Minutes of a Called Meeting of the City Council.
Austin, Texas, November 11, 1891. Hon. John McDonald, Mayor, presiding.
Roll Call: Present- Aldermen Assemann, Carleton, Bless, Hume, Ketchum, Marris, Newton, N.Tischke, North, Phillips, Platt, Schuber, Sutar, Townsend, Wayerman, Ziller. -16. Absent- Aldermen Anderson, Graham, Jackson, Linn, Schneider, Wingfield. -6. The foregoing Call and reports thereon was read: Mayor's Office, Austin, Texas, November 11, 1891. To the Honorable Board of Aldermen of the City of Austin: Gentlemen I hereby Call a Special meeting of the City Council to assemble in the City Hall at 8 o'clock p.m. this day, November 11, 1891, for the purpose of considering a bond from William Metzger, Richard Snell and D.C. McMurtin agreeing to comply with the terms of an Ordinance, which was passed by the City Council on the 2nd day of November, 1891, leasing to said parties, their representatives, assigns and Successors, the property of the City of Austin, known as the Dam railroad. Austin, Nov. 11, 1891, 6, p.m. I hereby certify that Aldermen Assemann, Carleton, Bless, Graham, Hume, Marris, Newton, N.Tischke, North, Phillips, Platt, Schneider, Schuber, Sutar, Townsend, Wingfield, Ziller, Wayerman and Ketchum, have been personally served with the above Call by reading it to each of them, and that Aldermen Anderson, Jackson and Linn have been served by leaving a true copy at their respective places of business, they being out of the City. H. Montgomery, Police Officer. The following bond was then read. State of Texas, } ss. County of Travis. } Know all men by these presents: That we, William Metzger, Richard Snell and D.C. McMurtin, as principals, and A. P. Wooldridge, S.H. Marley, F.H. Wormoth, as Sureties, are held and firmly bound to John McDonald, as mayor of the City of Austin, and his successors in office, in the Sum of Ten Thousand ($10,000) Dollars, for the payment of which well and truly to be made, we bind ourselves, our heirs and legal representatives firmly by these presents, subject to the foregoing conditions. Whereas, The City Council of the City of Austin, on the 2d day of November, 1891, passed an Ordinance entitled "An Ordinance leasing to William Metzger, Richard Snell, and D.C. McMurtin, their representatives and assigns and Successors, the property of the City of Austin known as the Dam railroad and granting them the right to [illegible] in pursuance the terms and operating them the right to operate and [illegible] [illegible] [illegible] within the City of Austin," the terms of which Ordinance the above named principals have accepted And, the above named William Metzger, Richard Snell

and J. C. Mc Martin shall comply with Each and Every of the provisions of said Ordinance in accordance with the effect of their written acceptance of the terms, Stipulations and Conditions Contained in said Ordinance, then this obligation shall become null and void, otherwise to remain in full force and obligation in law. Acceptance. The following was then read: Austin, Texas, Nov. 4th, 1891. To Hon. Mayor and Board of Aldermen of the City of Austin: Gentlemen - We, William Metzger, Richard Snell and D.C. McMartin, hereby accept the terms of the Ordinance passed by your honorable body on the 2nd day of November, 1891, and approved on the 2nd day of November, 1891, Entitled "An Ordinance leasing to William Metzger, Richard Snell and D.C. McMartin, their representatives, assigns and successors, the property of the City of Austin known as the Dam rail road, and granting them the option to purchase the same, and granting them the right to operate and maintain Street railroads within the City of Austin;" and we hereby agree to all the terms, Conditions and Stipulations therein Contained, and obligate Ourselves to the City of Austin to observe the same; and we herewith tender for approval by your honorable body a bond to secure the performance by us of the terms of said ordinance in accordance with the provisions of said Ordinance requiring such bond. Bond & acceptance. Alderman North presented the following: Resolved, That the bond of W. Metzger, Richard Snell and D.C. McMartin as principals, and A. P. Wooldridge, S.L. Morley and J. H. Warmeth as sureties, presented in accordance with an Ordinance passed November 2nd, 1891, entitled "An Ordinance leasing to W. Metzger, Richard Snell and D.C. McMartin, their representatives, assigns and successors, the property of the City of Austin known as the Dam railroad, and granting them the option to purchase the same, and granting them the right to operate and maintain street railroads within the City of Austin, be and the same is hereby approved. Resolved, That said bond, and the acceptance of the terms

of Said Ordinance by said W. Metzger, Richard Snell and D.C. McMartin, be spread and entered on the minutes. The resolution was adopted. Alderman Morris, at his request, was excused from voting. The Council then adjourned. Milton Morris, City Clerk.
