Minutes of a Regular Meeting of the City Council. Austin, Texas, June 20, 1898.
Hon. Jno. D. Mc. Call, Mayor, presiding. Roll Called. Present, Aldermen: Booner, Staynes, Horton, Maddox, Mc. Lemore, Morris, Blatt, Powell, Rosengran, Shelley, Stumpt, Saylor, and Downsend 13. Absent, Aldermen: Beaty, Belvin, Fischer, Kuehn, Miller, Nitschke, Bredd, Roberdeau and Zilker 9. Minutes approved. On motion, the minutes were approved as recorded, without reading. On motion, Alderman Morris was excused from further attendance at this session of the Council. Alderman Beaty entered the Council Chamber. Petitions, etc. Pet. of Scott Wear By Alderman Blatt. Petition of Scott Wear to erect shed, etc. on lot #1 Block 7, within the fire limits. Read and referred to the Fire Commissioners. Pet. of E. A. Eyles. By Alderman Staynes. Petition of E. A. Ellis asking for a franchise for a Street Rail Road. Read and laid over to come up with the ordinance on the subject. Alderman Nitschke entered the Council Chamber. Pet. of Citizens for boom By Alderman Maddox. Petition of Citizens requesting the City to erect a across mouth Bull Creek. boom across the mouth of Bull Creek. Read and referred to the Water Commission and the City Attorney. Aldermen Belvin, Zilker and Bredd entered the Council Chamber. Reports of Standing Committees. Police Com’ts report on Alderman Powell for the Police Committee, to whom was referred the Marshals rept for May reports of the City Marshal for the month of May 1898, presented a report stating that the reports had been examined and found correct. On motion, the report was received and ordered filed. Ord. Com’ts report on Ord. Alderman Shelley, for the ordinance Committee, to whom was referred an to amend Article 147, Chapter 4, Ordinance amending Article 147, Chapter 4, Title 5 of the Revised Civil Title 5 of Rev. Civ. Ord. Ordinances of the City, presented a report recommending the passage of the ordinance with amendment. The report was laid over to come up with the ordinance. Claims & Accts Com’ts rept on Alderman Blatt for the Claims and Accounts Committee, to whom was referred pet. of P. B. Russell the petition of P. B. Russell for damages, presented a report recommending that the petitioner be allowed the sum of $10.00 as damages. The report of the Committee was adopted by the following vote: Yeas: Aldermen Beaty, Booner, Bredd, Rosengran, Horton, Kuehn, Maddox, Mc. Lemore, Nitschke, Blatt, Powell, Saylor, Shelley, Stumpt and Zilker 15. Nays: Aldermen Belvin, Fischer, Staynes and Downsend 4. Print. Com’ts recommend Alderman Mc Lemore for the Printing Committee, moved that the City Clerk be printing Of’s reports. directed to have 750 copies of the Annual reports of the Mayor and City Officers for 1897, printed. Lost. Alderman Miller entered the Council Chamber. Alderman Maddox moved to reconsider the vote by which the resolution to have 750 copies of the Annual reports of the City Officers for 1897, printed, was lost, which motion was carried. But upon being put now on the adoption of the resolution, and the resolution

lost by the following vote: Yeas. Aldermen Staynes, Maddox, McLenmore, Blatt, Bowell, Rosengran, Shelley, Stumpf and Townsend 9. Nays. Aldermen Beatty, Belvin, Crooker, Fischer, Horton, Kuhn, Miller, Nitscheer, Preah, Saylor and Zilker 11. Unfinished Business. Ord. Approp. $87.70 to The Mayor laid before the Council, an ordinance appropriating the sum of $87.70 to build bridges on W. 2nd & 5th Sts. build bridges on West 2nd & 5th Streets. The ordinance was read third time, and placed on its final passage, and was lost by the following vote: Yeas. Alderman Beatty, Belvin, Crooker, Kuhn, McLenmore, Bowell, Rosengran, Townsend and Zilker 9. Nays. Aldermen Staynes, Haynes, Horton, Maddox, Miller, Nitscher, Blatt, Bradd and Saylor 11. Ord. to amend Ord. Vol. The Mayor then laid before the Council, an ordinance amending Article 14, Title I. Tit. 5. Chapt. 11. of the Revised Civil Ordinances of the City. Ord. The ordinance was read the second time. Alderman Shelley moved to amend Section 2, by striking out June 30th and inserting July 31st, which motion prevailed. On motion the rules was suspended, and the ordinance as amended, placed upon its third reading and final passage by the following vote: Yeas. Aldermen Beatty, Belvin, Crooker, Fischer, Haynes, Horton, Kuhn, McLenmore, Miller, Nitscher, Blatt, Bowell, Bradd, Rosengran, Shelley, Stumpf, Saylor, Townsend and Zilker 19. Nays. Alderman Maddox 1. The ordinance was read a third time and passed by the following vote: Yeas. Aldermen Beatty, Belvin, Crooker, Fischer, Haynes, Horton, Kuhn, Maddox, McLenmore, Miller, Nitscher, Blatt, Bowell, Bradd, Rosengran, Shelley, Stumpf, Saylor, Townsend and Zilker 20. Nays. None. Bill from W&S Comm. The Bill of the W. & S. Commission for Water and Light furnished the City, for W. & L. furnished. was referred to the Water & Light Committee. New Business. Ord. to Amend Sec.3 By Alderman Shelley, An ordinance to amend Section 3, of an ordinance regulating duties of passed and approved July 16th 1894, entitled "An Ordinance to regulate Bd. of Equalization. the powers, band, and duties of the Board of Equalization, to fix their number and compensation, and to consolidate into one ordinance, the ordinances now existing, on the subject of the Board of Equalization, and to repeal the same." The ordinance was passed under suspension of the rules, by the following vote: Yeas. Aldermen Beatty, Belvin, Crooker, Fischer, Haynes, Horton, Kuhn, Maddox, McLenmore, Miller, Nitscher, Blatt, Bowell, Bradd, Rosengran, Shelley, Stumpf, Saylor, Townsend and Zilker 20. Nays. None. Ord. granting r. of w. to By Alderman Haynes, An ordinance granting the right of way over the E. A. Ellis & assocs. r. of w. to build a St. R. R. streets of the City, to E. A. Ellis, and his associate to build a Street Railroad. Ord. Alderman Haynes moved that the ordinance be referred to a special Committee of 5. including the Mayor and City Attorney, which motion prevailed. Gen. Ord to put S. A. bridge By Alderman Miller Petition of Citizens of South Austin, asking that the in repair. bridge east of, and adjoining the residence of Mr. Browning be put in repair. Alderman Taylor moved to refer the petition to the Street Committee. Alderman Maddox moved that the Citizens of the South side present, and informCol. W.H. Wilson addressing ing the petitioners, be allowed to address the Council which motion prevailed Council in behalf of Petn. Col. W.H. Wilson then addressed the Council, speaking in behalf of the petitioners. Alderman Miller moved as a substitute for the motion of Alderman Taylor, to refer, that the petition be granted, which motion prevailed. Ord. Approp'g $27.312.50 to By Alderman Shelley An ordinance appropriating the sum of $27,312.50 to pay Int. due July 1st 1898 to pay interest due July 1st 1898 on the Water & Light bonds of the City of Austin. on W. & L. Bonds. The ordinance was passed, under suspension of the rules, by the following vote: Yeas. Aldermen Beaty, Belvin, Booker, Crooker, Fischer, Haynes, Horton, Huhn, Maddox, McLemore, Miller, Nitschke, Powell, Redd, Rosengren, Shelley, Stumpff, Taylor, Townsend and Zilker 19. Nays. Alderman Platt 1. Reconsideration of Vote Alderman Maddox moved to reconsider the vote whereby the Council refused whereby Council refused to pass the ordinance appropriating the sum of $1770.00 to build bridges on West to pass App'n to build 3rd and 5th Streets, which motion prevailed by the following vote. bridges. Aldermen Haynes, Horton, Nitschke, Platt, Shelley, Stumpff and Taylor. 7. Ord. Approp'g $1575.00 to By Alderman Shelley An ordinance appropriating the sum of $1575.00 to pay pay Interest due July 1st 1898, on interest due July 1st 1898, on bonds issued prior to May 1st 1890. Old Bonds. The ordinance was read first time and a motion made to suspend the rules and pass the ordinance on its second reading, was lost by the following vote: Yeas. Aldermen Booker, Haynes, Nitschke, Powell, Rosengren, Shelley, Taylor, Townsend and Zilker 9. Nays. Aldermen Beaty, Belvin, Crooker, Horton, Huhn, Maddox, McLemore, Miller, Platt, Redd and Stumpff 11. Alderman Haynes offered the following resolution. Resolution as to Austin Whereas, the Austin Rapid Transit & Railway Company, regardless of public R.T. & Ry. Co. & its comfort, are now and from time to time running their Street (or Cemetery noise. line) one or more cars that are a nuisance to the traveling public, and to the residents in said line and dangerous to pedestrians by reason of the terrific noise made by said cars, and in direct opposition to the honor of

16 their Charter, which requires them to operate their cars "by noiseless and safe motors" Therefore be it resolved, by the City Council of the City of Austin, that the Mayor call the attention of the Officers of said road to the requirements of said section, and to notify them, that they must comply with the spirit of the same. Alderman Fischer moved to refer the Resolution to the City Engineer, which motion prevailed. Alderman Haynes moved to reconsider the vote by which the resolution was referred to the City Engineer, which motion prevailed and the resolution was adopted by the following vote: Yeas. Aldermen Grasty, Belvin, Groover, Fischer, Haynes, Horton, Hohm, McLemore, Nitschke, Blatt, Read, Shelley, Saylor and Townsend 14. Nays. Aldermen Maddox, Miller, Powell, Rosengren, Stumph and Zilleken 6. Gentlemen: Complying with Section 99 F. of the amendment to the Charter of the City of Austin, we submit herewith a statement of the Receipts and Disbursements of the Water, Light and Power plant for the Quarter ending May 31st 1898; and as the report of this Commission for said period, we herewith transmit the report made to us by Mr. W. B. Patterson, Superintendent, which also contains a statement of the amount due by the City to this plant Light Consumers. Incandescent Light Consumers, May 28th 1898. 1178. Randolph " " Beaty " J. S. Wren " " O. McGregor " B. H. Littlefield & Jos D. Walls. " " Grosshans " R. A. Rutherford " " Ingren " Chas. Wolff " " Ladd " J. P. Wallace " " Maclay In motion nominations were closed. The Mayor appointed Aldermen Beaty, Slaynes & Zilker as Tellers. Herewith The following was the result of the first ballot. Voted. Von Rosenberg 3, Weyerman 10, Tracy 6, Randolph 17, Wren 3, Dremond 3, Littlefield 3, Wolff 4, Rutherford 5, Wolff 4, Wallace 9. W. H. Randolph having received a majority of the votes cast, was declared elected and a second ballot ordered. The following was the result of the second ballot. Weyerman 10, Tracy 4, Wren 3, Dremond 1, Littlefield 4, Walls 4, Rutherford 4, Wolff 3, Wallace 7. No one having received a majority, another ballot was ordered and the following reported as the result of the 3rd ballot. Von Rosenberg 1, Weyerman 8, Tracy 5, Wren 4, Dremond 1, Littlefield 4, Walls 7, Rutherford 1, Wolff 10, Wallace 13. Motion Mr. J. P. Wallace having received a majority of all the votes cast, was declared Voted. elected and another ballot ordered, and the following reported as the result of the 4th ballot. No election and a new ballot ordered, and the following reported as the result of the 6th ballot: Weyerman 6, Bracy 10, Wren 4. No election, and a new ballot ordered, and the following reported as the result of the 7th ballot: Weyerman 6, Bracy 10, Smith 2, Wren 2. No election, and a new ballot ordered, and the following reported as the result of the 8th ballot. Weyerman 6, Bracy 13, Wren 2. D. B.
