472 Minutes of a Regular Meeting of the City Council. Austin, March 20. 1893. Hon. Henry. A. Linn, President of the board of alden-men, presiding. Roll call Present - Aldermen Glass, Hawacek, Jackson, Linn North, Platt, Powell, Raymond - 9. Absent - Aldermen Anderson, Asmann, Dawson Fischer, Hinue, Ketchum, Miller, Schneider, Schuber Shelley, Taylor, Townsend and Warmouth - 13. Roll call of Council Aldermen was duly called and adopted. At 8:04 p.m. Aldermen Nitschke moved that the Council take a recess of ten minutes. Carried. At 8:14 p.m. the Council was again called to order and 2nd Roll call the roll called which resulted as follows: Present - Aldermen Glass, Hawacek, Jackson, Ketchum, Linn, Nitschke, North, Platt, Powell, Raymond, Schneider Taylor, Townsend, Warmouth - 14. Absent - Aldermen Anderson, Asmann, Dawson, Fischer, Hinue, Miller, Schuber, Shelley - 8. At 8:16 p.m. Alderman Platt moved that the council take a further recess of ten minutes, and it was agreed to. 3rd Roll call At 8:26 p.m. the council was a 3rd time called to order and the roll again called which showed the following: Present - Aldermen Asmann, Fischer, Glass, Hawacek, Jackson, Ketchum, Linn, Nitschke, North, Platt, Powell, Raymond, Schneider, Schuber, Shelley, Taylor, Townsend Warmouth - 18. Absent - Aldermen Anderson, Dawson, Hinue, Miller - 4. Roll suspended The call of the council was suspended. Alderman Hinue entered the council and answered to his name. Minutes adopted The minutes of the meeting of the city council which was held on the 6th day of March, 1893, were adop-ted as printed.
Petitions Petitions 8th Ave. X 8th St. The following Petitions were introduced: for electric light. Petition of residents residing near Eighth avenue and Eighth Street, requesting the City Council to erect an electric light at the corner of said streets. It was referred to the committee on Gas and Light. G. B. Bacon Petition of G. B. Bacon, asking the City Council to remit a fine of $10.00, which was assessed against him in the Recorders Court on May 1st. On the recommendation of the Mayor the council remitted the fine. 473 small amount of money available - meets for the balance of the fiscal year, they modify their demand made in a former petition to the council to have Each avenue between Seventh and Sixth, Sixth East Avenue bel 30x70x63, 65.5x55x54 and Fifth and Fourth graded and macadamized streets, for roadway. and known for the construction of a fifty feet roadway in the gates of said East Avenue, between Seventh and Fourth streets, which will fully respond to all the requirements and accomodate the travel of that portion of the city. E. 6th 5m long and this also requested that Each Sixth Street, from Congress E. W. 5t to be repaired Avenue to the intersection of the Houston and Texas railroad track, be repaired and a graveled or macadamized from Each avenue to the Houston and Texas railroad track. The petition was referred to the committee on streets and alleys. By Alderman Glass: A petition from the citizens of 10th ward to open the second taxpayers of the Fourth ward, asking the 4th st. etc. Council to open Fourth street, from Comal, its railroad terminus, to —- street, which runs in a Northerly direction into Fifth street. By motion, and referred to the committee on streets and alleys. J.M. Burgaz an By Alderman Ketchum: A petition from J.M. Burgaz an as to improvements. asking the Council to allow him to complete an addition to his building immediately back of the building on the North East corner of Congress avenue and Sixth street, the character of the material used being contrary to the fire regulations. After a communication from Geo. B. Brush, asking the Council to decide the matter at once. Alderman Schuber moved that the Petition be not granted. Alderman North moved to amend the motion by adding thereto, and that the City Marshall be instructed to see that the improvements be taken away. The amendment was accepted and the motion as amended prevailed. A. Lotties to By Alderman Porrce: A petition from A. Lotties, erect platform Con 4th. asking permission to erect a platform on the x Colorado sts. south side of his building on the corner of Colorado and Fourth streets. Alderman Porrce moved to grant the petition. Alderman Shelley moved to refer it to the committee on streets and alleys. Alderman North moved to amend the motion made by Alderman Porrce by adding thereto, "provided that the platform may be moved at any time by order of the City Council." Adopted. The motion made by Alderman Shelley was then rejected and, the original motion as amended, was adopted,

474 Young Mens Recreation By Alderman North: A petition Ass'n vs Court House Association for permission to use what Square. is Known as the old court house square as a recreation ground; pledging to repair and put in first class condition, the fence around said square, to maintain said fence in first class condition and to prevent the use of profane or vulgar language on said grounds and the playing of ball on Sunday as from Granted. to keep the weeds down and grass cut so that the place will be attractive and can be used by ladies or children without danger of being hurt or molested by the rough crowd that now use it. Granted. Alderman Miller entered the Council and answ-ered to his name.
Reports of Committees. #1745. Alderman Nitschke, for the committee, to 5th & 1st Street whom was referred an ordinace appropriating bridges on Waller br the sum of $1745. for fixing the fifth and first Street bridges on Waller creek, submitted a report thereon which states: "We have examined said bridges and find that the Fifth Street bridge over Waller is a very light structure and used by the heavy traffick for which it is now used and is continually out of order and liable to give way. And that the First Street bridge over Waller is un-safe and liable to cause the city a heavy suit for damages at any time and should be replaced by a structure as above ordained. We recommend that the above ordinace do pass, believing the same to be of vital importance." The report was adopted by the following vote: Yeas – Aldermen Hassman, Bracher, Glass, Jackson, Jackson, Ketchum, Miller, Nitschke Platt, Prell, Warmoth. – 11. Nays – Aldermen Nune, North, Raymond Schneider, Schuler, Shelley, Taylor, Townsend – 9.
N. 12th St. ash Alderman Nitschke, for the committee on streets and grade &c. alleys, to whom was referred a resolution directing the city engineer to Each Twelfth Street to its established grade, etc. presented a report thereon which states: "We each saw our properly paved and smooth and interesting streets would have, the entire city paved at least three months, and as the street is at present in a reasonably good condition we do not think it advisable, that the resolution be complied with at present, but would recommend that the city engineer be instructed to repair Twelfth St from Elmwood to Larosa Street, and from Culwarth Street to Wash.

Alderman North, for the committee on finance, to whom was referred an ordinance appropriating the sum of $2000. to purchase 2000 feet of hose for the fire department, offered a report thereon recommending the passage of the ordinance, Report adopted. Alderman Shelley, for the committee on claims and accounts, and the City attorney, to whom was recommitted Mrs Brueggemannhoff - the petition of Mrs. Brueggemannhoff, agent of the Krohn agent Krohn Esto estate, concerning increase in assessment for the year 1897, made a report thereon calling attention to the City submitted by the board of appraisers from the City Council to section 41, page 10, of the City Charter which prescribes the manner of appeal from the action of the board of equalization, and which, in the opinion of the committed, precludes any action by the City Council. The report was adopted.

$2500. for bridge An ordinance appropriating $2500 to build a on 8th St. bridge over Waller creek on East Seventh Street, was taken up on its final passage and on motion passed by the following vote; Yeas – Alderman Hassmann, Discher, Glass, Hancock, Jackson, Ketchum, Miller, Nietschke, Platt, Powell, Schneider, Schuber, Shelley, Warmoth – 14. Nays – Aldermen Neune, Linn, North, Raymond Taylor and Townsend – 6. $2000 for Ward An ordinance appropriating $2000 for the purchase House passage of hose for the fire department was taken up on its second reading and read, after which motions were made to suspend the rules and place the ordinance on its third reading and that it do pass, each of which were adopted by the following vote: Yeas – Aldermen Hassmann, Discher, Glass, Hancock, Jackson, Ketchum, Linn, Miller, Nietschke, North, Platt, Powell, Raymond, Schneider, Schuber, Shelley, Taylor, Townsend, Warmoth – 20.
New Business
$5000. to pay freight By Alderman Discher; An ordinance appropriating the sum of $5000 for the purpose of paying freight Shipped by and other charges on pumps, wheels and other Bitewell-Bierso & machinery shipped, by the Bitewell-Bierso and Smith-Vaile Co's Smith-Vaile Company, contractors. It was read the first time, after which motions were made to suspend the rules and place the ordinance on its second and third reading, each of which were Yeas – each of which were adopted by the following vote;

Eugene Dibbley By Alderman North, an ordinance authorizing Sale of McKay Sur. the Board of School Trustees of the city of Austin, Texas, Confirmed confirming the sale by the Board of School Trustees of its undivided one-half interest in the Thos. McKay survey of land in Victoria and Jackson Counties, Texas, to Eugene Dibbley. It was read the first time, after which motions were made to suspend the rules and place the ordinance on its second and third readings, each of which was adopted by a two-third vote of the whole board of aldermen.
