1899 Austin Approves Official Bonds, Budget

Monday, April 10, 1899 special called

New city officials approved: The council approved bonds for a new City Engineer, City Marshal, and Treasurer, ranging from $1,000 to $50,000, to ensure they would faithfully perform their duties and account for public money.

Monthly payroll authorized: The council appropriated nearly $3,200 to cover April 1899 salaries for police, street workers, sanitation crews, and other city employees—routine budget maintenance.

Telegraph company gets approval: The Southwestern Telegraph and Telephone Company was authorized to install underground conduits through Austin streets and alleys to lay telephone lines.

Standing committees assigned: The Mayor announced assignments for 14 standing committees overseeing areas like streets, water, fire, police, and parks for the upcoming term.

Minor city business: The council addressed an alley petition, removed improper property tax assessment on a former Methodist church building, and approved $159 for election judges' compensation.

158 Minutes of a Called Meeting of the City Council of Austin Texas April 10, 1899. Hon Jno. D. McCall Mayor Presiding Roll Call. Present Aldermen Dunham, Fischer, Glass, Morris, Mortimer & Nolen 6. Absent. Alderman Stumpf. 1. The following Call of the Council was read. Call A special meeting of the City Council is hereby called to meet in the Council Chamber City Hall at 8 O'clock P.M. this April 10th 1899. for the purpose of fixing and approving bonds of such City Officers as may be ready to qualify. Marshal's Certificate I hereby certify that the above Call was served on the following named Aldermen by having it read to each of them in person to wit; Dunham, Fischer, Glass, Morris, Mortimer, Nolen, and Stumpf. Lucy City Marshal Mr= Ord' Conditions and fixing the am't of Official bonds By Alderman Morris, an Ordinance Prescribing the Conditions and fixing the amount of the official bonds required of Certain Charter Officers of the City of Austin. The Mayor laid before the Council, the following official bonds. of J. M. P. McCall, City Engineer & Ex officio Street Commissioner. and A. J. Thorpe, Marshal. Engineers & Ex officio Street Comr Bond. State of Texas } County of Travis } Know all men by these presents. That We J. M. P. McCall D. A. McFall and H. P. Haldeman as sureties are held and firmly bound unto Jno. D. McCall Mayor of the City of Austin and his successors in office in the sum of One thousand ($1000) dollars, for the payment of which we hereby obligate ourselves, jointly and severally our heirs, executors, and assigns firmly by these presents. The conditions of this obligation are such that whereas the said J. M. P. McCall was on the 3rd day of April 1899 elected to the office of City Engineer & Ex officio Street Commissioner of the City of Austin, for the period of two years next ensuing and until his successor shall be elected & qualified. Now if the said J. M. P. McCall shall faithfully perform all duties imposed or may be imposed upon him by the Charter and Ordinances of said City, and by order of the City Council, and shall strictly account for and pay over all moneys that may come into his hands, then this obligation shall be void, otherwise it shall remain in full force. --- Page break --- 154 and effect; In witness whereof we hereunto set our hands this the 10th day of April 1899. Tharp. as principal and, as sureties, are held and firmly bound unto the Honorable Jno; D. McCall Mayor of the City of Austin and his successors in office, in the sum of Two Thousand (2,000) Dollars, good and lawful money of the United States of America, for the payment of which, well and truly to be made, We hereby bind ourselves, our heirs, executors and adminis=trators, jointly, severally and firmly by these presents. The condition of the above obligation is such that, Whereas the above bounden A.J. Tharp was on the 3d day of April, A.D. 1899, duly and legally elected, at the City Election held in the City of Austin, in Travis County, Texas, on Monday, April 3d 1899. Marshal of the said City of Austin, in Travis County, Texas, for the term of two (2) years as is shown by the election returns and the records thereof on file and of record in said City of Austin. Now if the said A.J. Tharp shall faithfully discharge all the duties of Marshal of said office of Marshal of said City of Austin and shall well and truly pay over and account for all money or sums of money by him Collected by virtue of his office to the person or persons authorized to receive the same in accordance with the law in such case [illegible] and the ordinances of said City of Austin. then this obligation to be null and void, otherwise to remain in full force and effect, In testimony whereof we hereunto sign our names at the City of Austin Texas, on this day of April, A.D. 1899 A.J. Alderman Shuerpful entered the Council Chamber. Alderman Morris for the Special Committee to examine the bonds reported that they had been examined, and found Correct as to form, and that they were satisfied as to the sureties and recommended their approval. The report was adopted. Alderman Dunham moved that the Clerk be directed to Copy the bonds in the minutes of the Council. Which motion prevailed. Ald'm Glass enters Alderman Nolen entered the Council Chamber. res'l Alderman Glass offered the following resolution which was read and referred to Claims and Accounts Committee. 'Be it resolved by the City Council of Austin that: Whereas, it appears from the records in the office of the County Clerk of Travis County and the minutes of the Dist. Court of Travis County that Lot 21, Blk. 8, out lot 16, Div. D. was during the year 1888, the property of the Methodist Church and used exclusively for church purposes, and Whereas, it further appears, that during said [illegible] ...through the action of --- Page break --- 156 adverse claimants (whose claim was by the final decree of the Dist. Court of Travis County declared void). Wherefore the City Assessor of the City of Austin is hereby directed to cancel said assessment and to remove same from the assessment rolls of said City. Res' to continue the ass't to City Clerk Alderman Morris offered a resolution authorizing the City Clerk to continue the assistant in his office until April 30th '99, to assist in transferring papers etc to the new file Case, which resolution was adopted. Res' to continue deputy [illegible] Alderman Morris offered the following resolution which read and adopted. Be it resolved by the City Council of the City of Austin, That the City Assessor and Collector is hereby authorized to continue to employ as now a deputy assessor at a salary of $75⁰⁰ per month, who shall perform such duties as the Assessor & Collector may require of him, and the Assessor & Collector shall be responsible for all of his official acts. The City Clerk is hereby directed to place his name on the Pay rolls as heretofore. Ald Stumpf enters Alderman Stumpf entered the Council Chamber. Treasurer's Bond The Mayor laid before the Council the bond of M. F. Byrne the Treasurer elect which was read and referred to the Finance Committee and City Attorney. Alderman Stumpf for the Finance Committee to whom was referred the Bond of the Treasurer elect presented a report recommending that the bond be approved. The report of the Committee was adopted. Copy of Bond (50c U.S. Internal Revenue Stamp) State of Texas, } Know all men by these presents County of Travis. } That we, Miles F. Byrne, as principal, and Jas R Johnson R. J. Brackenridge, J.P. Schneider, W.P. Northam, J.C. Myrick Geo. P. Grier, A.J. Zilker, Margaret J. Raymond and H.H. Haldeman as sureties, are held and firmly bound unto the City of Austin in the sum of Fifty Thousand Dollars, good and lawful money of the United States, for the payment of which well and truly to be made we hereby bind ourselves, our heirs, executors, and adminis-trators, jointly, severally and firmly by these presents. The Condition of the above obligation is such that, Whereas, the above bounden Miles F. Byrne, was on the 3d day of April A.D. 1899. duly elected City Treasurer of the City of Austin for the term of two years and untill his successor shall be elected and qualify, as is shown by the records of the City of Austin, now if the said Miles F. Byrne shall strictly account for or pay over all moneys that may come into his hands, and otherwise perform all his duties that are, or may hereafter be, imposed upon him by, or under the Charter or ordinances of the City, or by order of the City Council, then this obligation shall be null and void; otherwise to remain in full force and effect. Ordinance [illegible] [illegible] Telephone Co. to construct underground conduits By Alderman Morris, An Ordinance to authorize the Southwestern Telegraph and Telephone Co. to construct underground conduits for laying and conducting its wires through across and along certain streets and alleys of the City of Austin. The ordinance was passed under suspension of the rules by the following vote; Yeas, Aldermen, Dunham, Fischer, Glass, Morris, Mortimer, Nolen & Stumpf. 7. Nays, None. 0. Ord. app'g $159.00 judges of election etc. By Alderman Stumpf, an ordinance appropriating the sum of $159.00 to pay judges of election etc. The ordinance was passed under suspension of the rules by the following vote; Yeas, Aldermen, Dunham, Fischer, Glass, Morris, Mortimer, Nolen & Stumpf. 7. Nays, None. 0. Res'n regarding Compromise of suit Amelia Hall. Alderman Dunham, offered a resolution regarding compromise of the suit of Amelia Hall, vs, the City of Austin. The resolution was read and adopted, and the Mayor appointed the following aldermen as the special committee provided for in the resolution viz: Aldermen Dunham, Morris, and Fischer. Ord'n app'g 80.00 Sal. two street teams. By Alderman Stumpf, An ordinance appropriating the sum of $80.00 to pay salaries of two drivers street teams, for the month of April 1899. The ordinance was passed under suspension of the rules by the following vote; Yeas, Aldermen, Dunham, Fischer, Glass, Morris, Mortimer, Nolen & Stumpf. 7. Nays, None. 0. Ord'n app'g 199.00 Sal. 4 drivers & gutturman Sanity Dpt. By Alderman Stumpf, An ordinance appropriating the sum of $199.00 to pay salaries of four drivers Sanitary Carts, and one gutturman Sanitary Dept. April 1899. The ordinance was passed under suspension of the rules by the following vote; Yeas, Aldermen, Dunham, Fischer, Glass, Morris, Mortimer, Nolen & Stumpf. 7. Nays, None. 0. By Alderman Stumpf, An ordinance appropriating the sum of $2,690.66 to pay salaries of officers and employes for the month of April 1899. The ordinance was passed under suspension of the rules by the following vote; Yeas, Aldermen, Dunham, Fischer, Glass, Morris, Mortimer, Nolen & Stumpf. 7. Nays, None. 0.
