551 Regular Meeting of the City Council Austin Texas, August 19, 1901. Hon: R. B. White Mayor presiding. Roll Called. Present: Aldermen Hume, Maddox, Mortimer, Nitschke, Redd, Schneider, Shelley, Stumph and Ulilt. 9. Absent: Aldermen Brocker, Davis, Gillis, Low, and Shumate. 5. On motion of Alderman Maddox, the minutes were approved, as recorded Minutes read by the Clerk, without reading. without reading. Memorials & Petitions etc. Petition of G. M. Brass. By the Mayor: Petition of G. M. Brass, asking to have certain Read and on motion referred to the street committee. E. L. Dozier. By Alderman Nitschke: Petition of S. L. Dozier, asking to have certain Found fees paid by him, refunded. Read and referred to the Committee on claims and Accounts. Regular Order: Alderman Maddox, moved to suspend the regular order of business Sus. rules: and to take up and consider: An Ordinance granting authority to the H. & T. C. R. R. Co. to put in certain switches etc. Which motion prevailed. Ald. Davis enters: Alderman Davis entered the Council Chamber. Ord. Granting By Alderman Maddox: An Ordinance, granting the Houston H & T. C. R. R. Co. and Texas Central R. R. Co. permission to change certain side tracks to construct others and to construct, Brick Passenger Station, Austin. side track Sta. The Ordinance was read the First Time, and on motion the rules were suspended and the Ordinance placed on its second reading by the following Vote: Yeas, Aldermen: Davis, Hume, Maddox, Mortimer, Nitschke, Redd, Schneider, Shelley, Stumph and Ulilt. 10. Nays: None. 0. Ald. Shumate enters: Alderman Shumate entered the Council Chamber. The Ordinance: was read the Second Time. Alderman Davis Amendment: moved to amend by adding at the end of Section 3: the following "and approved by the City Engineer and Street Committee". Amendment adopted: The amendment was adopted. And a motion made to suspend the rules and place the Ordinance on its Third reading, and final passage, which motion prevailed by the following vote: Yeas: Aldermen: Davis, Hume, Maddox, Mortimer, Nitschke, Redd, Schneider, Shelley, Shumate, Stumph and Ulilt. 11. Pet. of Isaac Bledsoe: By the Mayor: Petition of Isaac Bledsoe, asking to have Certain Found fees paid, by him refunded. Reports of City Officers. City Engin. The Mayor laid before the Council reports of the City Engineer on Complaints: complaint of J. P. Houston and H. B. Fisher, also a report stating that he had laid out and filed certain allied lots. Reports of Standing Committees. --- Page break --- 552 Alderman Shelley for the Claims and Accounts Committee, presented the following reports. On the petitions of Mrs. S. J. Orr. A. R. Scott and W. E. Harwood, to have certain Pound fees remitted, they recommend that the petitions be granted, and the petition of the S. E. Whitfill asking correction of Assessment for 1900. They recommend that the petition be granted. The several reports of the Committee were adopted. Alderman Crooker entered the Council Chamber. Ord. for Com. Alderman Stumpf for the Ordinance Committee, to whom was of Austin presented the memorial of H. Von Rosenberg Jr. Esq. regarding the pumping into operation the Corporation Well of the City of Austin. presented a report. Stating that at this time they did not think it advisable to put the well in operation. The report of the Committee was adopted. Res. To Sus. Alderman Stumpf for the Ordinance Committee to whom was S. R. R. Com. referred a Resolution for the creation of a special Committee to be Terminus. Known as the Committee on Permanent Street improvement. presented a report recommending that the Resolution, "do not pass." The report of the Committee was adopted. Police Committe- Alderman Shelley for the majority of the Police Committee to Org? Police Force whom was referred an Ordinance, prescribing details for the Majority report organization of the Police force, presented a report, recommending the passage of the Ordinance, With an amendment proposed by the Committee. Minority report Alderman Schneider for the minority of the Committee, presented a report recommending that the Ordinance "do not pass." Alderman Stumpf moved to adopt the minority report which motion was lost by the following vote: Yeas: Aldermen, Schneider, Hume, Nitschke, Schmidt, Stumpf and Ult. . . . 6 Nays: " Davis, Maddox, Mortimer, Redd, Shelley, Shumate and the Mayor. . . 7 Mo. to bring up Alderman Nitschke moved that the report lie over to come up with with ord. New Business. By Alderman Maddox. An Ordinance to permit owners of real estate foreclosed by the City of Austin, at foreclosure sale, to redeem the same at any time within ninety days from the taking, effect of this Ordinance, by paying to the City Tax Collector, the amount of the taxes due, and court cost and all penalties, with interest from the date when such sums became due at six per cent per annum. Together with all taxes penalties, and interest that may be due on same. The Ordinance was passed, under suspension of the Rules by the following vote: Yeas: Aldermen. Crooker, Davis, Maddox, Mortimer, Nitschke, Redd, Schneider, Shelly, Shumate, and Ulit. Nays: Aldermen. Hume and Shumph. 10. 2. Ord. App'g. By Alderman Ulit. An Ordinance, appropriating the sum of $96.00. $96.00 for the purpose of paying the laborers in laying off the Cemetery lots, laborers in laying the Ordinance was passed, under suspension of the rules, by the following Cemetery. Vote: Yeas: Aldermen, Crooker, Davis, Hume, Maddox, Mortimer, Nitschke, Redd, Schneider, Shelly, Shumate, Shumph and Ulit. Nays: None. 12. Ord. App'g. By Alderman Ulit. An Ordinance, appropriating the sum of $15.00 for the purpose of buying fixtures for Cemetery gate. Cemetery Gate. The Ordinance was passed, under suspension of the rules by the following vote: Yeas: Aldermen, Crooker, Davis, Hume, Maddox, Mortimer, Nitschke, Redd, Schneider, Shelly, Shumate, Shumph, and Ulit. Nays: None. 12. Notice of Cemetory On motion of Alderman. Shelly, the Assessor and Collector was directed Lots on Sale. to give notice through the public press, that the City now had Cemetery Lots on Sale. Res. to repeal Alderman, Schneider offered the following resolution. Pound Ordinance. Be it Resolved, by the City Council of the City of Austin: That to abolish office all Pound Ordinances of the City be and are hereby repealed of Pound Master and that the office of Pound Master be and is hereby abolished. Tabled. Alderman, Mortimer moved to lay the Resolution on the table. Which motion prevailed. Leave of absence On motion of Alderman. Shelly, leave of absence for two days, absen. for City beginning on the 24th inst. was granted to the City Clerk. Ord. App'g. $50.00 Alderman. Maddox. Called up the Ordinance, appropriating, to pur. type writer the sum of $50.00 to purchase a typewriter, for the Marshal & Clerk, was read the second time, and a motion made to suspend the rules and place the Ordinance on its Third reading.
