Archer atty for G. W. Patterson A Communication was received from Osceola Archer attorney for G. W. Patterson which states that on the 13th day of June Mr Patterson was severely injured by being thrown over the bridge on West Sixth Street where it crosses Little Shoal creek. That said accident was caused by the bridge being defectively constructed and by its being out-of-repair. That Mr Patterson claims that the City of Austin is liable to him in damages for injuries received and he would much prefer settling with the city without bringing suit if it can be done Referred to street Com & City atty Referred to the Committee on Claims and Accounts and the City Attorney Aldermen Graham excused Alderman Graham entered the Council and answered to his name Alderman Ketchum excused Alderman Ketchum was excused from attending the sessions of the City Council until the first meeting in August on account of the sickness of his Son in Galveston. Pet of Taxpayers of Clarksville to grade streets and define lines of same A petition was received from Citizens and Taxpayers of the Second Ward who reside in Clarksville requesting that the streets and alleys in that portion of the City be properly defined and worked It was referred to the aldermen of the Second and Third wards --- Page break --- 356 J N Phillipson fine remitted On the recommendation of the Mayor a fine which was assessed in the Recorders Court against J. H. Phillipson was remitted. Pet of Citizens to construct bridge across gutter on E 8th & Cong ave By Alderman Marmoth. A Petition from Citizens Requesting; First, that a bridge be constructed across the gutter at the intersection of East Eighth street with Congress Avenue To grade hill on 8th street 2. That the hill on East Eighth street between Congress Avenue and Brazos street be cut down to a proper grade. It was referred to the Street Committee. Referred Officers Reports Rept on cost of bridge on Waller creek Reports of City Officers By the City Engineer. A report showing that the construction of a foot bridge over Waller creek on East seventh street will cost $72 Rept recd Carried Alderman North moved that the report be received. Carried. Chief Fire Dept- Calling attention of Council By the Chief of the Austin fire department. A report calling attention of the City Council to the necessity of supplying the fire department with about 2000 feet of new fire hose. It was referred to the Fire Committee. Alderman Sneider entered the Council and answered to his name. St-Com Rept- Sale of old harness By the Superintendent of Streets; A report which stated that he sold to Ad Smith a few old pieces of harness which were not usefull to the City receiving therefor the sum of $2.50 which he deposited with the City Assessor and Collector. Rept-recd The report was received. Officers Repts for June referred Reports of City officers for the month of June 1892 were referred to their respective Committees without being read. Com Repts Reports of Committees Pet of L K Barker etc to open Willow st By Alderman Nitschke for the Street Committee to whom was referred the petition of L. K. Barker, Thomas O. Brien, W. F. Wright and others requesting the removal of obstructions on Willow Street, submitted a report thereon on which states that "We find the Street encroached upon by a fence and would recommend that the City Engineer be instructed to notify the parties to remove the fence to proper line at once". Rept adopted The report was adopted. --- Page break --- 357 New Business The Mayor presented the following Mayor Office Austin Texas July 5th 1892 Mayor recommend board of A & E for confirmation Gentlemen of the City Council. I have the honor to recommend for the Board of Equalization of Taxes for the year 1892 the following gentlemen. A.M. Milby, M.H. Tobin, E.M. Bacon, John Murrah. And C.M. Calloway and respectfully their confirmation by your honorable body. Respectfully John McDonald Mayor referred to ord com It was referred to the Ordinance Committee. The following message was read Austin Texas July 5-1892 J. J. Fanning recommends change in top of Dam Gentlemen of the City Council In accordance with the recommendation of Mr J. J. Fanning Consulting Engineer the Board of Public Works has made arrangements with the Contractor Mr Bernard Corrigan to make the change in the shape of the top of the down stream face of the dam so as to conform with Mr Fannings plan. This change while it increases the price per Cubic yard of Masonry to be laid at said place will decrease the quantity and the actual cost will not be increased. I ask that the action of the Board in this matter be ratified. I would respectfully state that the Board of Public Works received the resignation of Mr Jos P. Frizell as Chief Engineer and accepted said resignation on June 30 1892 and on July 1st 1892 the Board placed Mr E.W. Groves in charge as Chief Engineer of Construction and I ask that the action of the Board in these matters be approved Respectfully John McDonald Mayor and President of the Board of Public Works adopted It was moved that the recommendations be adopted and the motion prevailed The Mayor presented the following Austin Texas July 5 1892 To the Members of the Board of Aldermen Board of Pub Wks accept bid of M. Carried To furnish rooms at C&C hospital for pay patients adopted appropriation to pay approved accts motion to suspend rules Carried Motion to amend Carried Motion to amend sec 1 It was moved that the City Council confirm the action of the Board Adopted By Alderman Miller: An Ordinance making an appropriation to build a foot bridge over Miller Creek on East Seventh Street It was read the first time after which a motion was made to suspend the rules and place the same on its second reading which was adopted by a vote of two thirds of the whole Council The ordinance was accordingly read after which Alderman Jackson moved to amend Section 1 of the ordinance by striking out "$87.00" and inserting in lieu thereof the Sum of "$72.00" Carried Motions were then made to suspend the rules and place the ordinance on its third reading. An Ordinance Appropriating $8577.40 for the purpose of paying approved accounts, It was read the first time After which a motion was made to suspend the rules and place the ordinance on its second reading which prevailed by a vote of two thirds of the Whole Council Alderman Anderson moved to amend Section 1 of the ordinance by inserting the sum of ten dollars to reimburse J H Philipson for fine remitted Carried Alderman North also moved to amend Section 1 by inserting therein the sum of $224.13 for the purpose of reimbursing Fred Sterzing City Assessor and Collector for tax receipts delivered in settlement of Judgement of R. A. Hume against the City.
