The Mayor laid before the Council the following Communication & the Honorable Mayor and Board of Aldermen City of Austin Gentlemen: It is with deep regret that I find it necessary To tender my resignation as Aldermen of the first ward of the City of Austin. Owing to my ill health, I do not feel that I can serve the City and her best interests as a Member of your honorable Body, as they should be served. 572. By the City Engineer Total paid on account during the month for street improvement $418.35 Referred to Street Committee Reports of Standing Committees Street Com. Report. Alderman Nitschke for the Street Committee to whom was referred on Petition. the petition of M. W. Pross to change street in Belle View Park presented a report, recommending that the petition be granted, provided the said Pross grade said streets, and obtain the consent of the County Commissioners Court to the said change. The report of the Committee was adopted Street Com. Report. Alderman Nitschke for the Street Committee presented a on Claim. a report recommending that the claim of John Hildinger for street work done by them, amounting to $45.25 be Compromised by paying them one half the amount claimed provided said petitioners accept same as full payment of their claim. The report of the Committee was adopted. Street Com. Report. Alderman Nitschke for the Street Committee to whom was on Pat. Weike. referred the claim of A. Weike for damages to home, caused by stepping into a hole in street on Lavaca Street, presented a report recommending that the sum of $10.00 be paid the said Weike in full settlement of said claim. The report of the Committee was adopted. Finance Com. Report. Alderman Maddon for the Finance Committee presented on Bond Purchase. a report stating that the Finance Committee had purchased for the Sinking fund of the Water & Light bonds, 15 Water & Light bonds of $1000. each, and recommending that said bonds be cancelled or destroyed by the Council. The report of the Committee was adopted. Cem. Com. Report. Alderman Uhlit for the Cemetery Committee to whom on Cem. Ordinance. was referred An Ordinance amending an ordinance regulating Cemeteries within the City, presented a report recommending the passage of the ordinance. On motion the report of the Committee was adopted. W & L. Com. Report. New business By Alderman Shelley An ordinance prohibiting the desecration of graves in the City Cemetery – The ordinance was read the first time and on motion was referred to the Cemetery Committee. Alderman Shinnate offered the following resolution, which was read and referred to the ordinance Committee. Be it resolved by the City Council of the City of Austin, that the Mayor be and is hereby instructed to appoint from the members of the City Council a Committee of three whose duty it shall be to auditthe accounts of every officer of the City charged with the duty of collecting, receiving or paying out funds of the City, and the said Committee shall make monthly reports of their action to the Council. By Alderman Waddas An ordinance appropriating the sum of $17.60 for the purpose of paying expenses incurred and the incurred in the case of the City of Austin Vs Bartholomew and Nalle, Receiver. Dear Sir: We beg to call your attention to the provisions of General Laws of the State of Chapter 163 page 236 of the 28th Legislature, entitled "an act to require Cities to provide for a board of plumbers to be known as the examining and supervising board of plumbers ; to regulate the duties of said board, and provide for the fines for violations thereof ", and request that you take such steps as may be necessary to adopt and put in force the provisions of said act in the City of Austin. Alderman Mortimer offered the following resolution Be it resolved by the Council of the City of Austin, that 250 copies of the Amended Charter of the City of Austin be printed and distributed for the information of all concerned Alderman Nibbs offered as a substitute that the City Clerk be directed to obtain from the Secretary of State a copy of the bills amending the Charter of the City of Austin, and that he have printed in pamphlet form for the use of the City and its citizens - The substitute was adopted By Alderman Nibbs an ordinance providing for the issuance of refunding bonds of the City of Austin, for the purpose of refunding its bonded debt and to provide for the assessment and collection of a tax sufficient to pay the interest thereon and to create an Annual Sinking Fund of two per centum (2%) of the principal thereof The ordinance was read the first time and on motion was referred to the Finance and Water Light Committee, each member of said Committee to be furnished with a copy of the ordinance On motion Alderman Shumate was excused from further attendance on this session of the Council By Alderman Nibbs an ordinance appropriating the sum of $ 1168.⁰⁰ to pay approved accounts.

Alderman Shelley moved that a Committee of three be appointed by the Mayor to destroy bonds purchased by the Finance Committee for the sinking fund of the water & Light bonds, as shown by the report of that Committee submitted to the Council, which motion prevailed. The Mayor appointed Aldermen Schneider Redd and Shelley as such Committee. The Council took a recess pending the report of the Committee. The Committee being ready to report the Council was called to order by the Mayor when the following report of the special Committee was presented and read.
