectfully request him to take due notice of the same. The motion was adopted.
G. a. Balm. Alderman Linn, for the finance Committee, to whom was referred a proposal from G. A. Balm to keep the City Clerk in repair, made a Verbal report thereon stating that no provision has been made for the purpose named in the proposal, that the Committee be discharged from further consideration of the same. By unanimous Consent the Committee was discharged as requested.
Purchases. By Alderman North, for the Special Committee appointed at the last meeting of the Council, by resolution, to prepare and submit an Ordinance concerning the manner of purchasing certain supplies for the city, Submitted a report stating that the Ordinance was prepared, and was ready for submission to the Council. On motion the report was laid over to be taken up with the Ordinance named therein.
Signs. Unfinished Business. An Ordinance to amend - Chapter two, title iii, of the Revised Penal Ordinances of the City of Austin by adding thereto another article to be known as article 112a of Chapter two of title iii, of said Ordinances, was taken up on its second reading, and read together with the reports of the Ordinance Committee thereon, which is also set forth. A motion was made to suspend the rules and place the Ordinance on its third reading, which was lost by the following Vote: Yeas. Aldermen Carleton, Glass, Graham, Jackson, Linn,

The following Ordinances were introduced: By Alderman Morris:First. of Article fifty eight, title ii, Chapter 10, of the Revised Criminal Ordinances of the City of Austin. The Ordinance was read the first time after which a motion was made to suspend the rules and place the same on its second reading which was adopted by a vote of two thirds of the whole Council. The Ordinance was then read by caption after which Alderman Ketchum moved to amend the same by striking out the words "North of the Colorado river" and" and also by striking out the words "Colorado river", between the words "the" and "between", and inserting in lieu of the latter the words, "Southern limits of the city." The amendment was adopted. A motion was then made to suspend the rules and place the Ordinance on its third reading which was adopted by the following vote: Yeas. - Aldermen Anderson, Assmann, Graham, Hume, Jackson, Ketchum, Linn, Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuber, Sutor, Townsend, Weyerman, Wingfield - 19. Nays.- Aldermen Carleton, Glass, Ziller.- 3. The Ordinance was then read by caption a third time and on motion passed. Purchasing Com. By Alderman North:- An Ordinance Creating a purchasing Committee for the City of Austin, and defining the duties thereof. It was read the first time after which Alderman North moved that the same be printed in full in the Minutes and lie over until the next meeting of the Council. Carried. Carrigan $692.84 for By Alderman Linn:- An Ordinance appropriating the day work. sum of $692.84, for the purpose of paying Bernard Carrigan for day work performed in excavating ditches and removing dirt from same. It was read the first time after which motions were made to suspend the rules and place the same on its second and third readings, and that it do pass, all of which were adopted by the following vote: Yeas.- Aldermen Anderson, Assmann, Carleton, Glass, Graham, Hume, Jackson, Ketchum, Linn, Morris, Nitschke, North, Phillips, Platt, Schneider, Schuber, Sutor, Townsend, Weyerman, Wingfield, Ziller - 21. Nay.- Alderman Newton. The Food By Alderman Linn.- An Ordinance appropriating the sum of $2.171.85, for the purpose of paying accounts for work done in the [illegible] approved by the Site of the same. were made to Suspend the rules and place the Same on its Second and third readings and that it do pass, all of which were adopted by the following vote: Yeas– Aldermen Anderson, Assmann, Carleton, Glass, Graham, Hume, Jackson, Ketchum, Linn Morris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuben, Sutor, Townsend, Weyerman, Wingfield, Ziller.– 22. apprd acts. By Alderman Linn, an Ordinance appropriating the Sum of $1999.50, for the purpose of paying approved accounts. It was read the first time after which a motion was made to Suspend the rules and place the same on its second reading which was adopted by a vote of two-thirds of the whole Council. The Ordinance was then read by Caption after which Alderman Morris moved to amend the same by adding $16.25 to pay Hutchings Printing House for printing pamphlets. adopted. Alderman Linn moved to amend the Ordinance by adding $14, to pay W. M. Mielby for assisting in engrossing the new City Charter. The amendment was adopted by the following vote: Yeas- Aldermen Assmann, Carleton, Glass, Ketchum, Linn, Morris, Newton, Phillips, Platt, Schuben, Townsend, Wingfield, Ziller.– 13. Nays- Aldermen Anderson, Graham, Hume, Jackson, Nitschke, North, Schneider, Sutor, Weyerman.– 9. On motion the Caption and Section one of the Ordinance were amended by Striking out the Sum of $ "1999.50", and inserting the Sum of "$2024.95" instead, in order to agree with the amendments. Motions were then made to Suspend the rules and place the Ordinance on its third reading and that it do pass, both of which were adopted by the following Vote: Yeas,- Aldermen Anderson, Assmann, Carleton, Glass, Graham, Hume, Jackson, Ketchum, Linn, Morris, Newton, North, Phillips, Platt, Schuben, Sutor, Townsend, Weyerman, Wingfield, Ziller.– 20. By Alderman Linn :- An Ordinance appropriating the Sum of $1629.08, for the purpose of paying Estimate No. 8 of labor and material furnished by Bernard Carrigan in the construction of the dam. under Contract dated November 7, 1890. 156 Schneider, Schuber, Sutor, Townsend, Weyerman, Wingfield, Ziller – 22. Alderman Phillips presented an additional proposal from Highland Park Cemetery Association, per G. P. Stiles, agent, stating that Cemetery Stiles. the Association would furnish a piece of ground, which is a part of the proposed Cemetery, for the temporary interment of paupers. Changes to be the same as named in the proposal already accepted by the city. All proposal was referred to the Cemetery Committee, without being read. Aldermen Ziller, Linn and Platt were excused. Water in gutters. By Alderman Jackson:- An Ordinance to repeal Article 150 of Chapter One, Title IV of the Revised Criminal Ordinances of the City of Austin. The Article named permits the running of Water, not offensive, into paved gutters. It was read the first time after which a motion was made to suspend the Rules and place the same on its second reading which was lost by the following vote: Yeas – Aldermen Assmann, Graham, Hanna, Jackson, Morris, Schneider, Sutor – 7. Nays – Aldermen Anderson, Carleton, Glass, Ketchum, Newton, Nitschke, North, Phillips, Schuber, Townsend, Weyerman, Wingfield – 12. Hospital monies. By Alderman North:- A resolution requiring the matron of the City hospital to report all monies collected by her to the City Council. Adopted. Financial Estimate. By Alderman Morris:- A resolution which was, adopted the following estimates in Compliance with Section 106 of the City Charter: An estimate of the income and expenses of the City of Austin, account of general fund, from June 1, 1891, to November 30,1891: Income: Ad Valorem tax $ 28.859.00 License tax 6.000.00 Recorders Court 2.000.00 City and County Hospital - from Travis Co. 437.50 City Cemetery 75.00 Rents and Miscellaneous 650.00 Cash in Treasury – June 1st 11.000.00 $ 49.021.50
