Minutes of a Regular meeting of the City Council. Austin, Texas, November 02, 1891. Hon. John McDonald, Mayor, presiding.
Roll Roll Called: Present- Aldermen Anderson, Carleton, Glass, Graham, Hume, Jackson, Ketchum, Linn, Marris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Suter, Townsend, Wayerman, Wingfield, Ziller- 21. Call. Absent- Alderman Assmann. Minutes. Alderman Linn moved that the reading of the minutes of the City Council, which was held on the 19th day of October, 1891, be dispensed with and that they be adopted as printed. Carried.
Lease of Dam R.R. Alderman North moved that the regular order of business be amended. suspended, and that the vote by which the Council passed at its last meeting, an Ordinance entitled, "An Ordinance leasing to William Morgan, Richard Snell and D.L. McMartin, their representatives, assigns and Successors, the property of the city of Austin known as the Dam railroad, and granting them the option to purchase the same, and granting them the right to operate and maintain Street railroads within the city of Austin" be reconsidered. The motion prevailed, and Alderman North presented the following amendment to be added to Section 12 of said Ordinance: "And provided further, that all tracks built by said lessees or their assigns or Successors hereunder, as well as this franchise, shall revert to, and become the property of the City together with all improvements made on said rail way by said lessees, their assigns or Successors, (Except the rolling stock thereon) Should they fail to Exercise their Option of purchase of Said Dam railroad given under this lease." Alderman Assmann entered the Council and answered to his name. The amendment was then adopted by the following vote: YeasAldermen Anderson, Assmann, Carleton, Glass, Graham, Hume, Jackson, Ketchum, Linn, Marris, Newton, Nitschke, North, Phillips, Platt, Schneider, Schuler, Suter, Townsend, Wayerman, Wingfield, Ziller- 22. Alderman Marris moved that the Ordinance do now pass. Alderman Platt moved as a Substitute that the Ordinance be published and that further action thereon be postponed until the next meeting of the City Council. The Substitute was lost by the following Vote: Yeas- Aldermen Hume, Newton, Platt, Wingfield- 4. Nays- Aldermen Anderson, Assmann, Carleton, Glass, Graham, Jackson, Ketchum, Linn, Marris, Nitschke, North, Phillips, Schneider, Schuler, Suter, Townsend, Wayerman, Ziller- 18. The motion made by Alderman Marris was then adopted. Petitions, Memorials, Etc. Ladies - City Cemetery. The Mayor laid before the Council a petition from the ladies of the city asking the City Council to have the city Cemetery cleaned, beautified, Etc. " " The Mayor Submitted a message recommending that an appropriation of $200.00 be made for the purposes named in the petition. Alderman Graham moved that the petition and message be referred to the Ordinance Committee. Alderman North moved to amend by calling the Cemetery Committee-

By Alderman Linn:- A petition of Citizens asking that the Ordinance regulating the hauling of Slops, Swice, etc be repealed. Alderman Linn moved that it be referred to the Ordinance Committee with instructions to report an Ordinance at the next meeting of the Council Covering the request Contained in the petition. Carried. Jas. Aug. Sti.. hofer A communication was received from Jas. Aug. Steinhofer Concernfiltering ing his patent filtering apparatus. It was referred to the Com- mittee on Water and Light. Reports- (read Reports of City Officers for the month of Oct., 1891. By the City Clerk: Statement of warrants issued against the general fund for the month of Oct. Total, $5,457.93. Referred to Finance Committee. By the City Clerk: Statement of warrants issued against the Water works and Electric light fund during the month of Oct Total $19,618.40. Referred to the Finance Committee. By the City Clerk: Statement of warrants issued against the water works and Electric light interest fund during Oct., Total, $10,000[illegible]. Alderman Phillips moved that the Committee on Parks and the City Attorney be instructed to ascertain if the City has the legal right to control any or all of the public grounds in the City. Carried. Unfinished Business. Fire- alarm of. An Ordinance Entitled "An Ordinance amending article 214, Chapter four, title five of the Revised Penal Ordinances of the City of Austin", was taken up on its second reading and read. Alderman Keller moved to amend the same by striking out the words "on any church, hotel or other bell." Carried. Alderman Phillips was excused. A motion was then made to suspend the rules and place the last above named Ordinance on its third reading, which prevailed by a vote of two-thirds of the whole Council. The Ordinance was accordingly read and on motion passed. New Business. Firemens Hall. By Alderman Schneider- A resolution requiring the City Engineer to inspect and report on the condition of firemens hall on merlett Square. Adopted. Carrigan, B. By Alderman Linn - An Ordinance appropriating the sum of Twenty Nine thousand and Eighty One and 52/100 dollars for the purpose of paying Estimate No. 12 in favor of Bernard Carrigan for material furnished and labor performed on the dam for the city of Austin, under contract with the City of Austin, dated November 2, 1890. The Ordinance was read the first time, after which motions were made to suspend the rules and place the same on its second and third readings, both of which were adopted by a vote of two-thirds of the whole Council. The Ordinance was accordingly read, and on motion passed by the following vote: yeas - Aldermen Anderson, Aheemans, [illegible], Glass, Graham, Dunn, Jackson, Hutchins, Linn, Morris, Newton, Nitschkie, North, Pratt, Schneider, Stevens, Staten, Townsend, [illegible], Wingfield, yeas - 21

Appt. accts. By Alderman Linn- An Ordinance appropriating the Sum of $2,202.75 for the purpose of paying approved accounts. The same was read the first time, after which a motion was made to suspend the rules and place the Ordinance on its second reading, which was adopted by a vote of two-thirds of the whole Council. The Ordinance was accordingly read, S. P. Kinney. after which Alderman Platt moved to amend Section One by inserting "$25.00 to pay S. P. Skinney for rent of house." The amendment carried by the following Vote: YeasAldermen Assmann, Glass, Jackson, Ketchum, Morris, Newton, Platt, Schneider, Sutton, Weyerman, Wingfield, Ziller- 12. Nays- Aldermen Andersen, Carleton, Graham, Hume, Linn, Nitschke, North, Schuler, Townsend- 9. The Caption and Section one of the Ordinance were changed to Conform to the amendment by striking out "$2,202.75" and inserting in lieu thereof "$2. 227.75." Motions were then made to suspend the rules and place the Ordinance on its third reading, and that it do pass, both of which were adopted by the following Vote: Yeas- Aldermen Anderson, Assmann, Carleton, Glass, Graham, Hume, Jackson, Ketchum, Linn, Morris, Newton, Nitschke, North, Platt, Schneider, Schuler, Sutton, Townsend, Weyerman, Wingfield, Ziller- 21. Election- By Alderman Morris: A resolution providing, first, Places & that a special Committee of three, who with the City Clerk, Judges. Shall select and Contract for some Suitable place in Each ward to hold the City Election on the first Monday in December; Secondly, That both Aldermen from the Eleventh Ward, and the aldermen from each of the otherwards whose term does not Expire this year, be appointed a Committee of one to see and obtain the Consent of Suitable persons to serve as election Judges, and report their names to the next regular meeting of the Council for appointment by the Council as election Judges. The resolution was adopted, and the Mayor appointed Aldermen Morris, Schneider and Assmann as the Committee to Select and Contract for Suitable places for holding the next City Election.
