Minutes of a regular meeting of the City Council of the City of Austin. Austin, Texas, Sept. 19, 1892.
Hon. Henry H. Linn, President of the Board of Aldermen, presiding. Roll Call. Present. Aldermen Anderson, Glass, Jackson, Linn, Miller, Newton, Nitschke, North, Platt, Schuber, Townsend, Warmoth, Weyerman.-13. Absent- Aldermen Assmann, Graham, Hume, Ketchum, Morris, Schneider, Shelley, Sutton, and Ziller.-9. The minutes of the meeting of the City Council which was held on the 5th day of September, 1892, were adopted as printed. Alderman Morris entered the Council and answered to his name.
Petitions, memorials, Etc. City Cemetery. The following named memorial and petition were introduced: By Alderman North: A memorial from Drs. Morris, Bennett, Daniel, Gasser, Edmondson, Berenger, Shelton, Matthews and Bragg, stating that in their judgment the proposed Extension of the City Cemetery in accordance with a petition now before the City Council would be a most injudicious step. In the first plea, it is the opinion of the best Sanitarians that Cemeteries are unhygienic in their influence upon those living near them, and for that reason and many others, they should never be established within city limits, but as far from centers of human habitation as consistent with reasonable convenience. The memorial further states that there is no doubt that noxious Vapors and gases, very detrimental to health, are constantly Exhaled, and closes by asking the Council to not grant the petition for permission to Extend the present City Cemetery. Alderman Weyerman moved that the memorial be received and filed. Alderman North moved to amend the motion by adding thereto: "And considered in connection with the report of the Cemetery Committee on the Same Subject." The amendment was accepted and the motion as amended was adopted. By Alderman North: A numerously signed petition asking the Council to prevent the Extension of the present City Cemetery, it was ordered to be received and filed and considered with the report of the Cemetery Committee on the same subject. Aldermen Graham and Shelley entered the Council and answered to their names.

for permission to place a Canvas sign from the top of building No. 515 East Sixth Street to top of building opposite, Submitted a report thereon which recommends that the petition be granted provided the sign Shall be removed within Sixty days after the Same Shall have been placed in position. The report was adopted. Alderman Schneider Entered the Council and answered to his name. Cleaning Streets. Alderman North, for the Committee on Ordinances, to whom was referred a message from the Mayor recommending that the Streets and Sidewalks be placed in a better Sanitary Condition, and to that end that the Committee on Ordinances be requested to report an Ordinance requiring all property owners in the City to clear all weeds and rubbish from the Sidewalks and one-half the alleys in front, and in the Event of the owners failing or refusing to do so to authorize the Street Commissioner to have such Cleaning done at the Expense of the owners of the property, presented a report thereon as follows: "Your Committee do not believe that the City has the power herein desired to be enforced, hence we have not prepared an Ordinance on this Subject." The report was adopted. Alderman Suter entered the Council and answered to his name. " " Alderman North, for the Ordinance Committee, to whom was referred the following resolution: "Resolved by the City Council of the City of Austin, that all the Street work but what is actually necessary to prevent accidents and keep Streets in a passable Condition be and the Same is hereby discontinued for the present. "Second. That the Street Commissioner be and is hereby instructed to use all street force, Except such part as are needed for work above Excepted, in Cleaning up the Streets and alleys for the City", Submitted a report thereon as follows: "Your Committee recommend the adoption of the within resolution and recommend that the work be done under the direction of the City Physician, with the assistance of the Sanitary Inspector, Commencing in the First and Fourth wards, Robertson Hill and other portions of the City mostly needing Cleaning" The report was adopted. City Cemetery Alderman Weyerman, acting Chairman of the Cemetery Committee, to whom was referred this proposition looking to the Extension of the Brazil City Cemetery, asked that further time be granted the Committee in order to prepare a report on the Subject. Alderman North moved as a substitute that the

Proposition be recalled from the Cemetery Committee The Substitute was lost by the following vote: Yeas - Aldermen Graham, Jackson, Miller, Morris, Newton, Nitschke, North, Platt, Warmoth.- 9. Nays- Aldermen Anderson, Glass, Linn, Schneider, Schuber, Shelley, Suter, Townsend, Weyerman.- 9. The question having recurred upon the motion to grant further time, it was carried.
Light. Alderman Morris, for the Water and Light Committee, to whom was referred a petition of citizens asking that an arc light be placed at the intersection of Congress Avenue and First Street, submitted a report thereon recommending that the petition be granted and that the Aldermen of the Tenth Ward be authorized to have a light placed at the point named, the price to be paid for said light to be the same as that paid for additional arc lights heretofore. The report was adopted. New Business. Bouldin Bridge. By Alderman Schuber: A resolution providing for the const ruction of a bridge and approaches over Bouldin Branch on the San Christamo road. It was adopted. Rapid Transit plank By Alderman Shelley: A resolution requiring the Austin Rapid Track. Transit Company to place timbers of suitable thickness on either side of the rails, to be on a level with the top thereof, at the intersection of Fifth, Seventh, Eighth, North and Tenth Streets and at the curve on Eleventh Street on Congress Avenue, and at the crossing of Sixth Street between Congress Avenue and Red River Street on the East and on the West, including Rio Grande Street. Said timbers shall be securely fastened to the cross ties and beveled on the outer edges, for the convenient crossing of vehicles of all kinds. It was referred to the Street Committee. To pay Bd. of E. By Alderman Morris: An ordinance appropriating the sum of $870 for the purpose of paying the Board of appraisers of the City of Austin for the year 1892. It was read the first time after which motions were made to suspend the rules and place the ordinance on its second and third readings, and that it do now pass, all of which were adopted by the following vote: Yeas - Aldermen Anderson, Glass, Graham, Jackson, Linn, Miller, Morris, Newton, Nitschke, North, Platt, Schneider, Schuber, Shelley, Suter, Townsend, Warmoth, Weyerman.- 18. To pay cost ... By Alderman Morris: An Ordinance appropriating the sum of $[illegible] for the purpose of paying costs in the district court in cases where property was sold for taxes and bid in by the city. It was read the first time after which motions were made to suspend the rules and place the same on its second and third readings and that it do now pass, all of which were adopted by the following vote: Yeas - Aldermen Anderson, Glass, Graham, Jackson,

"Resolved, That the City Attorney be requested 1. prepare a deed to be executed by Mrs. L.L. Robertson, conveying to the city certain land offered by her for Street purposes for an Extension of East Ninth Street in payment of certain taxes owing by her to the city, in accordance with her proposition reported on by the Finance and Street Committees, whose report was adopted August 15, 1892; and that upon the Execution of said deed, giving field notes as made by the City Engineer, that the Assessor and Collector be and he is hereby authorized to Execute in the name of the City a deed of release to L. L. Robertson of the lots sold to the City in payment of said taxes, Except the part thereof to be deeded to the city for Street purposes as aforesaid, and that tax receipts be issued to said L. L. Robertson for the taxes mentioned in her said proposition, specifying on their face, that the same Were paid in land, and that the Assessor and Collector be credited accordingly in his accounts". Adopted. Employ St. laborers Alderman Nitschke moved that the Street Commissioner 30 days. be authorized to Employ Extra Street laborers to the amount of $250, within the next thirty days. " Alderman Schuber moved to amend by authorizing the Street Commissioner to Employ five Extra Street laborers for thirty days. The amendment was accepted and the motion as amended was adopted. Work St. laborers By Alderman Nitschke: 9 hours per day. "Resolved, by the City Council of the City of Austin, that on and after 1st. of October, the Street Commissioner be requested to work all men Employed by the City to do Street work, Only nine hours for a days work."
