Minutes of a Regular Meeting of the City Council. Austin, Texas; January 20, 1896. Hon. Lewis Hancock, Mayor, presiding.
Roll call Roll called Members present Present Aldermen Fischer, Glasscock, Glass, Haynes, Lawless, Linn, Nitschke, Powell, Redd, Roberdeau, Rosenbaum, Shelley, Stumpf, Taylor, Tobin, and Walker. 18. Members absent Absent Aldermen Beaty, Goeth, Horton and Schneider. 4. Adoption of minutes of On motion of Alderman Powell the reading of the minutes was dispensed previous meeting as printed. with and they were approved as printed. Proposition of C.A. Beard to The proposition of C.A. Beard to furnish the City with Coal, was read, and furnish the City with Coal referred to the purchasing Committee. Pet. of Citizens on Austin Rapid By Alderman Linn. Petition of Citizens in regard to the Austin Rapid Transit R R Co. Transit Railroad Company, which was read, and on motion was referred to a Special Committee consisting of Aldermen, Linn, Glass, Nitschke, Shelley and Stumpf. Leave of absence granted Fred. On motion of Alderman Linn, leave of absence was granted the Recorder Carleton, Recorder from January 30th to February 6th 1896. Pet. of Geo. A. Brush et. al. The petition of Geo. A. Brush et. al. asking to be refunded amount paid by them for land, was read. Alderman Nitschke moved to refer the petition to the Committee on Claims and Accounts: Alderman Fischer moved as an amendment, that the petition be granted, which motion prevailed. Aldermen Beaty, Goeth and Horton entered the Council Chamber and answered to their names. Pet. of A.H. Pressler for permission By Alderman Powell, Petition of A.H. Pressler asking permission to conto construct R R on W. 3rd St. struct a Railroad on West Third street in front of Dembs' beer house read and on motion referred to the Street Committee with power to act. Pet. of J.H. Franklin for remission Petition of J.H. Franklin for remission of fine imposed in Recorder's Court of fine in Recorder's Court was read and on motion was referred to the Mayor. Ordinance granting permission By Alderman Lawless, An ordinance granting permission to the Austin to Austin Dam & Suburban R R Co Dam and Suburban Railway Company to lay tracks from its line on to lay tracks on W. 4th St. Fourth Street to its Car sheds on the old Court house square, was read and laid over to come up under the head of new business. Pet. of Trustees of Swedish By Alderman Townsend, Petition of the Trustees of the Swedish Evangelical Evan. Lutheran Church Lutheran Church, for permission to use a portion of the side walk in front of their Church was read and granted. Pet. of Citizens to have 21st graded By Alderman Townsend, Petition of Citizens to have Twenty First Street South of University South of the University graded, read, and on motion referred to the Street Committee. Pet. of Austin Base Ball and The petition of the Austin Baseball and Athletic Association to lease the Athletic Assc. to lease City Park old City Park, was read, and on motion was referred to a Committee on Parks. Report of City Auditor & Clerk The report of the City Auditor and Clerk in the matter of embargoed tax on Books &c rolls of the City, was read and on motion the report was ordered filed, and a Committee of three, consisting of Aldermen Powell, Goeth, and Shelley, were appointed to confer with the City Attorney, and report back to the Council. Proposition to repair certain streets The reports of the City Engineer in regard to certain [illegible] was read, and on motion was referred to the [illegible] committee.

To the old Water Company, together with a communication of C. C. Bartholomew Esq. receiver of said company, on the same subject was then read. Alderman Smith moved to refer to the Water and Light Commission which motion prevailed. The following communication from the Water and Light Commission was then read:
Austin, Texas Jan. 20 1896. Honorable Mayor and City Council. W & L Com. report re award of Gentlemen: contract to Howard Shelly to lay I have the honor to report that at a meeting of the Water and 4" pipe Light Commission held on December 28, 1895, the proposition of Mr. Howard Shelly to lay all 4 inch cast iron water pipe for the city for 13 1/2 cents per foot was accepted by the Commission, and on motion the acceptance of said proposition by the City Council was recommended. Respectfully submitted W. J. Oliphant, Secretary Water and Light Com'n. Action of W & L Com confirmed. On motion the action of the Water and Light Commission in the matter was confirmed. Ald. Tobin for W & L Com. stated Alderman Tobin, for the Water and Light Commission, stated that the contractor for putting in pumps contractor for putting in the turbines at the dam was now here, and at Dam was now here. asked that the Water and Light Commission have authority from the City Council authorizing them to employ an Engineer or Engineers to supervise this work and also in the matter of the reservoir. W & L Com. authorized to employ Alderman Fischer moved that the Water and Light Commission be Engineer or Engineers authorized to employ an Engineer or Engineers for the purpose indicated and that the Mayor, with the authority of the Water and Light Commission, be authorized to enter into contract with him or them, which motion prevailed. Ald. Shelly excused Alderman Shelly was excused from further attendance at this meeting of the Council. Special Com's rept. on destruction The special committee appointed to destroy the cancelled coupons of Cancelled Coupons presented their report, stating that they had burned the coupons as directed. On motion of Alderman Nitschke the report was received and the committee discharged. Rept. of Police Com. on City By Alderman Powell, Report of the Police Committee on the reports Marshal's rept. for Dec. 1895. of the City Marshal for the month of December 1895. On motion the report of the Committee was received and ordered filed. Report of Printing Com. Alderman Haynes for the Printing Committee, presented the following report, which was read and ordered filed.
Austin, Texas, January 20, 1896. To the Honorable Mayor and Council of the City of Austin: Your Committee on Printing to whom was referred the 5000 copies of final report of the Board of Public Works, with its illustrations, as contemplated in resolution of the Council of Jan. [illegible] 1896, beg leave to report that we recommend that the bid of Mr. Von Boeckmann, Pub Prtr be accepted, to wit: For him to furnish the copper plate illustrations, as contemplated in said resolution, and that the said Von Boeckmann furnish said report complete at $1.25 per page and 37 copies 55 cts per page. See his bid.

Report of Com. on Sanitation and Sewerage, on Stock Pen on 1st St The Committee on Sanitation and Sewerage, presented the following report: Austin, Texas, January 20, 1896. To the Hon. Lewis Hancock, Mayor, and Board of Aldermen of the City of Austin: Gentlemen: Your committee on Sanitation and Sewerage to whom was referred two petitions, regarding a stock pen on East First Street, beg leave to report that we have examined said pen and find it well kept and in a good sanitary condition, as previously reported by the City health officer. We also find that the danger complained of in petitions, if there is any, by driving cattle on said street, would be caused by cattle driven to the railroad shipping pens and cattle driven to the City pound, which we find is in no wise connected with said stock pen. We also find that said pen is not extensively used and very few stock kept there and only for a few days at a time. W. A. Glass, C. W. Powell, F. M. Beaty, Committee on Sanitation and Sewerage. Alderman Simms moved that the report be received and filed and that the Committee be discharged from further consideration of the matter, which motion prevailed.
Rept. of Specl Com. on Ords. defining duties of Street Commissioner. The Special Committee to whom was referred an ordinance defining the duties of Street Commissioner reported a substitute ordinance for the original ordinance. On motion of Alderman Roberdeau the report was laid over to come up with the ordinances.
Ord. appropriating $1800 for Fire hose Alderman Roberdeau moved that the Council take up an ordinance making an appropriation to purchase fire hose, which motion prevailed. An Ordinance appropriating the sum of $1800 for the purpose of purchasing fire hose was then taken up and read a second time. On motion of Alderman Roberdeau, the rules were suspended and the ordinance placed upon its third reading and final passage by the following vote: Yeas: Aldermen Beaty, Fischer, Glascock, Glass, Booth, Haynes, Horton, Lawless, Orrell, Powell, Redd, Roberdeau, Scarbrough, Skaggs, Taylor, Tobin, Townsend, Simms and Zilker. (20). Nays: None.
Passed.
Ord. to regulate payment of W.L. & Power rates Passed. On motion of Tobin, An ordinance to further regulate the payment of Water, Light and Power rates. The ordinance was passed under suspension of the rules by the following vote: Yeas: Aldermen Beaty, Fischer, Glascock, Glass, Booth, Haynes, Horton, Lawless, Orrell, Powell, Redd, Roberdeau, Scarbrough, Skaggs, Taylor, Tobin, Townsend, Simms, and Zilker. (19). Nays: None.

Report of Purchasing Com. on award of Contract for Shoeing paper Alderman Oliver from the purchasing committee, reported that the committee had awarded the contract for furnishing the City with Straw, timber for the year 1896, to Messrs. A. F. Martin & Bro. and the contract for shoeing mules belonging to the City for 1896, to H F Cook & Bro. Alderman Lawless moved that the report be adopted, and the Mayor authorized to enter into contract with the parties named in accordance with the contract, which was agreed to.
Petition of Citizens in 10th Ward in regard to stock pen The Mayor laid before the Council the petitions of Citizens in the Tenth Ward, in regard to a stock pen. Alderman Blass moved that the petition be laid upon the table, which motion was adopted.
Case of E. C. Anderson for permission to move frame building, etc. The Mayor laid before the Council the petition of Mr. E. C. Anderson for permission to move a frame building within the fire limits. Alderman Blascock moved that the permission be not granted, which motion prevailed.
Bond of City Auditor referred to Fin. Com. The bond of S. A. Wheatley, City Auditor, was referred to the Finance Committee.
Subst. Ordr. defining duties of Street Commissioner The Mayor laid before the Council the substitute ordinance offered by the special committee defining the duties of Street Commissioner. Alderman Linn moved that the substitute offered by the committee be substituted for the original ordinance. Carried. The ordinance was then read a second time.
Ald Powell moved to Amend Sect 1 Alderman Powell moved to amend section 1 by striking out the words, "subject to the approval of the street committee."
Ald. Taylor offered substitute Alderman Taylor offered as a substitute for Alderman Powell's motion to add to Section 1.
Ald Blascock to amend substitute Lost. Taylor's substitute lost Powell's Amendmt adopted Alderman Blascock moved to amend Alderman Taylor's motion by adding "the Mayor and Council," which was lost. Alderman Taylor's substitute was then lost. The amendment of Alderman Powell was then adopted by the following vote: Yeas/ Aldermen Beaty, Fischer, Blascock, Blass, Haynes, Horton, Lawless, Plath, Powell, Redd, Rosengren, Stumpf, Taylor, Tobin, Townsend and Zilker 16. Nays, Aldermen Dorth, Linn, Roberdeau, Nitsche and Saylor 5.
Ald. Zilker moved to amend Sect. 4 adopted. Ald. Linn excused Alderman Zilker moved to amend section 4 by inserting after the word 'supervision,' the words 'and control', which motion was adopted. Alderman Linn was excused from further attendance at this session of the Council by the following vote: Yeas, Aldermen Fischer, Blass, Dorth, Lawless, Platt, Powell, Redd, Rosengren, Stumpf, Tobin, Townsend and Zilker 13. Nays, Aldermen Blascock, Haynes, Horton, Nitsche, Roberdeau and Saylor 5.
Suspension of rules & final passage of Ord. Alderman Pitscher moved a suspension of the rules, and the ordinance be now put upon its third reading and final passage, which motion prevailed by the following vote: Yeas, Aldermen Beaty, Fischer, Blascock, Blass, Haynes, Horton, Lawless, Platt, Powell, Redd, Roberdeau, Rosengren, Stumpf, Saylor, Tobin, Townsend, and Zilker. 19. Nays, none.

Aldermen Platt, & Ohluenck excused Aldermen Black and Woosley were excused from further attendance at this session of the Council.
Ord appropriating $1279.88/100 to pay By Alderman Tobin, An ordinance appropriating the sum of $1279.88/100 out of [illegible] of the W Fund the Water and Light Fund, for the purpose, of paying certain approved accounts was read and under suspension of the rules placed upon its second reading by the following vote: Yeas Aldermen Beaty, Fischer, Glass, Goeth, Haynes, Horton, Lawless, Litscher, Powell, Redd, Robendeau, Rosenegren, Stumpt, Taylor, Tobin, Townsend and Zilver 17. Nays. none.
Ord. appropriating $480 to pay By Alderman Glass, An ordinance appropriating the sum of $480.00 to pay extra Sanitary Laborers. salaries of extra Sanitary laborers, was read. Alderman Glass moved that the rules be suspended and the ordinance placed upon its second reading, which motion prevailed by the following vote: Yeas Aldermen Beaty, Fischer, Glass, Goeth, Haynes, Horton, Lawless, Litscher, Powell, Redd, Robendeau, Rosenegren, Stumpt, Taylor, Tobin, Townsend and Zilver 17. Nays none.
Ord read second time The ordinance was then read a second time.
Ald Taylor moved to amend the ordinance by Alderman Taylor moved to amend the ordinance by striking out $480 and inserting $240 instead of $480 inserting $240 instead of $480. which motion was lost.
Alderman Fischer moved to suspend the rules and place the ordinance upon its third reading, which motion was lost by the following vote: Yeas Aldermen Beaty, Fischer, Glass, Goeth, Haynes, Horton, Lawless, Litscher, Powell, Redd, Robendeau, Rosenegren, Stumpt and Zilver 14. Nays. Aldermen Taylor, Tobin and Townsend. 3. Alderman Fischer offered the following resolution, which was lost:
Ordr creating office of Inspector of Weights Resolved by the City Council of the City of Austin, That the & Measures referred to ord committee Ordinance Commitee be and they are hereby instructed to prepare an ordinance creating the office of Inspector of weights and measures, defining his duties and fixing his fees.
