408 Called meeting of the City Council Austin Texas December 05, 1900 Hon Geo. S. McAlee Mayor presiding Roll Called Present Aldermen Dunham Fischer Glass Mortimer Nolen and Stumpf 6 Absent Alderman Schneider 1 On motion of Alderman Fischer the Council took a recess for fifteen minutes On the expiration of the recess the Council was called to order by the Mayor. Call The following for a special Meeting of the Council was read A special meeting of the City Council is hereby Called to convene in the Council Chamber at the City Hall in Austin Texas at 8 o’clock P.M. Tuesday December 4th 1900 for the purpose of considering an ordinance entitled an ordinance granting to J.B. Earl and J.E. Boynton the right to Construct a Telephone Exchange in the City of Austin, which ordinance is now pending on its second reading before said body and for the further purpose of taking such action on said ordinance as to the Council may seem proper. To Mortimer Jno. R. McAlee J. E. Nolen Francis Fischer Ord: Granting The Mayor laid before the Council an ordinance J.B. Earl & J.E. Boynton their associates and Tel. Exchange assigns to build, maintain and operate a system of telephone and an exchange in the City of Austin. The ordinance was read the second time Alderman Glass moved to amend the ordinance Article 6 paragraph 2. by striking out the word “said” and inserting in lieu of same the word “fifteen” which motion prevailed. Alderman Glass moved to amend the ordinance by adding Art 6.A. as follows That the grantees their associates and assigns shall within 90 days after the passage of this ordinance pay or cause to be paid to the City Clerk of the said City of Austin the sum of two thousand dollars, as a valuable consideration for the granting of said franchise. The amendment was lost by the following vote Yeas Aldermen Dunham Glass 2 Nays Aldermen Fischer Mortimer Nolen Stumpf 4 Alderman Glass offered the following amendment which was adopted viz: Art 9. after the word “said” on its own contract or lease on any person or Company now operating on or upon

409 operate a Telephone Company in said City of Austin" Alderman Fischen moved to Suspend the rule and place the ordinance on its third reading, and final passage which motion prevailed by the following vote: Yeas Alderman Fischen, Glass, Mortimer, Nolan & Stumpt 5 Nays Alderman Dunham 1 The ordinance was then read the third time and passed by the following vote: Yeas Alderman Dunham, Fischen, Glass, Mortimer, Nolan and Stumpt 6 Nays None
Alderman Dunham moved to re-consider the Vote by which the ordinance was passed and asked to have that motion entered upon the Journal. Alderman Dunham moved that the Council stand adjourned which motion was lost by the following Vote: Yeas Alderman Dunham and Glass 2 Nays Alderman Fischen, Mortimer, Nolan and Stumpt 4 Alderman Nolan moved to lay the motion, made by Alderman Dunham, to reconsider the Vote by which the Telephone ordinance was passed, on the table. Which motion prevailed by the following Vote: Yeas Alderman Fischen, Glass, Nolan & Stumpt 4 Nays Alderman Dunham & Mortimer 2 adjourned. On Motion the Council adjourned J.W. Johnson City Clerk
