661. Minutes of a Regular Meeting of the City Council. Cultin, Texas, August, 2nd 1897. Hon. Lewis Hancock, Mayor, presiding. Fire called. Present Aldermen: Falvin, Haynes, Maddon, Kitchner, Platt, Powell, Robordeaux, Schneider, Shelley, Stumble, Saylor and Townsend. 12. Absent Aldermen Doty, Fischer, Horton, Kuhn, Lawless, Linn, Miller, Redd Pennington and Filbert. 10. Minutes adopted as - On motion of Alderman Platt, the minutes of the last meeting were recorded approved without reading. Aldermen Fischer and Horton entered the Council Chamber. Petitions Etc. Pet. of C.J. Wilhelmin to- By Alderman Horton Petition of C.J. Wilhelms for permission to erect a public erect Wagon Scales on Canal. Wagon Scales on Canal, near Twelfth Street. On motion the petition was granted. Pet. of J.B. Daily for damages By Alderman Saylor. Petition of J.B. Bailey, asking damages to horse and buggy, caused to horse & buggy by falling through bridge near Paggi's store. Read and referred to the Committee on Claims and Accounts. Reports of Standing Committees Finance Com's report on Alderman Townsend for the Finance Committee to whom was referred the City Auditor's recommendation report of the City Auditor for the quarter ending February 28th 1894, presented regarding certain Debits & Credits their report, recommending that the Debits and Credits recommended therein Debtors & Creditors Acts. in be made. The report was adopted. Claims & Accts Com's report on Alderman Platt, for the Committee on Claims and Accounts, to whom was pet. of Dr. T.D. Woolsey asking referred the petition of Dr. T.D. Woolsey, asking reduction of assessment for reduction in his assessments made by the Board of Equalization for the year 1896, on Credits, Notes etc made by Bd. of Equalization from $1000. to $4000., presented their report, stating that they had no authority to change the assessment as fixed by the Board, and recommending that the petition be not granted. Alderman Kulm moved the adoption of the report of the Committee. Alderman Maddox moved as a substitute that the petition be granted. Aldermen Beaty, Sanders and Rosenstein entered the Council Chamber. Alderman Deford made the point of Order, that the Council had no legal authority to act in the matter. The Mayor ruled that the point of order was not well taken. Dr. Woolsey's petition granted. Street Comis report on pet. of Alderman 2 [illegible], for the Street Committee, to whom was referred the petition Mrs Matschne of Mrs Matschne, for permission to erect a building in the Alley in Block No 155, presented their report, recommending that the petition be not granted. The report of the Committee was adopted. Street Comis report on pet. Alderman 2 [illegible], for the Street Committee, to whom was referred the petiof Citizens of Clarksville tion of Citizens of Clarksville, asking that certain street work be done, presented their report recommending that the petition by not granted. Alderman Blatt, moved the adoption of the report of the Committee. Alderman Maddox moved as a substitute that the petition be granted. The substitute was lost and the report of the Committee was adopted. City Engineers report on City Engineer McFall who was, by resolution adopted at the last meeting wooden stairway on Smith of the Council, directed to investigate and report upon the matter of a wooden Opera House stairway, which had been erected in the building known as the Smith Opera House, presented a report stating, that permission had been granted to erect an iron stairway, but that it was stated by the Contractor that it was their intention to apply for permission to erect a wooden stairway, and that it was not the intention to erect an iron stairway. Alderman Taylor offered the following resolution: Resolution directing City Resolved, That the City Marshal be, and he is hereby directed to see that the Marshal to enforce Ord. City Ordinance is complied with in the matter of the erection of exterior steps in regard to all structures in the Alley leading to the upper story of the J.C. Mitchell building. within Fire Limits Alderman Skump offered the following amendment to the resolution: Strike out after the words "complied with" and insert "in regard to all structures within the Fire limits" The amendment was adopted by the following vote: Yeas, Aldermen Delvin, Haynes, Norton, Kuhn, Maddox, Miller, Kitschne, Blatt, Schneider, Skump, and Zilker 11. Nays, Aldermen Beaty, Fischer, Lawless, Powell, Redd, Robendrau, Rosengren, Shelley, Taylor and Townsend 10. The resolution as amended was then adopted. City Engineers report on The report of the City Engineer as to the cost of extending the Dam boulevard cost of extending Dam Boule- through the land of William Walsh was made, and on motion was ordered filed. vard The Mayor laid before the Council a communication from N.S. By Alderman Beaty, communication from Phil Gosche, asking permission to Bosche asking permission fasten guy wires to smokestacks of Laundry, to City buildings. Apprng $355.00 to pay Salary of Drivers of Sanitary Department By Alderman Stumpf, An Ordinance appropriating the sum of $355.00 to pay Salaries of Drivers of Sanitary department The ordinance was read first, second and third times under suspension of the rules by the following vote: Yeas, Aldermen Beaty, Belvin, Fischer, Haynes, Horton, Kuhn, Lawless, Maddox, Miller, Nitschke, Platt, Powell, Redd, Robertdeau, Rosengren, Schneider, Shelley, Stumpf, Taylor, Townsend and Zilker. 21 Nays None Alderman Maddox moved to amend this ordinance by adding after the words "Sanitary department" the following: "Up to and including September 30, 1897." The amendment was adopted by the following vote: Yeas, Aldermen Beaty, Belvin, Fischer, Haynes, Horton, Kuhn, Lawless, Maddox, Miller, Nitschke, Platt, Powell, Redd, Robertdeau, Rosengren, Schneider, Shelley, Stumpf, Taylor, Townsend and Zilker 21. Nays None. Ord. apprng $80.00 to pay Drivers of Street Teams By Alderman Zilker. An Ordinance appropriating the sum of $80.00 to pay Drivers of Street Teams for the month of August 1897. The ordinance was passed under suspension of the rules by the following vote: Yeas, Aldermen Beaty, Belvin, Fischer, Haynes, Horton, Kuhn, Lawless, Maddox, Miller, Nitschke, Platt, Powell, Redd, Robertdeau, Rosengren, Schneider, Shelley, Stumpf, Taylor, Townsend and Zilker 21. Nays None. Ord. authorizing redemption of Real Estate sold for Taxes and bid in by City of Austin. By Alderman Shelley. An Ordinance authorizing the redemption of Real Estate heretofore sold for Taxes and bid in by the City of Austin. The ordinance was passed under suspension of the rules by the following vote: Yeas, Aldermen Beaty, Belvin, Fischer, Haynes, Horton, Kuhn, Lawless, Maddox, Miller, Nitschke, Platt, Powell, Redd, Robertdeau, Rosengren, Schneider, Shelley, Stumpf, Taylor, Townsend and Zilker 21. Nays None. Ord. declaring keeping of Hogs a misdemeanor within city limits of the City By Alderman Robertdeau. An Ordinance declaring the keeping of Hogs in a misdemeanor within certain limits of the City of Austin a misdemeanor, and providing a penalty therefor. The ordinance was read first time, and on motion of Alderman Taylor was referred to the Sanitary Committee. Resolution directing C. W. of Streets to grade & gravel Mary St. By Alderman Redd. Resolution directing the C. W. of Streets to grade and gravel Mary Street from Congress Avenue, Nueve Blvd., and put it in a passable condition. That and on motion was referred to the Street Committee.
