Minutes of a Regular Meeting of the City Council of Austin Texas March 20, 1899.
Hon. Jno. C. McCall. Mayor presiding. Roll Called. Present: Aldermen. Belvin, Brady, Hehr, Haynes, Horton, Kuehne, Maddox, McLenore, Rosengren, Shelley, and Stewart. Absent: Aldermen, Beaty, Crooker, Fischer, Groves, Miller, Morris, Nitschke, Powell, Reed, Walker, and Zickler. On motion the Council adjourned untill Thursday March 23d 1899. at 8 oclock. P.M.
(Austin Texas March 23d 1899. The Council was called to order by Hon F. M. Maddox. President of the Council. Roll Call. Present: Aldermen Beaty, Belvin, Brady, Crooker, Hehr, Fischer, Haynes, Kuehne, Maddox, McLenore, Miller, Morris, Nitschke, Powell, Reed, Rosengren, Shelley, Stewart, and Walker. 19. Absent: Aldermen. Groves, Horton, and Zickler. 3. On motion the minutes of the last regular and subsequent called meetings were approved as read without reading.
Petitions Memorials etc.
Alderman Powell offered the following resolution which was read and adopted. “Be it resolved by the City Council, of the City of Austin, that permission be granted the International and Great Northern Ry Company. to Connect a switch to their track on West 3d Street at Nueces Street, and lay said track along West 3d Street to the south east Corner of the Old Court House Square.” On motion Alderman Brady was excused from further attendance at this session of the Council. By Alderman Shelley. Petition of Citizens at and near the Dam asking certain changes in water supply. Read and on motion referred to the Water and Light Commission. By Alderman Slumph. Petition of S. H. Land & co for permission to erect a wagon scale at 1st Street and Georgetown road, in Hyde Park. Read and on motion the petition was granted the work to be done under the supervision of the City Engineer. By Alderman McLennore. Petition of the Austin Oil Mf’g Co. asking that a fire hydrant be placed on 5th Street infront of the Oil Mills. On motion the petition was granted. By Alderman Maddox. Petition of Joe Maller asking permission to erect a Corrugated Iron roof shed on alley in rear of Lots 1&2. Blk. 65. inside the fire limits Read and referred to the Fire Commissioners.
Reports of City Officers.
The chair laid before the Council the report of the Mayor acting as Auditor. Stating that he had examined the reports of the City Assessor and Collector, the Clerk, and the Treasurer for the Quarter ending Feby 28d 1899

and found the same correct, the warrant was ordered filed. Alderman Moodie, for the Claims and Accounts Committee, to whom was referred the petition of J. Sh. Fulmore, Jr. of the Estate of W M Jackson Jr. claimant, asking for certain corrections in assessment for new pavement etc, report, recommending that the petition be granted. The report of the Committee was adopted. Alderman Brady for the Fire Committee presented the following report which was read and ordered filed. Austin, Texas March 20th, 1899.
To the Honorable Mayor and City Council: Your Fire Committee has the honor to report that we have complied with your instructions to advertise for bids and to purchase for the City two New Hose Wagons, and 1,000 feet of Hose. Your Fire Commissioners and Fire Committee met and after carefully considering a large number of bids, awarded the contract for our wagons to Mr. S. B. Rathby of this City, his being the lowest bid, amounting to Four Hundred & Ten, 00/100 ($410.00) Dollars; said wagon to be delivered inside of four months. We also receipted the Washington Wagon, previously purchased, at the same price, $410.00. The bill for which is now on file in the office of the City Clerk. Further more, we have purchased from Walter Tips, agent, One Thousand feet of Keystone Three Ply Hose, at Seventy cents per foot, guaranteed for Five years, which your Committee also considered the best bid. We also purchased of Protection Fire Company a Fire Bell, for which there was an appropriation of $250.00, made some time ago. This Bell is to cost $232.00, delivered. Rpt. Special Com to confer with owners of Sewerage Plant Driskill Hotel Alderman M Lennord for the special Committee appointed to confer with the owners of the Sewerage Plant, in regard to certain connections in the alley west of the Driskill Hotel, offered the following motion which was adopted, “Moved that the City Engineer be and he is hereby instructed to place lighter stones than those now there at the intersection of the Driskill alley with Sixth street and to place there so much gravel as he thinks necessary to make a safe and dry crossing for pedestrians.
Election of officers of the Fire Dept. The Chair laid before the Council the returns of the Judges of Election for officers of the Fire Dept. held March 20th, 1899. On motion the chair appointed the following Committee to open and canvass the returns. Viz; Aldermen: Haynes, Shelley and Walker.
Suit of Amelia Hall vs City Com appointed The Chair then laid before the Council a communication from the City Attorney, recommending a compromise of the suit of Amelia Hall against the City; upon the terms as set out in the communication. on motion the matter was referred to a special Committee consisting of Aldermen: Walker, Shelley, & Mr. Leonard, with power to act.
Comn from City atty regarding sewers emptying in the Colorado River The Chair then laid before the Council a communication from the City attorney regarding the different sewers in the City emptying in the Colorado River. The communication was read and on motion the matter was referred to the Mayor, the City attorney, and to aldermen

141 Maddox, Belvin & [illegible] for further investigation and consultation with the representatives of the different sewers. Alderman Horton entered the Council Chamber and Alderman Priddy was called to the Chair. The Committee to Canvass the vote for officers of the Fire Dept. made the following report. March 23d 1899.
Graham The your Committee appointed to Canvass returns of election for Chief of the Fire Dept, Ass't Chief and Recorder, beg to report as follows. The tally sheet shows that Jo. S. Stumph for Chief received 139 votes and A. W. Achilles received 95 votes. For assistant Chief J. Machin received 135 votes and C. Woodworth received 109 votes. For Recorder J. M. Mitchell received 129 votes and C. Brinkman received 111 Votes. Result being that Jo. S. Stumph received a majority of 44 Votes for Chief and J Machin received a majority of 26 votes for Ass't Chief and J. M. Mitchell a majority of 18 Votes for Recorder H. L. Haynes a. M. Belvin R. C. Walker.
New Business.
Message from Mayor - returning unapproved Ord' al'p'g $350.00 to repair bridge in Fair View Pk. The Chair laid before the Council a message from the Mayor reterning without his approval an Ordinance passed at the last regular meeting of the Council appropriating the sum of $350.00 to repair bridge across Jennings Branch in Fair View Park, south austin with his reasons therefor. The question was then put shall the Ordinance now pass notwithstanding the objections of the Mayor. and the Ordinance passed by the following Vote: Yeas. Aldermen: Brady, Crother, Haynes, Horton, Huber, Maddox, McLemon, Miller Morris, Mitchell, Powell, Redd, Roesgen, Shelley and Stumph. 15. Nays. Aldermen: Belvin, Fehr, Fischer, and Walker. 4. On motion Alderman Belvin was excused from further attendance at this session of the Council.
Message from Mayor returning unapproved Ord. app'g $150.00 Bridge !! N 2d & Con The Chair then laid before the Council a message from the Mayor returning without his approval an Ordinance Appropriating the sum of $150.00 to build a wagon bridge at the intersection of N 2d Street and Congress Avenue, with his reasons therefor. The Chair stating that the question was, "Shall the Ordinance now pass notwithstanding the objections of the Mayor", and the ordinance passed by the following Vote: Yeas. Aldermen: Brady, Crother, Fehr, Fischer, Haynes, Horton, Huber, Maddox, McLemon, Miller, Morris, Powell, Redd, Roesgren, Shelley and Stumph. 16. Nays. Aldermen: Mitchell and Walker. 2. Alderman Horton offered the following resolution, which was read and adopted. Whereas there is now no safe and adequate bridge or crossing over Waller Creek between sixth street and Fourteenth street. to accommodate the large population residing East of said Creek, and having to pass through that location, not only from the City, but from the adjoined Country, and it is a necessity to provide some adequate method to meet the needs of the public in transit.

Therefore, Be it resolved by the City Council of the City of Austin, That the City Engineer be and he is hereby instructed to at once proceed to examine the roadway and approaches to said Waller Creek where [illegible] Street crosses it and make an estimate of the probable cost of constructing a good and substantial viaduct over said Creek at said point, and to report the same as soon as practicable to this body. By Alderman Haynes, An Ordinance appropriating the sum of $50.00 to build a rock box culvert on East Avenue and between 10th & 11th Streets. The Ordinance was passed under suspension of the rules by the following Vote: Yeas Aldermen: Brady, Crooker, Fehr, Fischer, Haynes, Horton, Huhn, Maddox, McLemore, Miller, Morris, Nitschke, Powell, Redd, Rosengren, Shelley, and Stumpf. 17. Nays: Alderman Walker. 1.

President pro tem Maddox in the chair. By Alderman Brady an Ordinance appropriating the sum of $150.00 to build a bridge at the intersection of W 5th & Congress Avenue. The Ordinance was passed under suspension of the rules by the following Vote: Yeas. Aldermen: Brady, Crooker, Fehr, Fischer, Haynes, Horton, Huhn, Maddox, McLemore, Miller, Morris, Powell, Redd, Rosengren, Stumpf, 16 Nays, Aldermen, Nitschke, Shelley, & Walker. 3. On motion Alderman McLemore was excused from further attendance at this session of the Council.

By Alderman Morris, An Ordinance appropriating the sum of $2,871.22 to pay salaries of Officers and employees for the month of March 1899. The Ordinance was passed under suspension of the rules by the following Vote: Yeas. Aldermen: Brady, Crooker, Fehr, Fischer, Haynes, Horton, Huhn, Maddox, Miller, Morris, Nitschke, Powell, Redd, Rosengren, Shelley, Stumpf, and Walker. 17. Nays. none.

By Alderman Morris, An Ordinance appropriating the sum of $330.00 to pay Salaries of Aldermen for the month of March and April, 1899. Int due on W & L By Alderman Morris an Ordinance appropriating the sum of $16,187 50/100 to pay interest due April 1st 1899, on $1,295,000 00/100 5% Water and Light bonds The Ordinance was passed under suspension of the rules by the following vote: Yeas Aldermen, Brady, Crooker, Fehr, Fischer, Hayne, Horton, Huhn, Maddox, Miller, Morris, Nitschke, Powell, Read, Rosengren, Shelley, Stumpf, and Walker. 17. Nays None.
funding bonds By Alderman Morris, an Ordinance appropriating the sum of $2,175 00/100 to pay interest due April 1st 1899, on $72,500 00/100 funding bonds. The Ordinance was passed under suspension of the rules by the following, vote: Yeas Aldermen, Brady, Crooker, Fehr, Fischer, Hayne, Horton, Huhn, Maddox, Miller, Morris, Nitschke, Powell, Read, Rosengren, Shelley, Stumpf & Walker. 17. Nays, None.
City Charter to have New Charter printed On motion, the City Clerk, was directed, to have one from the Secretary of State, a certified Copy of the New Charter for the City, and to have 500 Copies of the same printed, at once.
