Austin's 1898 Railroad Debate and City Finances

Railroad Track Controversy: First Ward citizens petitioned against granting railroad right-of-way on city streets. The council tabled the ordinance for companies including Lone Star Ice Company and Austin Gas Light and Coal Company, with 11 voting to delay and 8 opposing.

Tax Relief and Financial Management: The council approved an ordinance allowing Mrs. S.L. Pease a $1,158.92 tax credit for illegally collected 1891 taxes, but postponed final action pending a review of other similarly affected taxpayers.

Public Parks Regulation: Council passed a new ordinance to regulate public parks and enclosed grounds, including penalties for violations. An amendment specifically prohibited grazing animals in parks without permission.

City Treasury Report: Monthly collections totaled $7,804.85 from various sources including property taxes and fines, with the city maintaining sinking funds of approximately $19,877.85 for water and light bond redemption.

Community Invitation: Council unanimously invited the Sons of Hermann lodge to hold their 1899 annual meeting in Austin.

Minutes of a Regular Meeting of the City Council. Austin, Texas, May 02, 1898. Hon. Jno. D. McCall, Mayor, presiding. Roll Called. Present. Aldermen Shelley, Stumpf, Taylor, Kuhn, Maddox, Mc:Lemore, Morris, Blatt, Powell, Rosengren, Townsend and Zilker 12. Absent. Aldermen Brady, Belvin, Crooker, Fischer, Haynie, Horton, Miller, Nitschke, Read and Roberdeau 10. On motion of Alderman Blatt, the Council took a recess of ten minutes. At the end of the recess the Council was called to order. Aldermen Brooker and Maddox, entered the Council Chamber. Minutes On motion of Alderman Saylor, the minutes of the last meeting were approved adopted. as recorded without reading. Aldermen Belvin, Haynie, and Roberdeau entered the Council Chamber. Petitions, etc. Pet. of O. H. The Mayor laid before the Council a petition of O. H. Yarrington, asking a Yarrington reduction in his Assessments for taxes for 1897. On motion the petition was referred to the Claims and Accounts Committee. Aldermen Read and Miller entered the Council Chamber. Pet. of Citizens By Alderman Morris: Petition of Citizens of the First Ward protesting of 1st Ward against the granting of right-of-way to lay a Railroad track on certain Streets against R. R. track of the City. On motion of Alderman Saylor, the petition was laid over to come up with the Ordinance on the subject. On motion, Alderman Rosengren was excused from further attendance at this Session of the Council. Pet. of P. B. Russell The Mayor laid before the Council, a petition of P. B. Russell, asking for damfor damages to ages to horse and wagon caused by falling through a bridge on East Sixth Street. Horse & Wagon On motion, the petition was referred to the Claims and Accounts Committee. Pet. of H. Mc: The Mayor then laid before the Council a petition from H. Mc: Zilvary asking permissio Zilvary. to erect two small frame buildings on Block 58, to be used in connection with a Sanitarium. On motion the petition was granted. Pet. of G. M. Brass By Alderman Blatt: Petition of G. M. Brass asking that the Alleys in Blocks 37 + 38 to open Alleys in of the City, be opened. Alderman Zilker moved that the petition be laid on the table. Lost Blks 37 + 38 Alderman Maddox, moved to refer the petition to the Street Committee, which motion prevailed. Alderman Brady entered the Council Chamber. Reports of Standing Committees. Claims & Accts Comtee Alderman Blatt for the Claims and Accounts Committee, to whom was referred repts on pet of J.F. the petition of J.F. Boswell asking to be refunded certain Pound fees, presented - Boswell a report stating that the charges were not excessive, and recommended that the petition be not granted. The report of the Committee was adopted. L & L Com's rept. Alderman Blatt for the Claims and Accounts Committee, to whom was referred the on pet. of Morris Givens petition of Morris Givens, asking reduction of Assessment for taxes, presented a report recommending that the petition be not granted. The report of the Committee was adopted. Printing Com's rept. Alderman Mc Elmore for the Printing Committee, called up the report made the on award of contract Printing Committee on the 17th of January 1898. awarding the contract for Job Printing for Job Printing to the Eugene von Boeckmann Publishing Company, and moved the adoption of that report, and that the Mayor be authorized to enter into contract with said Company for doing Job-printing in accordance with their bid, which motion prevailed. Unfinished Business. Ord. granting Lone The Mayor laid before the Council, an ordinance, granting to the Lone Star Ice Star Ice Co. et. al. Company, the Austin Gas Light and Coal Company and Seligman & Co. authorpermission to lay ity to build, maintain and operate a Railroad over certain streets of the City. R.R. tracks Alderman Zilker moved that the ordinance be laid on the table, which motion prevailed by the following vote: Yeas, Aldermen Calvin, Maddox, Miller, Morris, Nitschke, Blatt, Powell, Roberdeau, Shelley, Townsen and Zilker. 11. Nays. Aldermen Beaty, Crooker, Haynes, Kuhn, Mc Elmore, Read, Stumpf and Taylor. 8. On motion of Alderman Shelley, the City Attorney was excused from further attendance at this session of the Council. Ord. authorizing redemption The Mayor then laid before the Council, an ordinance authorizing the redemption of certain property of Real Estate heretofore sold for taxes, under judgment of the District Court, sold for taxes. and bid in by the City. The ordinance was read second time, and on motion, the rule was suspended and the ordinance, placed upon its third reading, and final passage by the following vote: --- Page break --- 4 Aays Aldermen Beaty, Belvin, Brooker, Hayne, Kuhn, Maddox, Mc Lemore, Miller, Morris, Nitschke, Platt, Powell, Redd, Roberdeau, Shelley, Stumpf, Townsend and Zilker 19. Nays, None. The Ordinance was then read third time and passed. Bid for W & L Bonds for Sinking Fund The Mayor laid before the Council, a proposition from S. A. Coquard of St Louis Mo. offering to sell the City, $10,000.00 Water and Light Bonds of the City, at par and interest delivered in Austin, the City to pay expenses of charges and exchange. Alderman Taylor moved that the Mayor be authorized to purchase for the Sinking Fund $10,000.00 Water and Light Bonds, at par and interest delivered in Austin. Alderman Morris moved to table the motion of Alderman Taylor, which motion prevailed by the following vote: Aays Aldermen Belvin, Hayne, Kuhn, Mc Lemore, Morris, Nitschke, Powell, Roberdeau, Shelley, Stumpf, Townsend and Zilker 12. Nays Aldermen Beaty, Brooker, Maddox, Miller, Platt, Redd and Taylor 7. Alderman Maddox moved that all money in the City Treasury belonging to the interest and Sinking Fund Water and Light Bonds, be turned over to the Water and Light Commission for the completion of the plant. Not voted on. Ord to allow Mrs. S. L. Pease credit on Taxes for 1891 Alderman Platt called up an ordinance directing the City Assessor and Collector to allow Mrs. S. L. Pease, a credit of $1158.92 on the taxes due by her to the City of Austin for the year 1891. The amount thus allowed being taxes illegally collected from her for that year. The ordinance was read second time. Alderman Platt moved to suspend the rules and place the ordinance on its third reading and final passage. Alderman Brooker moved that further consideration be postponed until the next regular meeting, and that the Assessor and Collector be directed to furnish a list of all other tax payers similarly situated, and the amount paid by each, which motion prevailed. Res inviting Sons of Hermann to meet in Austin in 1899. By Alderman Zilker. Resolution, inviting the grand Lodge of the Sons of Hermann, of Fort Worth, to hold their next Annual meeting in this City, and that the City Clerk, be directed to forward at once, a copy of this resolution to the grand Lodge now in session. The resolution was unanimously adopted. Ord approptg to Ko complete Culvert on post of W. 1st. St. By Alderman Powell. An ordinance appropriating the sum of $40. for the purpose of completing a Culvert on West First Street. The ordinance was passed under suspension of the rules by the following vote: Aays Aldermen Beaty, Belvin, Brooker, Hayne, Kuhn, Maddox, Mc Lemore, Miller, Morris, Nitschke, Platt, Powell, Redd, Roberdeau, Shelley, Stumpf, Taylor, Townsend and Zilker 19. Nays None. Ord. Amending Art. 171 Title 5 Chap. 4. of Rev Civ Ord. By Alderman Morris. An ordinance amending Article 171, Title 5 Chapter 4, of the Revised Civil Ordinances of the City. Alderman Platt moved that the ordinance be laid on the table. Lost by the following vote: Aays Aldermen Beaty, Brooker, Mc Lemore, Platt, Redd, Roberdeau, Stumpf and Zilker 8. Nays Aldermen Belvin, Hayne, Kuhn, Maddox, Miller, Morris, Nitschke, Powell, Shelley, Taylor and Townsend 11. Alderman Belvin moved to refer the ordinance to the ordinance Committee, which motion prevailed. By Alderman Shelley. The ordinance was read first time, and on motion, the rule was suspended and the ordinance placed on its second reading by the following vote: Ayes, Aldermen Beaty, Belvin, Brooker, Hughes, Huhn, Maddox, Mc Lemore, Miller, Morris, Kitscher, Platt, Powell, Redd, Roberdeau, Shelley, Taylor, Townsend and Zilker 18. Nays, Alderman Stumpf 1. The ordinance was read a second time. Alderman Brooker moved to adjourn. Lost. Alderman Maddox offered the following amendment to the ordinance: Ord. Amendment Amend by striking out the words "or by placing animals therein to graze" without No 1 permission from the person in charge thereof. The amendment was adopted, and the ordinance as amended, was then passed under suspension of the rule by the following vote: Ayes, Aldermen Beaty, Belvin, Brooker, Hughes, Huhn, Maddox, Mc Lemore, Miller, Morris, Kitscher, Platt, Powell, Redd, Roberdeau, Shelley, Taylor, Townsend and Zilker 18.
