The Minutes of a Regular Meeting of the City Council, Austin, Texas, April 16, 1894. Hon John McDonald, mayor, presiding. Roll Call. Present- Aldermen Anderson, Dawson, Fischer, Glass, Hancock, Jackson, Lawless, Nitschke, North, Platt, Powell, Rudd, Schneider, Shelley, Warmoth- 15. Absent- Aldermen Assmann, Henne, Linn, Raymond, Robertdean, Taylor, Townsend- 7 The minutes of the meetings of the city council, held on April 2 and April 14, 1894, were adopted as printed. Time of Council meeting changed. On motion of Alderman North, the time of regular meetings of the council was changed from 8 oclock to 8.30 oclock p.m. Petitions, Memorials, Etc. Communication from Babcock to have Protection Hose carriage painted & repaired. A communication from Frank O. Babcock, chief of Austin Fire Department, enclosing a request from Protection Hose Company that said company's hose carriages be painted and otherwise repaired, was read and referred to the fire committee. Petition to gravel E 5th Street. By Alderman Lawless- A petition from a number of citizens, asking that East Fifth street between Congress Avenue and East Avenue, be graveled. Referred to the street committee. Reports of Committees. Street Com. report on Bouldin Creek Bridge Alderman Jackson, for the street committee, to whom was referred a statement of the condition of Bauldin creek bridge made a report which states that a closer investigation discovered that a hole had been washed out by the recent rain, leav- ing the east wing walls and east end of the bridge in a dangerous condition, likely to result in serious damage if permitted to remain so. The committee therefore recommended an appropriation of $350 for repairs and offered an ordinance for that purpose. The report was laid over to come up with the ordinance under new business. Aldermen Linn, Raymond, Robertdean, Townsend and Taylor entered the Council and answered to their names. Cem. Com. report on petition as to burial of Colored paupers Bethany Cemetery. Alderman Platt, for the Cemetery Committee, to whom was referred the petition of colored voters, asking that colored paupers be buried in Bethany Cemetery of Austin, on the same terms and fees as are now given, made a report recommending that said petition be granted and that the mayor be authorized to contract with the Bethany Cemetery Association, said contract to take effect on August 3, 1894, when the present contract with Highland Park Cemetery Association will expire. Adopted. [illegible] Alderman North made a verbal report that the purchasing committee had opened the bids for furnishing feed for the city teams and had awarded the contract to C.J. Martin & Co. The report, on motion, was adopted. Alderman North, for the special committee, to whom was referred the resolution of the Jos. A. Mower Post 12414 Grand Army of the Republic, concerning the death of Col. J. C. DeGress, offered the following resolution which was adopted and ordered printed by a rising vote

Whereas, Col. J. C. De Gress departed this life on the 21st day of March 1894, and Whereas, For many years he occupied official positions under the city of Austin, the State of Texas and the federal government, both in civil and military capacities, Resolved, By the city council of the city of Austin that it is meet and proper that the city council should officially take notice of his death, Resolved, That by the death of Col. J. C. De Gress the country has lost a brave soldier and a faithful public servant. Resolved, That these resolutions be spread upon the minutes of the city council and that the picture of Colonel De Gress adorning the city hall chamber, be as a mark of respect, draped in mourning for the period of 30 days Alderman Assmann entered the council and answered to his name.
Unfinished Business.
Appropriation of $2500 for P[ease] & Harris heirs for land occu- pied by Dam and [illegible].
An ordinance appropriating the sum of $2500 for the purpose of purchasing from Mrs L C Pease and the heirs of John W. Harris, the land now occupied by the Dam railroad, was taken up on its third reading when Alderman Lawless offered the following amendment as section 4: Section 4. The said $2500 is given in full settlement of all claims by the estates of E. M. Pease, deceased, and John W. Harris against the City of Austin for the right of way of the dummy railroad, as specified and on account of the extension of West Pecan or Sixth street, over their land as the same now exists on the ground, and the said payment of $2500 is to be made upon condition that there will be no claim for any damages because of said Pecan or West Sixth street being located on their land where the same now exists. It was adopted by the following vote: Yeas: Aldermen Anderson, Assmann, Dawson, Fisher, Glass, Hancock, Jackson, Lawless, Linn, Nitschke, North, Plath, Powell, Raymond, Redd, Roberdeau, Schneider, Shelley, Taylor, Townsend, Warmoth, total 21. The ordinance was then read a third time and passed by the following vote: Yeas- Aldermen Anderson, Assmann, Fischer, Glass, Hancock, Jackson, Lawless, Linn, Nitschke, North, Plath, Powell, Raymond, Redd, Schneider, Shelley, Taylor, Townsend, Warmoth 19. Nays- Aldermen Dawson, Roberdeau 2. Alderman North moved that the mayor be authorized to rent additional office room for himself and the Board of Public Wards. Carried. Alderman Taylor, by unanimous consent, presented a petition from L H Easton and A O Watson, stating that William Uninsworth, is operating a saw mill and stabbing stock in Lot 6, Block 134, is injuring their property, and establishing a nuisance. Relief is asked for. On motion of Alderman Linn the petition was tabled by the following vote:

Nays- Aldermen Anderson, Dawson, Glass, Jackson, Platt, Powell, Roberdeau, Schneider, Taylor, Townsend- 10 By Alderman Jackson- An ordinance appropriating the sum of $350 for the purpose of making additional repairs to Bouldin bridge on South Congress avenue. It was read the first time and a second and third time under suspension of the rules and passed by the following vote: Yeas- Aldermen Anderson, Asmann, Dawson, Fischer, Glass, Hancock, Jackson, Lawless, Nitschke, North, Platt, Powell, Raymond, Redd, Roberdeau, Schneider, Taylor, Townsend, Warmoth-19 Nays- Aldermen Linn, Shelley- 2. On motion, the City attorney was requested not to bring suit for the present for money due under the lease of the Dam railroad. Alderman Hume entered the council and answered to his name. By Alderman Warmoth. A statement from the Austin Dam Street Railway company, showing the receipts and disbursements of said road from October, 1893 to March, 1894, and submitting as a compromise of the matter of rent a proposition that said road would pay one half of the amount claimed, and surrender the property in accordance with the demand of the city, making such payment promptly before acceptance by the city of their proposition. Alderman Warmoth moved that the proposition be accepted. Alderman Glass moved as a substitute, that it be referred to a special committee. The substitute was adopted and the mayor appointed Alderman Glass, North and Lawless on such committee. By Alderman Anderson- An ordinance appropriating the sum of $6648.84 for the purpose of paying certain estimates and accounts on account of the waterworks and electric light system for the city of Austin. It was read first time and a second and third time, under suspension of the rules, and passed by the following vote: Yeas- Aldermen Anderson, Asmann, Dawson, Fischer, Glass, Hancock, Hume, Jackson, Lawless, Linn, Nitschke, North, Platt, Powell, Raymond, Redd, Roberdeau, Schneider, Shelley, Taylor, Townsend, Warmoth. Total 22. By Alderman Jackson- An ordinance appropriating the sum of $1000 for the purpose of paying extra street and sanitary laborers. It was read first time and a second and third time under suspension of the rules and passed by the following vote: Yeas- Aldermen Anderson, Asmann, Dawson, Fischer, Glass, Hancock, Hume, Jackson, Lawless, Linn, Nitschke, North, Platt, Powell, Raymond, Redd, Roberdeau,

It was read the first time, after which the rules were suspended by a two-thirds vote of the council and the ordinance read a second time, an amendment by Alderman Taylor inserting $500 instead of $1000 was accepted The rules were again suspended by a two-thirds vote, the ordinance read a third time and passed by the following vote: Yeas- Aldermen Anderson, Assmann, Fischer, Glass, Han cock, Hume, Jackson, Lawless, Linn, Nitschke, North, Platt, Powell, Raymond, Ridd, Roberdean, Schneider, Shelley, Taylor Townsend, Warmoth: 21 Nay- Dawson. The council then adjourned Milton Morris, City Clerk
