282 Regular meeting of the City Council Austin Texas March 19, 1900 Hon Jno. W. Wrall Mayor presiding Roll Called Present Alderman Dunham Glass Morris Wartimer and Stumpff 5 Absent Alderman Fischer & Kolean 2 The minutes of the last regular meeting were read Alderman Glass moved to change the minutes So as to Minutes Show that he Voted "No" on the motion to pass the ordinance Attached putting into operation the Corporation Court, Notwithstanding, the Mayors objections" the record showing that he Voted "Aye" Alderman Fischer entered the Council Chamber. The motion to change the minutes was then put and the Motion to change Motion lost by the following Vote lost Yeas Alderman Dunham Glass & Wartimer 3 Nays Alderman Fischer Morris, Stumpff & the Mayor 4 The motion was then made & put to adopt the minutes as recorded and the motion lost, Alderman Glass stated that he had voted against the Minutes adoption of the minutes, and desired to change his Approved Vote & Vote to adopt them. The Mayor then declared the Minutes adopted as recorded by the Clerk. Petitions Memorials etc Peth.L. The Mayor laid before the Council the petition of J.L. To Cancel and destroy 3.5% Water & Light-bonds, purchased for the Sinking fund of W&L bonds. Which motion prevailed and the X Mayor appointed Aldermen Stumph Dunham & Rosen as such Committee. Supplemental The Mayor laid before the Council a supplemental annual Report W&L report of the Water & Light-Commission, made by them in Commission response to a Resolution passed by the Council – The report was read and on motion referred to the Water & Light – Committee for finished business. The Mayor laid before the Council the following Veto Message from the Mayor's office, Austin, Texas, March 1st 1900 To the Honorable City Council, Gentlemen: I herewith return without my approval an ordinance entitled "An ordinance appropriating Mayor's Veto the sum of Ten Thousand dollars for the purpose of streets and Approp $10,000 for bridge improvements of the City of Austin" passed by your St & W&L Honorable body March 5th 1900. Section 10 of the Charter reads as follows: "Sec 10. That in order to make these restrictions effective the council shall within two months after the beginning of each fiscal Year, and after the Salaries of Officers and regular employees shall have been fixed for the year, cause to be made or adopt an estimate of the probable income from all sources which will be collected for the general fund during the fiscal Year, and of the expenditures to pay Salaries and wages of Officers and regular employees, and of the amount required to meet the other ordinary expenses of the City Government, not including work on the streets - --- Page break --- 284 and bridges, or other public improvements; Said estimate shall be spread upon the minutes of the Council when adopted, and may be amended when the Council may deem them incorrect." "Section 122 reads as follows: "Sec 122 That after two months from the beginning of any fiscal year no appropriation shall be made for other purposes, other than to pay the regular salaries of officers and employees, and expenses of the Hospital without such estimate of the City Council being in force as provided for in this act" Said estimates have not been adopted, as provided for in the Charter, the Council is therefore without authority at present to appropriate money for street improvements" Respectfully Jas. D. W. Hall Mayor Alderman Lelass moved to reconsider the vote by which the ordinance was passed, which motion prevailed. Veto sustained The motion was put, shall the ordinance pass notwithstanding the Mayors objection, which motion was lost by the following tall Yeas None Nays Alderman Dunham, Lelass Morris Mortimen, Stumph 6 No business Bill for W & L from The Mayor A bill of the Water & Light Commission for Water & Light furnished City the City to Feby 28th 1900, which was on motion refered to the Water & Light Committee. Deed of G. W. & Mrs. Amelia The Mayor laid before the Council a communication Prass for street purposes. from G.W. & Amelia Prass enclosing a deed for certain real Estate for street purposes. On motion the deed was accepted and the thanks of the Council extended to the donors. Alderman Dunham moved that Officer Ottison Ottison given be furnished with a telephone at his residence at the telephone at expense of City, which motion prevailed. expense of City Dan Collum from 1899 "Alderman Morris offered the following resolution approved Resolved by the City Council of the City of Austin, That the Tax Rate for the year 1899, be approved subject to the pending appeals." The resolution was adopted by the following vote Yeas Alderman Rischen Morris, Stumph & The Mayor 4 Nays Alderman Dunham Lelass & Mortimer 3 On motion the Council adjourned Geo. F. Johnson City Clerk.
