Absent
Absent- Aldermen Assmann, Warmoth, Ziller- 3. The minutes of the meetings of the City Council which were held on the 7th. and 14th. days of November, 1892, were adopted as printed.
Petitions &c.
Petitions, Memorials, Etc. The following petitions were introduced:
Nora Givens to refund pound fees.
By Alderman Nitschke: A petition from Flora Givens requesting the Council to refund certain pound fees which were paid to the city by her. Granted.
Burt McDonald for Miss M.E. Brackenridge Erect stairways for 1st Nat'l Bank
By Alderman Jackson: A petition from Burt McDonald, for Miss M.E. Brackenridge, owner of building, requesting permission to erect two iron Stairways for gaining access to the First National Bank building. Alderman Jackson moved to grant the petition and Alderman Schneider moved as a Substitute that

the petition be referred to the Street Committee, which was agreed to by a rising vote of ten to four. Reports of Committees. The following report was offered by Alderman Shelley:

Rept of Com. Claims & Accounts on.
Gentlemen- Your Committee on Claims and Accounts to whom was referred the petition of A. Wilkie, tillerman of Hook and Ladder Company No. 1, "with instructions to report an Ordinance covering his Salary," beg leave to submit herewith such an Ordinance as is contemplated by your instructions. While such instructions obviate the necessity of an investigation into and report upon the facts upon which the Ordinance is based, your Committee deem it not improper to say, that on the 5th day of September last, while en route to a fire, the truck upon which Mr Wilkie occupies the position of tillerman, in making a turn at the corner of Eighth Street and Congress Avenue, was upset, throwing Mr Wilkie to the ground and falling upon him, causing injuries which totally disabled him and from which he has not yet recovered and probably will not recover sufficiently to resume the discharge

404 of his duties for the next two months your Committee is advised by those who witnessed the accident that in order to avoid a collision with and the probable killing of an old gentleman, Mr Wilkie was forced to attempt the crossing of the track of the rapid transit railroad, the rails of which being so much elevated above the level of the Street, caused the truck, in striking it at an angle, to overturn. Aldermen Warmoth & Assmann, present Aldermen Warmoth and Assmann entered the Council and answered to their names. New Business. New Business H. S. Wright confirming sale of 80 acres school land in Kaufman Co. By Alderman Graham: An Ordinance authorizing and confirming the sale by the city of Austin and its Board of School Trustees of the undivided one-half interest in Eighty acres, being block No. 1 of a Sub-division of the Antonio de las Ruyle Survey in Kaufman County, Texas, to W. S. Wright. It was read the first time, after which motions were made to suspend the rules and place the ordinance on its second and third readings, each of which were adopted by a two-thirds vote of the whole Board of Aldermen. The Ordinance was accordingly read and, on motion passed. E. F. Numbers Judge of Election 1st ward Alderman Sutor moved that the name of E. F. Numbers be substituted for that of H. H. Graham as Judge of the Election in the First Ward, Mr Graham having declined to serve. The motion was adopted. The following was read: Austin, Texas, Nov. 21, 1892. Council invited to ball given by Fire Co. The Honorable mayor and City Council of the City of Austin: Gentlemen- you are cordially invited to attend a ball to be given by Austin Hook and Ladder Company No. 1, and Colorado Steam Fire Engine Company No. 2, Friday evening, Nov. 25, 1892, in honor of the Completion of our hall. Respectfully, Firemen's Joint Committee of Arrangements Alderman Graham moved that the invitation be accepted with thanks, and the motion was unanimously adopted. A. Wilkie $100. appropriated to re- imburse him. By Alderman Shelley: An Ordinance appropriating the sum of One hundred ($100) dollars to reimburse A. Wilkie, Kileeman of Hook and Ladder Company No. 1, for pay of Substitute for the months of September and October, 1892, and providing for his employment by the city for the months of November and December. It was read the first time, after which motions were made to suspend the rules and place the Ordinance on its second and third readings and that it do now pass, each of which were adopted by the following vote: Yeas- Aldermen Anderson, Assmann, Glass, Graham, Helme, Jackson, Ketchum, Linn, Miller, Morris, Newton, Nitschke, North, Platt, Schneider, Schuber, Shelley, Sutor, Townsend, Warmoth, Weyerman- 21.

By Alderman Linn: An Ordinance appropriating the sum of $11,250 for the purpose of paying interest on the Water works and Electric light bonds of the City of Austin. It was read the first time, after which Motions were made to Suspend the rules and place the Ordinance on its second and third readings and that it do now pass, Each of which were adopted by the following Vote: Yeas- Aldermen Anderson, Assmann, Glass, Graham, Hume, Jackson, Ketchum, Linn, Miller, Morris, Newton, Nitschke, North, Platt, Schneider, Schuber, Shelley, Suter, Townsend, Warmoth, Weyerman.- 21. By Alderman Nitschke: Whereas, By the Extension of the city limits of the city many tax payers who were, on the first day of January, 1891, non-residents of the city, and therefore subject to the tax imposed by law for the improvement of County roads, which tax they paid; and Whereas, Their property was assessed by the city for said year, and the taxes upon same were paid, therefore be it Resolved, By the City Council of the city of Austin, that the City Tax Collector be and he is hereby authorized, to issue tax receipts for the year 1892 to such persons as surrender to him the road overseer's receipt for the year 1891, and pay the difference between the amount of such receipt and the amount of taxes due for the year 1892, provided the person so surrendering said receipt is a resident of the city of Austin. This resolution shall apply to the persons who petitioned the City Council during the present year Concerning this matter. Adopted By Alderman North: Resolved, That the balance in the city treasury to the credit of the Cemetery fund be and the same is hereby transferred to the credit of the general fund. Carried Report of Committees By Alderman Weyerman: Austin, Texas, Nov. 21, 1892 To the Hon. John McDonald, Mayor and Board of Aldermen of the city of Austin: Gentlemen- your Special Committee appointed to investigate property leased to a Company, then known as the Capitol Ice Factory, for the purpose of manufacturing ice, by the city of Austin, beg leave to report, after careful investigation, find that there is no such Company existing at this time, nor has there been for several years; Said Company having ceased operations as such for a period of five years or more, and not likely to resume

as such in the future Said Company having Sold all the machinery from the premises, and Geo. B. Gimpelman is now Sub letting Said property for other purposes Contrary to Said lease. Your Committee would therefore recommend that Said lease, according to the reading thereof, be declared null and Void. (Signed) A. Weyerman, Wm J. Sutor. The report was adopted. Recorder Carleton Alderman Linn moved that Recorder Carleton be granted granted leave of absence leave of absence on Wednesday and Thursday of this week. Carried. Alderman North moved that the Council Stand adjourned Last. Yeas, 10; Nays, 11. Alderman Assmann Alderman Assmann was Excused. excused Alderman Linn offered the following: Resolved, That the C.B. Close Mayor of the city of Austin be and he is hereby authorized to Execute a lease to C.B. Close of the property and improvements Mayor authorized heretofore leased to the Capitol Ice Company upon the terms to lease Capitol Ice and Conditions as described in the petition of C.B. Close now Co's premises to him. on file; provided, however, that Said lease be not Executed until the city obtains possession of Said property, and provided that the rent of Said property be paid Semi-annually in advance. Alderman Anderson moved to Strike out "C.B. Close", and insert in lieu thereof "to the highest bidder". Alderman Schuster moved to lay the resolution on the table, which was adopted by the following Vote: Yeas- Aldermen Anderson, Graham, Sturme, Miller, Morris, Nitschke, North, Platt, Schneider, Schuler, Shelley, Warmoth-12. Nays- Aldermen Glass, Jackson, Ketchum, Linn, Newton, Sutor, Townsend, Weyerman.-8. Alderman Anderson moved that the city Attorney be instructed to take the proper legal Steps to place the city in possession of the property named in the above resolution. Carried.
