It was moved that the Council stand adjourned until 8:30 P.M. Tuesday May 17. 1882 and that the City Clerk be instructed to notify all aldermen of the meeting to be then held. Carried.

Motion to suspend reg. order business appropriating 617.45 to purchase Mules
Alderman North moved That the regular order of business be suspended and that an ordinance appropriating the sum of $617.45. for the purpose of paying for. Mules purchased for the use of the City of Austin be considered
Motion prevailed. Mules purchased.
The motion prevailed and Alderman North presented the ordinance named together with a report from the Committee on purchases which states that in accordance with a resolution passed by the Council the Purchasing Committee have purchased five mules at a total cost of $617.45
Motion to suspend rules and passed
A Motion was then made to suspend the rules and place the above named ordinance on its second and third readings and that it do pass all of which were adopted by the following vote Yeas Aldermen. Pet- to remit-fine of Abner Boutwell
A Petition from. A. R. Boutwell asking the Council to remit a fine of $5.00, which was assessed against his son Abner Boutwell in the recorders court. on the recommendation of the Mayor the petition was granted.
Aldermen. Newton and Shelley entered the Council and answered to their names.
Pet- of H. Orsay against Opening E 9th st
By Alderman Assmann. A petition from Henry Orsay protesting against the opening of the Continuation of East Ninth Street through outlot No. 1, in Division B. It was read and referred to the Street Committee to be con-sidered in connection with a petition now in the hands of the Street Committee asking that East-Ninth-Street be opened through the outlot named.

to open the Boulevard along Lake Front
A Communication was received from the Secretary of the Board of Trade Stating that the following resolution was adopted by said Board. Whereas, there exists no suitable roads for the use of Citizens desiring to visit the great lake above the dam. or to enable them by reasonably direct route to drive from the vicinity of the dam towards Mt. Bonnell - the State Encampment-grounds and other points on the western limits of the City. And there is now pending before the City Council a petition for opening up an extension of the boulevard from the dam along the lake front. therefore. Resolved that it is the sense of this Board that the interest and convenience of the public would be greatly promoted by such extension and we respectfully urge favorable action of the City Council in the matter of opening such street."

Alderman Forth moved that the resolution be received and considered in connection with the petition therein named. Carried
Communication from Ladies Cemetery Assn.
By Alderman Ziller, A Communication from the Ladies Cemetery Association To the Honorable City Council. The ladies of the Cemetery association encouraged by the interest the Council has taken in their work -beg to make a few suggestions. 1. The ladies would be glad to have the sextons duties as employe of the Council defined and if the duties do not cover all the Council thinks necessary to be done they would be glad to have his Salary increased for the next three months sufficiently to enable him to do the additional work that is necessary.

316 Trash Boxes for City- Cemetery 2 It- is desired That at-least- two dozen boxes 3 feet-long 1 foot-wide and 1 1/2 feet-deep may be placed at-suitable intervals in the ground to receive all trash and that strict laws be made restraining any one from throwing any thing in paths streets or on lots and that these boxes shall be emptied once a week
Avenue to be graded 3 They would call attention to the fact That the avenue leading to the south iron gate needs work, leveling, terracing and guttering and think it-would add much to the appearance of the Cemetery to have it- put- in order Also That the south iron gate which opens on no street should be moved to the place now occupied by the while-wooden gate or thereabouts
Trees trimmed to uniform height 4 We desire That all trees should be trimmed to a uniform height-
Sexton required to have asst. 5 The Sexton should be required to leave some one on the premises when he is absent- during the day in order to prevent-trespassing and thieving
Drives and paths to be curbed 6 As money can be furnished or as it-accumulates for Cemetery funds it-could be used to great-advantage in curbing the drives laying pipes and sodding where necessary And we petition the Council that it-shall be done,
Com. Laid over Alderman Ziller moved That the communication be laid over to come up with an ordinance to be introduced covering the matters named in the communication, Adopted

Pet- of R. J. Hill to open Boulevard By Alderman Blume, from the Street Committee to whom was referred the petition of R. J. Hill for the opening of a Street- from the Terminus of the Boulevard now opened for travel to the dam submitted a report-thereon which recommends that the petition be granted and that in view of the needs of the public and the probability of the extension of the Austin dam railroad along such street-that such extension be in width 80 or 100 feet-wide and that proceedings for the condemnation for the extension of said street be taken by the City,
Alderman Morris was excused from voting he being Attorney for the Dam Railroad Company The report was adopted
City atty to take proceedings Alderman Kreth then moved that the City Attorney be instructed to institute on behalf of the City of Austin for the opening of the extension of the dam boulevard northwesterly in accordance with the report- of the street Committee and in accordance with the field notes of the City Engineer

317 extension to be opened 80 feet wide, said proceedings to be instituted so soon as Mr. D. C. Myrick shall have paid to J. S. Myrick the sum of $250 to be held and disbursed by said Myrick for the payment of any costs which may be adjudged against the city of Austin; provided That the city shall not be put to any expense in addition to the cost.
Motions to suspend rules and place same on 2nd & 3rd reading. Motions were made to suspend the rules and place the resolution on its second and third readings both of which were adopted by the following vote Yeas Aldermen Anderson, Glass, Graham, Hume, Jackson, Ketchum, Miller, Newton, Nitschtke, North, Platt, Schneider, Schutze, Scutur, Townsend, Wroe, and Ziller,— 18 Nay Alderman Shelly.
Alderman Morris was excused from voting for the reason above named. The resolution was then passed.
Com Rept - Majority- Removing Shouses By Alderman Scutur for a majority of the committee on Sanitation and sewerage to whom was referred a resolution granting the butchers of the city of Austin an extension of time to January 1st-1893 to remove their slaughter houses outside of the limits of the City of Austin presented a report therein which states: After a thorough investigation and examination of two petitions for and against such grant and a report of the health officer we recommend that the resolution do pass [signed] Wm J. Minority Rept of Com on S & S. By Alderman Meyermann of the Committee on Sanitation and sewerage.. A minority report on the above named resolution which recommends the passage of the resolution with the following amendment Provided the owner or person in charge of any such slaughter house or slaughter pen. shall first procure the names of at least ten Citizens living in the immediate vicinity of such pen or house to a petition requesting the City Council to permit such pen or house to remain where it may now be located until January 1st 1893
Motion to adopt Minority Rept Alderman Ketchum moved that the minority report be adopted Motion to Lay on table Alderman Ziller moved as a substitute that both reports be laid over to be taken up with the resolution Carried. St Comer to dispose of Mules Alderman North moved that the superintendent of Streets be instructed to dispose of the three worn out mules belonging to the City to the best interest of the city Alderman Ziller moved to lay the motion on the table Adopted

Res extending time for A resolution extending the time for removal of slaughter removal of S. house houses out side of the limits of the City of Austin until January 1st 1893 was read and laid on the table by the following vote Yeas. Aldermen. Graham, Hume, Jackson, Ketchum, Miller, Morris, Newton, Nitschke, North, Schuber, Townsend, Warmoth Weyermann, Ziller, — 14 Nays. Aldermen. Anderson, Glass, Platt, Schneider, Shelley, Sutor, - 6 New Business Appropriating $150 for By Alderman Ziller: An Ordinance Appropriating City Cemetery the Sum of $150 for the purpose of making trash boxes and for other necessary work at the City Cemetery It was read the first time after which motions were made to suspend the rules and place the same on its second and third readings both of which were adopted by a vote of two thirds of the whole Council. The ordinance was accordingly read and on motion passed.

Prescribing duties of By Alderman Shelley: an ordinance amending Health Officer Ord. 296. of the Revised Ordinances of the City of Austin prescribing the duties of the City Health Inspector. It was read the first time after which a motion was made to refer it to the ordinance Committee, which was lost by a raising vote of 6 to 9

Seyer Haulenbeck, his associates and assigns for a street rail road to be built from Brazos and Third Streets as herein after described, It was read and referred to the Ordinance Committee

Present - Aldermen Nune, Jackson, Lewis, Morris Platt, Schuber, Shelley. — 7. Absent- Aldermen Anderson, Assmann, Glass, Graham Ketchum, Miller, Newton, Nitschke, North, Schneider, Sutton, Townsend, Warmoth, Weyerman, Gillen - 15. ball of Council Alderman Morris moved a call of the Council which was duly seconded and adopted. The Marshal sent after absentees. Recess. Alderman Morris moved that the Council take a recess of ten minutes. Carried. 2nd Roll Call Present Absent After the expiration of recess the roll was again called and resulted as follows: Present - Aldermen Anderson, Assmann, Glass, Nune, Jackson, Lewis, Morris, Nitschke, North, Platt, Schneider, Schuber, Shelley, Townsend, Warmoth, -15. Absent - Aldermen, Graham, Ketchum, Miller, Newton Sutton, Weyerman, Gillen - 7. On motion the call of the Council was suspended. Petitions &c. Petitions, Memorials, etc. The following Petitions, Memorials, etc, were presented. Protection H. Co no. 3 invitation of An invitation from Protection Hose Company No. 3 to the Mayor and Board of Aldermen, to attend a banquet to be given May 25, in honor of the fourteenth anni-versary of the Company. Acceptance of Alderman Anderson moved that it be accepted with thanks. Carried. G. H. Coagine Petition of as to San Antonio & Dist. streets By Alderman Townsend: A petition from G. M. Coagine asking that San Antonio and District streets be so worked as not to injure his property. It was referred to the Street Committee and City Engin-eer. Ald. Weyerman present: Alderman Weyerman entered the Council and answered to his name. August Frick pet. complaining of Slaughter House By Alderman Nune: A petition from citizens, complaining of the slaughter house owned by August Frick, and situated near the Lunatic Asylum as being a nuisance, and requesting that the same be removed. Resolution to remove Slaughter Houses &c Alderman Nune introduced a resolution directing the City Marshal to immediately remove all slaughter houses that are complained of as nuisances, beyond the limits of the City. Resolution amended Alderman Nune moved to amend the resolution so

321 as to give ten days in which to remove such houses. My Ammendment prevailed by a rising vote of eleven to three. Substitute by Alderman North moved, as a substitute for the resolution, Ald. North. That the Health Officer be instructed to enforce Article 175 of the Revised Penal Ordinances of the city, but more especially with reference to the slaughter house of Mr. August Frick. August Frick. The substitute was adopted, and on motion passed.
Committee Reports. Committee Reports. Alderman North, from the Committee on Ordinances, to Ordinance Committee whom was referred an ordinance granting a street railway franchising to J. Deyes Newlenbeck and associates, J Deyes Newlenbeck submitted a report thereon which states: railway franchise That they have considered the same, and recommend that it be amended by adding thereto sections 6 to 17, both inclusive, and your committee recommend that said Amended and ordinance do pass when so amended. Sec. 6 to 17 added. Alderman North moved that the report be laid over, to be taken up with the ordinance named therein. Adopted. Unfinished Business. Unfinished Business. Right of way An ordinance entitled, "An Ordinance granting the right granted of way over certain streets and the right to cross certain to J. Deyes Newlenbeck highways in the city of Austin to J. Deyes Newlenbeck, from his associates and assigns, for a street railroad to be built Brazos to 3rd Street. from Brazos and Third Streets, as hereinafter described," was taken up on its second reading and read, after which sections 6 to 17, both inclusive, offered by the Ordinance Committee, as above mentioned, were read and adopted. Amendment to sec. 16½. Alderman Assmann offered the following amendment: to protect against To Section 16 ½. any rise in river. That the channel of the Colorado river shall be spanned by such a structure as will give perfect safety by reason of any rises liable to occur in this river. Adopted. Amendment to sec. 14. Alderman Schneider moved to amend section 14. after the word "badges", by inserting the words, "and all active firemen going to a fire". The amendment was adopted. Final passage of A motion was then made to suspend the rules, and place ordinance. the ordinance on its third reading, which was adopted by a vote of two-thirds of the whole Council. The ordinance was accordingly read, and on motion passed.

By Alderman Morris: Authority to the Mayor Resolved, That the Mayor be authorized to purchase a set of weights and measures. and have established a Standard of weights and meas-ures in accordance with Article 28th of the Penal Ordi- -nances of the City.
