Austin's 1893 Water Works Bonds and Fish Protection

Minutes adopted The minutes of the meeting of the City Council which was held on the 7th day of August- 1893 were adopted as printed. Petitions, Etc Pet of Achilles & Milam. A petition from A. Achilles and W. H. Milam stating that stand pipe at the Corner of Eleventh and Lavaca streets is a nuisance and requesting the removal of the same. was read and ordered filed the pipe having already been removed. Comm Rept on the Alderman Anderson for the committee on water and proposal of the Light, to whom was referred a proposal from the receiver of the Receiver of W & S. Co. Austin Water Light and Power Company agreeing to supply the City with water for Six months ending Dec 31 1893 as follows. For, fire protection (170 Hydrants) $1050 Second. For flushing Gutters on Congress Avenue and sixth street, in the City cemetery, City Hall, Fire department buildings, Public School buildings, and 15 public watering troughs, for the full amount of the City advalorem taxes assessed against the Company for 1893. presented a report thereon recommending that the proposal be not accepted because it was excessive in amount. The report was adopted Comm Rept on the Alderman Anderson for the Committee on water and light proposal of the to whom was referred a proposal from the Austin Gas light and Austin Gas Light & Co Coal Company agreeing to furnish additional street lights offered a report thereon recommending that it be not accepted And the report was adopted. Aldermen Fitchette. Dawson, and Kitchum entered the Council and answered to their names. Alderman Assman was excused. Repts of W & L. Comm Alderman Anderson for the Committee on water and Light to whom was referred the following resolution, to wit:“Resolved by the City Council of the City of Austin that the Mayor to appoint Mayor is hereby authorized to appoint a Special Committee special committee of two members of the City Council and two members of the Board of Public works whose duty it shall be to prepare a statement to the Citizens of Austin giving an estimate of when the power house and water and electric light system of the City now in course of Construction will be ready for use the estimated cost to the Consumers of water and Light when said system is under headway and fully and impartially stating any other facts in connection with said enterprise and the impediments thrown in way of its Construction that may be of interest and enlightenment to the Citizens of Austin and that such statement when fully complete shall be immediately given outfor publication” presented the following report thereon Report of Committee To the Honorable Mayor and City Council Your Committee to whom was referred the within resolution of Alderman Raymond are unable to give the information requested on account of the stringency of the money market hereby not being able to learn [illegible] when bonds can be sold.” The report was adopted after which Alderman Raymond made the following motion of order. “That the water and light committee have no authority to make any report other than favorably or unfavorably upon the passage of the resolution as the resolution provides --- Page break --- 552 For the appointment of a special Committee to make a statement to the Citizens of Quincy, and the resolutions was never amended so as to substitute the special Com-mittee for the special Committee provided in the resolution. Rulings by the chair. The Chair ruled on this point as follows: "In the opinion of the Chair the point of order is not well taken. Second point of order: "The resolution has never been passed by the Council and therefore no committee has any authority either to make or refuse to make the statement called for in the resolution as it is improper to carry out or attempt to carry out the provisions of the resolution until the same has been voted on and passed by the City Council." Rulings by the chair. On this point the Chair ruled as follows: "In the opinion of the Chair the point of order is not well taken. Motion to publish Alderman Raymond moved that a full report of the action action of Council of the Council in regard to the resolution be published in carried. the minutes and the motion carried. Unfinished Business An Ordinance entitled an ordinance to prevent the destruction Ord regulating fishing and to regulate the catching of fish in the Calamous river within of fish in Calamous the corporate limits of the City of Quincy and providing "a river. penalty for violation thereof" was taken up on its third reading, amendment and after which Alderman Shelly offered the following amendment to section 1 thereof " and at any point more than 100 yards below the foot of "said" amended Alderman Raymond moved to amend the amendment by striking out "100" and inserting " below the foot of "" carried. and the motion carried. --- Page break --- The amendment as amended was then adopted by the following vote. Nays 2 Aldermen Schuber, Townsend New Business Ord to appropriate By Alderman Marmoth $137.73 overpaid By an ordinance appropriating the sum of $137.73 Taxes for the purpose of paying the City National Bank the amount overpaid by Mrs. L. F. Robertson through City National Bank in settlement of back taxes, this being in accordance with the recommendation of the City Attorney. It was read the first time after which motions were made to suspend the rules and place the ordinance on its second and third readings, each of which were adopted by a two thirds vote of the whole Board of Aldermen. Ordinance passed The ordinance was accordingly read and on motion passed by the following vote. Offer to have By Alderman Glass down the Grumble Whereas the vault of one Grumbles situated in a Vault private graveyard in East Austin east of the present City Cemetery is in a dilapidated condition, Be it Resolved, By the City Council of the City of Austin that the City-health officer be and is hereby ordered to have said vault torn down and have remains of said Grumbles interred in said graveyard according to the Ordinances governing same. Referred to comm. On motion of Alderman North it was referred to Committee on cemetery. on Cemetery. The following was read Mayor's Office } Austin February 1st} Gentlemen of the City Council, I have the honor to report the sale of twelve thousand dollars ($12,000) more of the Austin water works and electric light bonds to Mr. Howard Lowengass of Kansas City Mo. at ninety five cents ($.95) on the dollar for the --- Page break --- purpose of adjusting the balance of his account against the city and I respectfully ask that you ratify said Bill Respectfully John Mc Donald Mayor referred to B. P. W. public works Alderman North moved to refer the communication to the Board of public works for report as to whether the price to be paid for bonds is 95 cents and accrued interest. Adopted. Report of Commissioners Court of Travis County re Bouldin bridge A report was received from the Commissioners Court of Travis County to the effect that the Bouldin Bridge and approaches are complete, and that the court desires the City to pay over to the County Treasurer one half of the Cost of same, namely $25-00 On motion of Alderman Platt this report was referred to the Street committee and City engineer with instructions to report on the matter at the next meeting of the city council. Pet of A B Leen Alderman Shelley for the committee on claims and accounts, made a verbal report on the petition and affidavit of A. B. Leen in regard to an error made by the board of equalization for the year 1892 in assessing a note against him which he did not own on the first day of January 1892 and on motion the petition was granted releasing him from the payment of taxes on this note. Res to widen dyke By Alderman Dauson - A. Resolution providing for the widening of the dyke between the bridge over the Colorado river and Bouldin Creek bridge. The Resolution provides "that the city join the County in making said improvement by furnishing a force of men and teams equal to that furnished by the County provided the dirt for making such improvement can be obtained with out cost to the City. Provided the City teams can be furnished so as not to prevent work in other parts of the city That that only a part of the City force will be employed at any one time and under the direction of the City engineer." The resolution was adopted. A com of City Engineer to examine crossing on Bull Creek Alderman Shelley moved that the Street Committee and City Engineer be requested to consider the question of providing a suitable crossing at which wagon may conveniently cross Bull Creek near the lake and to report the result of such investigation at its next meeting.
