Roll Called Present Aldermen Beaty, Haynes, Kuhn, Lawless, Sinn, Maddox, Miller, Nitsche, Platt, Powell, Redd, Roberdeau, Schneider, Shelley, Stumpf, Taylor, & Zilker, and Townsend. 19. Absent Aldermen Belvin, Fischer, Horton, Fessenger. The following call of the Council was then read: Mayor's Office, Austin, Texas, January 14, 1897. Called Meeting of the City Council A special meeting of the City Council is hereby called to meet in the Council Chamber at 8 o'clock p.m. this day, January 14, 1897, for the purpose of considering and acting upon the report of the special Committee on Charter Amendments. Austin, Texas: Jan. 14th, 1897. 6 p.m. Marshal's certificate of serving call. I hereby certify that the following named Aldermen have been served with the above call by having it read to each of them in person, viz: Aldermen Beaty, Belvin, Fischer, Haynes, Kuhn, Lawless, Sinn, Maddox, Miller, Nitsche, Platt, Powell, Redd, Roberdeau, Rosengren, Schneider, Shelley, Stumpf, Taylor, Townsend and Zilker, and that Alderman Horton was served by a true copy having been left at his place of business, he being out of the City. Alderman Fischer entered the Council Chamber. Special Committee report on Charter Amendments The Mayor laid before the Council the report of the special Committee on Charter Amendments. Reconsideration of vote adopting recommendation in regards to No. of wards. Alderman Platt moved to reconsider the vote adopted by the Council making the number of Aldermen eight instead of twelve, as recommended by the Committee. Alderman Townsend entered the Council Chamber. The motion of Alderman Platt, was adopted by the following vote: Yeas Aldermen Fischer, Haynes, Kuhn, Lawless, Sinn, Maddox, Miller, Nitsche, Platt, Powell, Redd, Schneider, Shelley, Stumpf, Townsend and Zilker 16 Nays Aldermen Beaty, Roberdeau and Taylor. 3. Reconsideration of vote on two Aldermen from each ward adopted. Alderman Platt then moved that the Board of Aldermen be composed of two Aldermen from each Ward; one of whom is to be elected each year. Alderman Maddox moved as a substitute that the recommendations of the Charter Amendment Committee be adopted, which motion prevailed, by the following vote: Yeas Aldermen Beaty, Fischer, Kuhn, Lawless, Maddox, Roberdeau, Shelley, Stumpf, Taylor and Zilker. 10. Nays Aldermen Haynes, Sinn, Nitsche, Platt, Powell, Redd, Schneider and Townsend. 8.
The vote on amendments of Aldermen Maddox & Roberdeau to the recommendations of the Charter Amendment Committee having been reconsidered, Alderman Maddox moved as a substitute for the recommendations of the Charter Amendment Committee, the following, which motion was adopted by a vote of 10 to 8. The recommendations of the Committee as amended were then adopted by a vote of 10 to 8, as follows, to-wit: Yeas Aldermen Beaty, Fischer, Kuhn, Lawless, Maddox, Roberdeau, Shelley, Stumpf, Taylor and Zilker. 10. Nays Aldermen Haynes, Sinn, Nitsche, Platt, Powell, Redd, Schneider and Townsend. 8.

Alderman Maddox moved to reconsider the vote fixing the number of No of Wards Wards eight instead of six, as recommended by the Committee, which motion was lost by the following vote: Yeas Aldermen Beaty, Fischer, Kuhn, Lawless, Maddox, Miller, Redd, Roberdeau, Shelley, Taylor and Zilker 11. Nays Aldermen Haynes, Linn, Nitschke, Platt, Powell, Schneider, Stumpf and Townsend 8. Alderman Maddox moved to adopt the report of the Committee as to Section 3 making the number of Wards six. Alderman Redd moved to amend by making the number of Wards eleven, which motion was lost by the following vote: Yeas Aldermen Haynes, Linn, Miller, Nitschke, Platt, Powell, Redd, Schneider and Townsend 9. Nays Aldermen Beaty, Fischer, Kuhn, Lawless, Maddox, Roberdeau, Shelley, Stumpf, Taylor and Zilker. 10. No of Wards amended Alderman Nitschke moved to amend by making the number of Wards six; three to be on the east and three on the west side of Congress Avenue. Alderman Linn offered as a substitute to the motion of Alderman Nitschke that the number of Wards be fixed at seven, and that South Austin be one of the seven, which motion prevailed by the following vote: Yeas Aldermen Beaty, Fischer, Haynes, Kuhn, Lawless, Linn, Maddox, Miller, Nitschke, Platt, Powell, Redd, Roberdeau, Schneider, Shelley, Stumpf, Townsend and Zilker. 18 Nays Alderman Taylor 1. Com's report as to Sec. 3 adopted. On motion of Alderman Nitschke the report of the committee as to section 3, as amended, was then adopted. Vote reconsidered adopting Sections 4, 5, 6, 7 & 8. Alderman Nitschke then moved to reconsider the vote adopting the report of the Committee as to sections 4, 5, 6, 7 and 8 which motion prevailed. Alderman Nitschke then moved to amend the report of the Committee by making it read, one Alderman from each of the Wards of the City, and five Aldermen from the City at large. One Alderman from each Ward & five to be elected at large Alderman Linn moved as a substitute for the motion of Alderman Nitschke that there be elected one Alderman from each Ward and five at large, the ones receiving the highest vote to be declared elected. Carried by the following vote: Yeas Aldermen Beaty, Fischer, Haynes, Lawless, Linn, Miller, Nitschke, Platt, Powell, Redd, Taylor, Townsend and Zilker 13. Nays Aldermen Kuhn, Maddox, Roberdeau, Schneider, Shelley and Stumpf 6. Alderman Nitschke moved to adopt the section as amended, which motion prevailed by the following vote: Yeas Aldermen Beaty, Fischer, Haynes, Kuhn, Lawless, Linn, Miller, Nitschke, Platt, Powell, Redd, Taylor, Townsend and Zilker 14. Nays Aldermen Maddox, Roberdeau, Schneider, Shelley and Stumpf, 5. Amendment to Sections 5, 6, 7, & 8. Alderman Haynes offered the following, amendment to the report of the Committee: That Sec. 5, be amended so as to read as follows: That the registration required by the City Charter, be and is hereby suspended and that all persons who are legal voters, in said City's election precincts, may vote, on an affidavit to be filed with the judges, reciting said voter's residence, in said precinct, and if required, to take an oath, as to his qualifications, prescribed and directed in and by the Constitution and laws of this State.

Amendment to Sec. 57 Art 13. of prostitution or assignation, and keepers and inmates thereof, and to provide a system of inspection thereof for the preservation of the public health. Alderman Taylor moved to lay the amendment on the table. Lost by the following vote: Yeas Aldermen Fischer and Taylor. 2. Nays Aldermen Beaty, Haynes, Huhn, Lawless, Linn, Maddox, Miller, Kitschue, Platt, Powell, Redd, Roberdeau, Schneider, Shelley, Stumpf, Town- send and Zilker. 17. Amendment to Sec. 57, Art 13 adopted Alderman Kitschner moved to adopt the amendment of Alderman Haynes which motion prevailed by the following vote: Yeas Aldermen Haynes, Lawless, Linn, Maddox, Miller, Kitschue, Platt, Powell, Redd, Schneider, Shelley, Stumpf, Townsend and Zilker. 14. Nays Aldermen Beaty, Fischer, Huhn, Roberdeau and Taylor. 5. Amendment to Sec. 56 that all Alderman Zilker offered as an amendment proposed Charter Officers be elected by a by the committee to Section 56, the following: That the Charter Officers of the vote of the People. City be elected by a vote of the people. Alderman Roberdeau moved to amend by excepting the City Marshal and City Clerk. Alderman Lawless moved to amend the amendment of Alderman Roberdeau by adding "and the City Attorney". Alderman Beaty moved to lay the amendment on the table. Lost by the following vote: Yeas Aldermen Beaty, Fischer, Linn, Miller, Roberdeau, and Townsend 6. Nays Aldermen Haynes, Huhn, Lawless, Maddox, Kitschue, Platt, Powell, Redd, Schneider, Shelley, Stumpf, Taylor and Zilker 13. Alderman Taylor moved to adjourn. Lost by the following vote: Yeas Aldermen Beaty, Fischer, Kitschue, Roberdeau, Taylor & Townsend 6. Nays Aldermen Haynes, Huhn, Lawless, Linn, Maddox, Miller, Platt, Powell, Redd, Schneider, Shelley, Stumpf, and Zilker 13. Alderman Maddox moved the previous question on all the amendments, which was seconded. The vote was first taken on the amendment of Alderman Lawless, to except the City Attorney, and the same was lost by the following vote: Yeas Aldermen Lawless, Linn, Maddox, Platt, Shelley and Townsend. 6. Nays Aldermen Beaty, Fischer, Haynes, Huhn, Miller, Kitschue, Powell, Redd, Roberdeau, Schneider, Stumpf, Taylor, and Zilker. 13. The vote was then taken on Alderman Roberdeau's motion to except the City Marshal and City Clerk, and the same was lost by the following vote: Yeas Aldermen Linn, Maddox, Miller, Platt, Redd, Roberdeau, Shelley, Taylor and Townsend. 9. Nays Aldermen Beaty, Fischer, Haynes, Huhn, Lawless, Kitschue, Powell, Schneider, Stumpf, and Zilker. 10. Amendment to Sec. 58 as to Salary of Mayor Shelley, Saylor and Downsend. 10. Alderman Haynes offered the following amendment to the report of the Committee: Section 58 should be amended so as to allow the Mayor a salary of $1000.00 per annum and that he shall receive no other fees. Alderman Saylor moved to table the amendment, which motion prevailed by the following vote: Yeas Aldermen Fischer, Kuhn, Lawless, Linn, Miller, Redd, Roberdeau, Schneider, Saylor and Downsend. 10 Nays Aldermen Beaty, Haynes, Maddox, Nitschke, Platt, Powell, Shelley, Stumph and Zilker. 9.
Reconsideration of Vote taken on Sec. 2. Memorial from Citizens from South Austin. Presented. Alderman Linn moved to reconsider the vote by which the report of the committee on section 2 was adopted. Carried. Alderman Linn then presented a memorial from the Citizens of South Austin asking that they be left out of the limits. Alderman Linn moved that the memorial be received and filed, and that the recommendations of the Committee as to the boundaries be adopted.
Colorado River South bound- ary line of City. Alderman Redd offered as a substitute that the north bank of the Colorado River be the south boundary line of the City. The substitute of Alderman Redd was adopted by the following vote: Yeas Aldermen Haynes, Miller, Nitschke, Platt, Powell, Redd, Schneider Saylor, Downsend and Zilker. 10. Nays Aldermen Beaty, Fischer, Kuhn, Lawless, Linn, Maddox, Roberdeau, Shelley and Stumph. 9.
Sec. 2 adopted as amended. Alderman Redd moved the adoption of Section 2 as amended. Carried by the following vote: Yeas Aldermen Haynes, Kuhn, Miller, Nitschke, Platt, Powell, Redd, Schneider, Saylor and Zilker. 10. Nays Aldermen Beaty, Fischer, Lawless, Linn, Maddox, Roberdeau, Shelley, Stumph and Downsend. 9. Alderman Saylor moved that the Special Committee be directed to conform with the amendments adopted by the Council, which motion was lost by the following vote: Yeas Aldermen Haynes, Kuhn, Miller, Nitschke, Redd, Taylor & Zilker. 7. Nays Aldermen Beaty, Fischer, Lawless, Linn, Maddox, Platt, Powell, Roberdeau, Schneider, Shelley, Stumph and Downsend. 13. Alderman Nitschke moved to table the report of the special committee on Charter Amendments. Lost by the following vote: Yeas Aldermen Linn, Nitschke, Platt, Powell, Schneider and Stumph. 6. Alderman Roberdeau moved that the Council adjourn until 8 o'clock P.M., Friday, January, 15, 1897. which motion prevailed by the following vote: Yeas Aldermen Beaty, Fischer, Lawless, Linn, Miller, Nitschke, Roberdeau, Stumph, Downsend, and Zilker. 10. Absent, Aldermen Belvin, Fischer, Horton, Lawless, Miller, Redd, Shelley, Townsend and Zilker 10. Alderman Maddox moved that Alderman Shelley be excused which motion prevailed. Stitscher moved a call of the Council, which was ordered. Roll Called. Present, Aldermen Beaty, Haynes, Huhn, Linn, Maddox, Stitscher, Platt, Powell, Roberdeau, Rosengren, Schneider and Stumpf 12. Absent, Belvin, Fischer, Horton, Lawless, Miller, Redd, Taylor, Townsend and Zilker 9. Absent & Excused, Alderman Shelley 1. Aldermen Belvin, Miller, Redd and Taylor entered the Chamber and answered to their names. Alderman Platt moved to suspend the call, which motion prevailed. The Mayor then laid before the Council the report of the special Committe on Charter Amendments. The amendment to section 70 was then read and adopted. Section 71 was read and adopted by the following vote: Yeas, Aldermen Beaty, Belvin, Huhn, Linn, Maddox, Miller, Platt, Redd, Roberdeau, Rosengren, Schneider and Taylor 12. Nays, Aldermen Haynes, Stitscher, Powell and Stumpf 4. Alderman Linn moved that the report of the special Committee be laid upon the table. Alderman Maddox moved a call of the Council, which was ordered. Alderman Taylor moved to adjourn. Lost by the following vote: Yeas, Aldermen Beaty, Belvin, Maddox, Rosengren, Stumpf and Taylor 6. Nays, Aldermen Haynes, Huhn, Linn, Miller, Stitscher, Platt, Powell, Redd, Roberdeau and Schneider 10. The vote was then taken on the motion of Alderman Linn to table the report of the Committee. Lost by the following vote: Yeas, Aldermen Haynes, Huhn, Linn, Stitscher, Platt, Powell, Rosengren and Schneider 8. Alderman Powell moved to strike out the amendments to section 71. Alderman Redd moved, to lay the said amendments on the table. The vote was then taken on the amendment of Alderman Powell, which was lost by the following vote: Yeas, Aldermen Fischer, Haynes, Kuhn, Linn, Nitschke, Powell, Roberdeau and Schneider 8 Nays, Aldermen Beaty, Belvin, Maddox, Miller, Platt, Redd, Rosengran Stumpf and Taylor. 9. Alderman Redd moved to adopt the report of the Committee as amended on boundaries. Alderman Maddox offered as a substitute for the motion of Alderman Redd That the report of the special committee on Charter Amendments as originally presented be adopted. Alderman Belvin moved that further consideration of the special committee's report be indefinitely postponed, which motion prevailed by the following vote: Yeas, Aldermen Belvin, Fischer, Haynes, Kuhn, Linn, Maddox, Nitschke, Platt, Powell, Roberdeau, Schneider and Stumpf 12. Nays, Aldermen Beaty, Miller, Redd, Rosengran and Taylor. 5. Alderman Linn moved to reconsider the vote just taken and to lay that motion on the table. Alderman Taylor moved that a committee of four Aldermen and four Citizens be appointed by the Mayor, who shall be authorized to propose certain amendments to the City Charter, and to present them to the State Legislature now in session. Alderman Linn moved to table the resolution of Alderman Taylor, which motion prevailed by the following vote: Yeas, Aldermen Belvin, Fischer, Haynes, Kuhn, Linn, Miller, Nitschke, Platt, Powell, Schneider and Stumpf. 11.
