Austin Charter Reforms: Major City Boundaries and Council Changes 1897

Expanded city boundaries: Council voted to significantly extend Austin's city limits, incorporating new territory north and south of the Colorado River with detailed surveying requirements.

Restructured city council: Changed the alderman system from 11 wards to 8 wards, with each ward electing two aldermen—one local representative and one citywide representative—to take effect after the December 1897 election.

Capped government salaries: Set maximum salary limits for city officials including the City Marshal, Clerk, and Attorney at $1,500 each; the City Engineer and Assessor at $1,200-$1,800 to control spending.

Consolidated city positions: Combined the separate City Engineer and Superintendent of Streets into one position, while creating a new Board of Equalization with a one-year term.

Modernized election and tax procedures: Made publication of council proceedings optional, allowed mayors to call special meetings with three council members, and prioritized city tax claims over other debts on delinquent properties.

Minutes of a Call of the City Council. Austin, Tex., Jan. 7, 1897. Present: Lewis Hancock, Mayor, presiding. J.M. Miller. Aldermen: Bating, Calhoun, Fischer, Haynes, Kuhn, Maddox, Miller, Platt, Schneider, Shelley, Stumpt, Townsend and Ward. Aldermen absent: Horton and Will. The following call was then read: Special Meeting. Austin, Tex., Jan. 7, 1897. A special meeting of the City Council is hereby called to meet in the Council Chamber at 4:30 o'clock p.m. this day, January 7, 1897 to receive and act upon the report of the Special Committee on Charter Amendments. Thence westerly with the north line of said Brackenridge tract to within ten varas of the Colorado River's ordinary water level, as said level has been determined by a line surveyed and marked under direction of the City authorities. Thence up the east bank of the Colorado River, skirting ten varas of said line so surveyed, twenty-two (22) miles by following the river. Thence across said river at right angles to a distance of ten varas beyond said water level, as surveyed and marked on the west side of said river. Thence down the Colorado River within ten varas of the ordinary water level of the Colorado River, from the completion of the dam to a point ten (10) varas back from the bluff face, two hundred (200) varas below the dam. Thence in a direct line to the nearest point on south bank of said Colorado River. Thence down said river along its south bank to its north west corner of Lot No eleven (11) of ten and 100 acres, set apart to Nancy Fox, in partition of the estate of James W. Gouldin, deceased, in the probate Court of Travis County, Texas, as surveyed Sydney Jex, at J. W. Gouldin et al. Thence south 30° West with the west line of the original Gouldin tract to the corporate limits of the City of Austin. Thence N. 9. 30' W. with the corporate limits of the City of Austin, along said boundary to a point on the west line of the original Gouldin tract. Thence in a direct line to the nearest point on the north line of the J. W. Gouldin tract. Thence easterly along the north line of the J. W. Gouldin tract to the northeast corner of said tract. Thence southerly along the east line of the J. W. Gouldin tract to the southeast corner of said tract. Thence in a direct line to the nearest point on the south line of the J. W. Gouldin tract. --- Page break --- Proposed Boundaries Sec. 3. No. of Wards Mayor and Council of Aldermen how chosen Sects 9, 11, 17, 18, 23, 33, 35, 40, 41, 47, 48 543 . Thence across the Colorado River in a straight line to the place of beginning. Section 3 is to be amended so as to limit the number of wards of the City to just more than six. Sections 4, 5, 6, 7 and 8 are to be amended so as to make the City Council consist of a Mayor and a board of Aldermen; the board of Aldermen to be composed of two Aldermen from each ward, one of them to be elected by the residents, only of the ward, and the other to be elected by the residents of the City at large; but from among the residents of the particular ward; provided, that the members of the present board of Aldermen shall hold their offices until the next general election in December, 1897, at which time the whole board shall retire and a new board under the provisions of this Charter shall then be elected; provided, further, that the Aldermen at large elected at the first general election, to-wit, in December, 1897, only hold their offices for one year, and those elected by residents, only of their respective wards shall hold for two years, so that thereafter the Aldermen elected at large shall be elected in the year when no mayoralty contest takes place. Sec. 9. Section 9 is to be amended so as to make it obligatory upon the City Council to provide by ordinance a mode of procedure which is to be followed in contested election cases. Sec. 11. Section 11 is to be amended by striking out the last clause, to-wit; "but not a second time for the same offense." Sec. 17. Section 17 is to be amended so as to make the publication of the Council proceedings optional with the Council. Sec. 18. Section 18 is to be amended so as to make the President of the Council to be elected only upon nomination by members of the board of Aldermen. Sec. 23. Section 23 is to be amended by substituting the words "regular meetings" for the words "stated sessions," and further by giving the power to call a special meeting to the Mayor or to any three members of the Council, instead of any five members. Sec. 33. Section 33 should be amended by adding at the end, "except in the election of Officers." Sec. 35. Section 35 should be amended by adding thereto that it shall be the duty of the City Council to levy taxes at the first meeting in March of each year. Sec. 40. Section 40 should be stricken out. Sec. 41. Section 41 should be amended by providing for the creation of a new commission to be composed of three resident free-holders of the City of Austin, who shall take the oath of office prescribed by the constitution, hold office for two years, and receive such compensation as may be fixed by the City Council. And the section should be further amended by limiting the action of the County Court on appeal to ascertaining the correctness of the action of the commission and not to pass on the valuations made by said board. Sec. 47. Section 47. amended by, striking out the provision which limits the City upon its corporate property, or in any [illegible] Sec. 48. Section 48. is also amended by, striking out the part of the section --- Page break --- 544 Sec. 49. without previously offering the property for Section 49 should be amended so that the tax-laws created in favor of the City shall be prior to all other claims and attach to the property in the hands of the purchaser from the delinquent tax-payer. Sec. 56. Section 56 should be amended so as to provide that the Mayor only shall have the right to nominate all the Officers Boards and Agents of the City, excepting whereby by the Charter a different mode is expressly provided, and that Police Officers shall be elected on nomination by the Mayor, subject to confirmation by a majority of the City Council; and provided further if a nomination fails of confirmation on the first ballot the Mayor shall not nominate Sec. 59. the same person a second time, and should be amended so as to require the Council to fix the salaries of all Officers before their election. Section 59, paragraph 51 should be amended by adding a proviso under which the elections may be held under the provisions of the State law in regard to registration of the voters; and that such registration shall be closed thirty days prior to the day of the election, and further by requiring that a voter shall vote in the ward in which he has registered, un- less such a change of residence, such removal has been endorsed on his certificate officially by the registrar. Sec. 70. Section 70 should be amended so as to give, in case of absence or illness of the Recorder, or in case of vacancy in the office of Recorder, the Mayor the power to designate some proper person who has the qualifications of Recorder to act *ad interim*, such person to draw for the time he is so acting as Recorder the *pro rata* of the Recorder's salary. Sec. 71. Section 71 is to be amended so as to conform to the amendment of section 56, as stated. Sec. 71. Section 71 is further to be amended by eliminating from among the Charter offices those of City Engineer and of Superintendent of Streets, and substituting therefor one officer to be known as City Engineer and Superintendent of Streets; and further, by adding to the Charter office that of the board of equalization. Sec. 71. Section 71 should further be amended by making the term of the Charter Officers only two years, and providing for removal and abolishment of all other Officers, boards, agents and employees at the pleas- ure of the Council, unless otherwise expressly provided for by the Charter. Sec. 78. Section 78 should be amended by making the salary of the City Marshal not more than Fifteen Hundred Dollars. Sec. 79. Section 79 should be amended by making the salary of the City Clerk not more than Fifteen Hundred Dollars. Sec. 96. Section 96 should be amended by making the salary of the City Attorney not more than Fifteen Hundred Dollars (and by providing for such additions.) Combination salary, be allowed by the City Council in case the City Attorney is employed for services not embraced in Section 71. Sec. 97 should be amended by authorizing the City Treasurer to provide and keep a cash book to be submitted for inspection by the Finance Committee, on or before the 10th of each month, or whenever he may be called on by the Mayor. Sec. 97, Section 80 should be amended so as to --- Page break --- 543 incident to the office of City Engineer and Superintendent of Streets, as created by section 77. Sec. 81. Section 81 should be amended by limiting the Salary of the City Engineer and Superintendent of Streets to not more than Twelve Hundred Dollars. Sec. 85. Section 85 should be amended so as to limit the Salary of the City Assessor and Collector to not more than Eighteen Hundred Dollars. Sec. 87. Section 87 should be amended so as to authorize Surety Companies authorized to do business in this State, to become surety on the bond of the City Treasurer. Sec. 88. Section 88 should be amended by making the Salary of the City Treasurer not more than Six Hundred Dollars. Sec. 93. Section 93 should be amended so as to make the Salary of the City Recorder not more than Twelve Hundred Dollars. Sec. 96. Sections 96 to 99 inclusive should be stricken out, as the Office of Superintendent of Streets has been abolished by section 77. Sec. 103. Section 103 should be amended so as to make the Fiscal year of the City run from the first day of January to the 31st day of December inclusive. Surety Companies on It is further recommended that a general provision be made auBonds of City Officials thorizing Surety Companies to become surety on any bonds required by the City. Alderman Schneider moved that the Council take a recess of ten minutes. Carried. At the end of the recess the Council was called to order by the Mayor. Roll called. Alderman Beatly, entered the Council. The vote was taken on Alderman Nitschke's substitute for the motion of Alderman Shelley and it was lost, the following votes Nays 16. Alderman Schneider moved to amend the motion of Alderman Shelley by adding "and the Evening News, provided they publish it at the same price as the Statesman." Alderman Shelley accepted the amendment offered by Alderman Schneider. The motion of Alderman Shelley was then adopted by the following vote: Yeas Alderman Belvin, Fischer, Haynes, Kuhn, Maddox, Miller, Platt, Redd, Robandrow, Schneider, Shelley, Strumpf, Saylor, Townsend and Zilker 15 Nays Alderman Beaty, Nitschke and Powell. 3. Report of Special Com. on The Mayor laid before the Council the report of the Special Committee on Charter Amendments up for Charter Amendments. Action. Alderman Schneider moved that the report be read and acted upon, section by section, which motion prevailed. Alderman Townsend entered the Council Chamber. Section regarding boundaries The first section of the report, defining the boundaries of the City, was read. read Alderman Beaty moved to adopt that part of the Committee report. Alderman Schneider moved to amend the report by striking out all of the territory south of the Colorado River. Alderman Linn moved to table the amendment offered by Alderman Schneider, which motion prevailed by the following vote: Yeas Aldermen Beaty, Belvin, Fischer, Kuhns, Lawless, Linn, Maddox, Rob erts, Shelley, Taylor and Townsend 11. Nays Aldermen Haynes, Miller, Nitschke, Platt, Powell, Redd, Rosengren, Schneider, Stumpf and Zilker 10. Alderman Nitschke moved to amend the report by striking out "northeast corner of Block 14 in outlot the Division C" and inserting "the South line of outlot 3 Division C", so as to include in the City limits the bench water main laid on Manor road, which motion prevailed. Committees report adopted. The vote was then taken on the motion of Alderman Beaty to adopt the report of the Committee as amended, and the report was adopted by the following vote: Yeas Aldermen Beaty, Belvin, Fischer, Kuhns, Lawless, Maddox, Nitschke, Platt, Redd, Roberts, Schneider, Taylor and Zilker 15. Alderman Roberdeau moved to amend section 3 of the Charter, by making the number of Wards Seven, instead of Eleven. Alderman Redd moved to table the motion of Alderman Roberdeau. Lost by the following vote: Yeas Alderman Haynes, Kuhn, Linn, Miller, Nitschke, Powell, Redd, Schneider, and Townsend 9. Alderman Platt, moved to amend the motion of Alderman Roberdeau by making the number of Wards Eight, instead of Seven. The amendment was accepted by Alderman Roberdeau. Alderman Powell moved to amend by striking out the word "two" where it appears and insert the word "one" making it read "one Alderman from each Ward and four to be elected by the City at large." Alderman Belvin, moved to table the amendment. Lost by the following vote: Yeas Alderman Belvin, Linn, Platt, Rosengard, and Stumpf 5. Alderman Maddox moved to amend by striking out that part of the motion providing for the election of "four Aldermen to be elected by the City at large." Alderman Maddox moved to adopt the section as amended, and that the Committee make the changes as suggested by the Council. Carried. Secs. adopted as amended. The amendments to sections 9, 11, 14, 18 and 20 were read and adopted. Sections 9, 11, 14, 18 & 20 read & adopted. Sections 15 & 16 read Alderman Roberdeau moved to amend sections 15 and 16 of the Charter by inserting that the Aldermen serve without compensation. Alderman Nitschke moved to table the motion, which motion was lost by the following vote: Yeas Alderman Fischer, Haynes, Kuhn, Linn, Maddox, Nitschke, Platt, Powell, --- Page break --- Schneider and Townsend 10 Nays Aldermen Beaty, Belvin, Lawless, Miller, Redd, Robardeau, Rosengren, Shelley Stumpf, Taylor and Zilker 11. Nays Alderman Stumpf 1. The amendment to section 35 was then read. Alderman Maddox moved to amend by striking out "March" and inserting "January" which motion was lost. Alderman Linn was excused from further attendance at this session of the Council by the following vote: Yeas Aldermen Belvin, Fischer, Haynes, Kuhn, Lawless, Maddox, Miller, Platt, Powell, Redd, Robardeau, Rosengren, Shelley, Stumpf, Taylor, Townsend and Zilker 17. Alderman Powell moved to reconsider the vote by which the motion of Alderman Maddox to strike out "March" and insert "January" in the amendment to Section 35 was lost, which motion prevailed. Alderman Taylor moved to amend by striking out March and inserting February. Alderman Maddox accepted the amendment and the vote was then taken on the motion to strike out "March" and inserting February, and the motion was adopted. The section as amended was then adopted. The amendment to Section 40 was then read and adopted. The amendment to Section 41 was then read. Alderman Fischer moved to amend by striking out "and not to permit the valuation made by said board to be increased by the Court." Alderman Shelley moved as a substitute for the motion of Alderman Fischer and for the report of the Committee that that part of the Charter relating to appeals to the County Court be stricken out, which motion prevailed. Alderman Maddox moved that the Committee be directed to amend Section 41 so as to conform to the motion first adopted. Carried. Alderman Stumpf moved to amend the report of the Committee by making the term of office of the Board of Equalization one year instead of two, which motion prevailed by the following vote: Yeas Aldermen Beaty, Belvin, Fischer, Haynes, Kuhn, Lawless, Miller, Nitschke, Platt, Powell, Redd, Robardeau, Schneider, Shelley, Stumpf, Townsend, Zilker 19. Alderman Maddox moved to amend by inserting after the word "claims" the words "except State and County taxes," which motion prevailed. The section as amended was then adopted. The amendment to Sec. 56 was then read. Alderman Zilker offered the following amendment to section 56: That on the first Monday of December beginning with the year 1894, a City Assessor and Collector, City Marshal, City Clerk, City Attorney, City Treasurer and Street Superintendent, City Treasurer and City Recorder shall be voted for by the qualified voters of the City of Austin, and the returns of such election shall be made and be the same as is provided for in the election of Mayor and Aldermen, and the terms of the Officers shall be as provided for in section 11. Alderman Roberdraw moved to amend the amendment offered by Alderman Zilker by striking out the words "City Marshal" and "City Clerk". Lost by the following vote: Yeas Aldermen Kuhn, Maddox, Miller, Platt, Redd, Roberdraw, Shelley, Taylor and Townsend 9.
