This of thanks to Alderman. Brooker offered the following resolution. which was. E.A. Hose Co-for read and unanimously adopted. "Be it resolved by the Mayor Entertainment and City Council of the City of Austin. That the hearty thanks of the Council are hereby tendered to the East Austin Hose Co, for the elegant entertainment given by that Co. of Jany 9th 1899. at which the members of the Council were so generously enter=tained with refreshments. ministering both to the body and mind and at which they had a royal good time. On motion the Clerk was directed to furnish a copy of this resolution to the said Company. The Mayor laid before the Council. a G.A. Report of Committee. Alderman Morris, for the special Committee presented the following report which was read, adopted and ordered filed. Austin Texas, Jany 1st. 1899.
Rept of Sp'l. Commu's to Exchange Bonds. To the Hon. Jno. D. McCall Mayor and Board of Aldermen of the City of Austin. Gentlemen: Your special Committee to exchange bonds. beg leave to report that they exchanged bonds with Mr. L. A. Bouquard, as per resolution of the City Council passed Dec 19th 1898. as follows. Bonds numbered, 10. 12. 13. & 14. were exchanged for bonds numbered, 1308. 1309. & 1310. which are only slightly mutilated. All of said bonds are Austin Water & Light 5½% Bonds.

113 Rept. of Police Alderman Prell. for the Police Committee to whom was referred the Comm. reports of the City Marshall for the month of Dec. 1898 presented a report, stating that the reports had been examined & found correct. The report was adopted & ordered filed. Alderman M'Lemore for the printing Committee presented the foll-owing report.
Austin, Texas, Jany. 18th. 1899. Rept. of Printing To the Hon. Jno. D. M'Call, Mayor and Comm. Board of Aldermen of the City of Austin. -Gentlemen: Your Committee on Printing, having duly advertises -ed for bids on printing, such as the Council proceedings, Ordinances, and such other matter as the Council may desire to print, have received bids from the Statesman, Tribune and Evening News, all daily papers published in the City of Austin. The Statesman agrees to do the printing for one third (1/3) of a cent per word, The Tribune for one sixth (1/6) of a cent per word, and the News for one twenty fifth (1/25) of a cent per word, each insertion. In view of the extremely low bid of the News, which is muchless than that of either of the other papers. Your Committee recom-mend that the News be awarded the Contract, for the ensuing year, and that the publishers of the said paper be required to file with the City Clerk a bona fide Bond, of one hundred (100) Dollars for the faithful execution of the Contract. Alderman Brooks moved that the report of the Committee be adopted which motion prevailed by the following vote: Yeas. Aldermen. Alderman M'Lemore, for the Printing Committee asked that the Committee be granted further time on the Job Printing. Which motion prevailed.

Belvin, for the Purchasing Committee, presented a Comm. report stating that the Committee had advertised for and had awarded bids for the following supplies for the City. From the City Attorney. Austin, Texas January 18th 1899. To the City Council of the City of Austin. Gentlemen: I desire to call your attention to the cases now pending in the Federal Court at this place, brought by E.C. Bartholomew, Receiver against, the City of Austin growing out of the contract made with the City Water Company, April 13th 1882. The first suit was filed Jany. 9th. 1897. for $16.900.53 and came on for trial upon the exceptions of the City on February 10th. 1897. before U.S. District Judge Maxey, and among the defenses sustained was one that the contract was void because creating a monopoly. This decision was reversed by the U.S. Circuit Court of Appeals at New Orleans and the case now-stands for trial on the merits. This suit involves the contract year of 1896. (See 85 Fed. Rep. 359.) The second suit was filed Jany. 19. 1898. for $17.080.26. covering the contract year of 1897. and the Attorney for the Receiver informs me that he will at once file a third suit for the amount claimed for the contract year 1898. In each of the cases the plaintiff admits owing taxes to the City which he wants deducted from the amount of his claim leaving $13,300.00. as the net amount due for with 6% interest for each year. As you know these cases involve the question whether the City shall pay for water until April 13th 1902. whether it was or not. The charter provides that it shall be the duty of the City Attorney to represent the City in all cases in all courts unless the City Council shall otherwise direct. This being the law I consider it my duty to call your attention to the cases and to say that if it be the desire of the Council to employ other attorneys to assist or take charge of them, it should be done at once, as it is necessary to arrange for the setting of them as early as possible. I am willing to discharge my full duty in the premises and to try the cases alone, if it is the opinion of the Council that their importance does not require the employment of other attorneys. This suggestion is made without any desire on my part to escape the responsibility or avoid the labor involved, My purpose is simply to avoid criticism for assuming to represent the City without assistance in cases of vital importance when perhaps the City Council might have thought that other attorneys should have been employed. Be it resolved that the City Engineer be and is hereby instructed to notify the owners of the Cattle, that they must at once arrange proper drainage along and across said Street. that same be done under the direction of the City Engineer. The Ordinance was read the second time. Alderman Horton moved to amend the Ordinance by striking out twenty five dollars and inserting in lieu thereof ten dollars. Resolved that the City Engineer be W. of Driskill Hotel and he is hereby authorized to lower the street gutter in front of the Driskill Hotel building to any depth he may deem proper in order to drain the alley on the west side of Said building. Resⁿ. to clean out Alderman Zieser, offered the following resolution which was ditch through read and adopted. Be it resolved by the City Council of the City of Austin, Texas, that the ditch running South through Comal Street, draining the 9ᵗʰ & 10ᵗʰ Wards, east of Waller Creek has become so obstructed that the water in said ditch has become stagnant, and is now a monaced to the health of the Citizens of Austin. Resolved that the Sanitary Inspector be authorized to employ two (2) extra men to remove all impediments that prevent the free drainage of the water in said ditch. Finance Commᵗᵒ to Alderman Haynie, moved that the Finance Committee be directed prepare Budget for 1899. to prepare and report to the Council the budget for the year 1899. The Ordinance was read the second time. Alderman Horton, moved to amend the Ordinance by striking out twenty five dollars and inserting in lieu thereof ten dollars. Rec in regard to proposed New Charter for the City 117. Ridd, Rosengren, Shelley, Stumph, Walker, and Zieker. 24. Nays. None. Alderman Redd, offered the following resolution. Whereas the people of this City as well as their representatives in this Council, have been entirely ignored by the self constituted “Democratic Charter Amendment Committee” who have in their Chamber meetings arranged a so called “new Charter” and their deliberations never having been made public, until the Statesman generously published the same in this mornings issue and, Whereas the Council being composed of democrats, on half of whom were elected on the same democratic platform as our Hon Mayor, Geo. D. McCall, at the East City election and on the peoples representatives, were at least entitled to the courtesy of being advised as to the character of the proposed new Charter, to be submitted to the Hon Legislature, to substitute our present Charter, which was drawn up by some of our most able jurists and democrats, after months of careful investigation and deliberation, and under the wise provisions of which the most magnificent system of Water Works, Electric Light and Power Plant has been given to the Capital City of our State, and under which with a few minor amendments, desired by the people and Council, our City can soon begin to derive an income over and above the operating expenses and sinking fund and interest on the bonds, which under our present Charter, rapidly being retired, giving us at the same time a progressive City Administration. Therefore be it resolved: That the proposed new Charter does not voice the will of our people and is not a democratic measure, having been incubated in Star Chamber sessions by a self constituted Committee and our Hon Senate and House of Representatives are hereby respectfully petitioned by this Council, composed of democrats and representing the Tax Payers of the City of Austin, to require that the so-called new Charter in event of its passage, be submitted to the people of our City for their approval or disapproval in order that the ends of justice and democratic principles may be subserved. The resolution was adopted by the following Vote: Yeas. Aldermen Beaty, Brady, Crowther, Dikes, Groves, Haynes, Horton, Kuhn, Maddox, Miller, Morris, Mieschler, Powell, Redd, Rosengren, Shelley, Stumph and Walker. 18. Nays.
