Minutes of a Regular Meeting of the City Council. Austin, Texas. Feb 18. 1895.
Hon John McDonald, mayor, presiding. Roll call. Present Aldermen Fischer, Glascock, Foeth, Haynes, Lawless, Linn, Nitschke Platt, Powell, Redd, Robertson, Schneider, Shelley, Taylor, Tobin, Warmoth; total, 16. Absent Aldermen Anderson, Asmann, Glass, Kunce, Jackson, Paw[illegible]send; total 6. Minutes of the meeting of the city council held Feb 4, 1895, were adopted as printed. Alderman Jackson entered the council and answered to his name. Petitions, Memorials, Etc.
Bethany Cemetery Co. A petition from the Bethany Cemetery Company, alleging that the Petition. remains of a colored pauper had recently been buried in the city cemetery, contrary to the city's agreement with said company, and requesting the council either to have the remains exhumed and re-interred in the grounds of said company or pay the said company the amount it would have received from the city had the interment been made in the grounds of said company. Alderman Lawless moved to lay the petition on the table and the motion prevailed.
Frank Brown & others. By Alderman Taylor. A petition from Messrs Frank Brown, Henry Petition for grade of Hutchings and Thomson and Donnan, agents for Gillette estate street. stating that they have donated to the city a street extending west through outlots 9, 10 and 11, division E. from West avenue to Shoal creek, and requesting the city council to establish the grade of said street and authorize the street committee to grade and work the same. The petition was read and referred to the street committee. Aldermen Asmann and Glass entered the council and answered to their names. Reports Of Committees.
Tax Ordinance Prescrib- Alderman Taylor, for the committee on ordinances, to whoming penalties. was referred an ordinance amending article 171, title 5, chapter 4, of the Revised Civil Ordinances of the City of Austin, as amended Sept 4, 1893, presented a report thereon, recommending its passage. The report was read and laid over, to be taken up with the ordinance named therein, under the head of unfinished business. The ordinance prescribes penalties to be levied and collected where real estate has been advertised for sale for taxes.
Public Amusement Ord. Alderman Taylor, for the committee on ordinances, to whom was referred an ordinance, entitled "An ordinance providing for the protection of persons attending theatres and other public places of amusements in this city, and fixing a penalty for the violation thereof" presented a

report recommending the passage of the same with the following amendment: "Section 5a. That every opera house, building, room or part of a room, in this city wherein any public performances, lecture or other public amusement is given or held, shall be provided with one or more aisles, not less than three feet in width, which shall at all times during such performances, lecture or other public amusements, be kept free from any obstruction which would impede the egress of persons attending such performance, lecture or other amusement in case of fire or fire alarm." The report was laid over to be taken up with the ordinance named therein, under the head of unfinished business. Police report on Alderman Powell, for the committee on police, to whom Marshals account. was referred the reports of the city marshal for the month of January, 1895, presented a report thereon, which states "that the said reports were examined and found to be correct". Adopted. F. D. Rushing. Report Alderman Powell, for the committee on police, to whom Police Com. was referred a communication from Mr F. D. Rushing, secretary of the Austin Rapid Transit Railway Company, in regard to special policemen riding free on the cars of the company, presented a report thereon, which states: "That the ordinance reads that police officers shall ride free. As our force is small and we find it necessary to have a few special policemen, we recommend that all special badges be called in except seven, and that the city marshal be instructed to have them display their badges on the outside of their coats. The report was adopted. Printing Com. Alderman Roberdeau, for the committee on printing Awards. presented a report, which states that bids were received for doing the city's job and newspaper printing during the year ending November 30th 1895, and that the Statesman Publishing company was awarded the contract for doing the newspaper printing and Eugene Von Boeckmann was awarded the contract for doing the job printing. The report was adopted and the mayor authorized to enter into contracts in accordance with the awards. Austin City Cemetery Alderman Platt, for the committee on cemetery, asked Ass. for further time in which to prepare a report on an ordinance authorizing the Austin City Cemetery Association to establish a cemetery in the city of Austin. Granted. Wallie Carpenter. Alderman Platt, for the committee on cemetery, reported that Wallie Carpenter had been awarded the contract for hauling remains of paupers to the cemeteries.

The report was adopted and the mayor authorized to enter into contract in accordance with the annexed and specifications.
Fire Com. Report Alderman Robertdeau, for the committee on fire department, on Truck &c. to whom was referred an ordinance appropriating the sum of $2500.00 for the purchase of a fire truck with instructions to advertise for bids, offered a report thereon thereon which states "that an advertisement has been forwarded to a journal of large circulation among manufacturers of fire apparatus, and pending receipt of proposals, respectfully recommend the passage of the accompanying ordinance." The report was adopted. Alderman Anderson entered the council and answered to his name.
J. B. Vinson & others, Alderman Nitschke presented a communication from Mr against new cemetery J. B. Vinson, presiding at a mass meeting of citizens and property owners living adjacent to and in the vicinity of the proposed extension to the city cemetery, held at Scotts store on Feb 15, 1895, setting forth a resolution which was unanimously adopted at said meeting protesting against the proposed extension of the city cemetery. It was read and referred to the committee on cemetery. Aldermen Hume and Townsend entered the council and answered to their names. Unfinished Business.
Culvert on W 5th & An ordinance appropriating the sum of $1649.22 for the Little Shoal. killed purpose of building an arch culvert on West Fifth street at the intersection of Nueces street, over Little Shoal creek, was taken up on its final passage. Alderman Powell moved to lay the ordinance on the table subject to call. Alderman Lawless moved as a substituted, to lay the ordinance on the table, and the motion prevailed.
$1800 Fire Truck. An ordinance appropriating the sum of $2500.00 for the purchase of a fire truck, was taken up on its second reading and read. Alderman Robertdeau then moved to amend the caption and section 1 of the ordinance by striking out "$2500.00 and inserting in lieu thereof $1800.00. Carried. Alderman Glass moved to lay the ordinance on the table subject to call, and the motion was lost by the following vote: Yeas. Aldermen Fischer, Glass, Garth, Hume, Jackson, Platt, Redd, Tobin, Warmoth- 9. Nays. Aldermen Anderson, Armmann, Glascock, Haynes, Lawless, Linn, Nitschke, Powell, Robertdeau, Schneider, Shelley, Taylor, Townsend- 13. The ordinance was then passed under suspension of the rules by the following vote:

Nays- Aldermen Glass, Hume and Jackson. An ordinance entitled "An ordinance amending article 171, title 5, chapter 4, of the Revised Civil Ordinances of the City of Austin as amended Sept 4, 1895" was taken up on its second reading and read. Alderman Linn then moved to amend section 1 thereof by striking out $2 for executing deed to purchaser at tax sale and inserting in lieu thereof fifty cents. The motion was adopted by the following vote: Yeas- Aldermen Anderson, Assmann, Fischer, Glascock, Haynes, Hume, Jackson, Lawless, Linn, Platt, Parwell, Roberdeau, Schneider, Shelley, Taylor, Tobin, Townsend, Warmoth - 18. Nays- Aldermen Glass, Goeth, Nitschke, Redd- 4. Alderman Shelley moved to amend section 2 of the ordinance by striking out the word "October" and inserting in lieu thereof the word "December"; and also by striking out the remainder of the section after the word "year". The amendment was adopted. A motion was made to suspend the rules and place the ordinance on its third reading, which was adopted by the following vote: Yeas- Aldermen Anderson, Assmann, Fischer, Glass, Glascock, Goeth, Haynes, Jackson, Lawless, Linn, Nitschke, Platt, Parwell, Redd, Roberdeau, Schneider, Shelley, Taylor, Townsend, Warmoth-20. Nays- Aldermen Hume and Tobin- 2. The ordinance was then read a third time and passed. An ordinance entitled "An ordinance providing for the protection of persons attending theatres and other public places of amusement in this city and fixing a penalty for the violation thereof" was taken up on its second reading and read. The amendment offered by the committee and above set forth was then adopted. The ordinance was then duly passed under suspension of the rules. Alderman Anderson was excused from further attendance on the session of the council. New Business. By Alderman Tobin- An ordinance appropriating the sum of $13,905.22 for the purpose of paying engineering and miscellaneous expenses connected with the con- struction of the water and light system for the city of Austin; also draft of General Electric Company due under thier contract with the city, and also freight bill of the General Electric Company. It was passed under suspension of the rules by

the following vote: Yeas- Aldermen Asmann, Fischer, Glues, Glascock, Garth, Haynes, Hume, Jackson, Lawless, Linn, Nitschke, Platt, Powell, Redd, Roberdeau, Schneider, Taylor, Tobin, Townsend, Warmoth - 20 Nay- Alderman Shelley.
Fire. Election of officers. By Alderman Schneider An ordinance amending articles 262 and 263, chapter 1, title 9, of the revised civil and criminal code of the city of Austin. It was read and referred to the committee on fire department. It refers to the election of officers of the fire department.
Resolution as to City By Alderman Schneider. Whereas, The city and county hospital is & County Hospital. costing this city between four and five thousand dollars annually for maintaining same; and Whereas, The county of Travis is supposed to pay at least one-half for maintaining said hospital; therefore be it Resolved by the city council of the city of Austin That the hospital committee be empowered to make such arrangements with the honorable commissioners court of Travis county as to at least get them to pay one half of the expenses for maintaining said hospital, or to tender them the maintainance and the city pay one half of the expenses. Adopted.
$2400. Int on Bonds of By Alderman Linn. An ordinance appropriating the sum of May 1-90 $2400 for the purpose of paying interest on bonds of the city of Austin issued prior to May 1, 1890 due July 1, 1894 and January 1, 1895. It was passed under suspension of the rules by the following votes: Yeas Aldermen Asmann, Fischer, Glass, Glascock, Garth, Haynes, Hume, Jackson, Lawless, Linn, Nitschke, Platt, Powell, Redd, Roberdeau, Schneider, Shelley, Taylor, Tobin, Townsend, Warmoth - 21.
City Auditor By Alderman Taylor. An ordinance creating the office of city auditor of the city of Austin, defining the duties, and fixing the compensation of such officer. It was read and referred to the committee on finance.
Resolution for Wt By Alderman Fischer. Be it & L data +e from Resolved by the City Council, That the secretary of the Board of Secy B.P.W. Public works of the city of Austin is hereby instructed to furnish the finance committee with a memoranda of the amounts of all contracts connected with the water and light system and the terms of pavements on said contracts. Adopted.
Alta Vista Cem. Assn. By Alderman Taylor. A proposal from the Alta Vista Cemetery Association. Alderman Shelley moved that it be referred to the committee on Cemetery without being read, and the motion prevailed. The council then adjourned
