Austin Removes Railroad Track Obstructions

White Mayor presiding Roll Called Present Aldermen- Crooker, Low, Maddoo, Mortimer, Nitschke, Schneider, Shelley, Shumate & Hard - 9 Absent - Alderman Davis, Hume, Redd & Stumpf - 4 The following call of the Council was read- To the members of the City Council of the City of Austin:Call of Council: Special meeting of the City Council of the City of Austin is hereby called to convene in the Council Chamber of the City of Austin, at the City Hall in said City at 8 o'clock P.M. on this date for the purpose of taking such action as the Council may deem advisable upon STRs W.R.R. a petition of Citizens requesting the Council to direct water tax the City Engineer and City Marshall to remove at once any + and all obstructions between the north line of the track of Cemetery and the International and Great Northern Rail Road and the northerly north line of Cypress or third Street between Crocket & Fanning Streets; and also for the purpose of taking such action as the Council may deem proper with reference to repealing certain ordinances with reference to the sale of lots in the Austin City Cemetery. Hume, J.B. Nitschke, H.A. Redd, Mr. Ellit, Joseph Stumpf, J.M. Crooker, J.P. Schneider, Thos Low, P.D. Mortimer, J.M. Maddoo and a true copy of said call left at Mr. Davis' place of business, he being out of the City. J.H. McAnally City Marshall Resolution - By Alderman Maddoo an ordinance amending Ord. entitled “An Ordinance amending Section 3 of an ordinance authorizing the Austin City Cemetery association to establish a Cemetery in the City of Austin” passed March 18th 1895; and re-enacting the provisions of said Section 3 and repealing also an ordinance entitled “An Ordinance to amend an Ordinance entitled An Ordinance regulating Cemeteries within the City of Austin and fixing penalties for the violation of the regulations therein prescribed" passed October 7th 1901 and approved --- Page break --- 649 October 9th 1901. The ordinance was read the first time. Alderman Redd entered the Council Chamber. Alderman Crooker moved to suspend the rule and place the ordinance on its second reading which motion prevailed by the following vote - Yeas Aldermen Crooker, Low, Maddox, Mortimer, Nitschke Redd, Schneider, Shelley, Shumate & Ulit - 10 The ordinance was read the second time and a motion made to suspend the rule and place it on its third reading which motion was lost by the following voteYeas Aldermen Crooker, Low, Maddox, Mortimer, Nitschke, Redd, Schneider, Shumate & Ulit, 9 Nays Alderman Shelley - 1 Alderman Shelley moved to reconsider the vote by which the Council refused to suspend the rule and place the ordinance on its third reading- which motion prevailed. Alderman Crooker moved to suspend the rule and place the ordinance on its third reading which motion prevailed by the following voteYeas Aldermen Crooker, Low, Maddox, Mortimer, Nitschke, Redd, Schneider, Shelley, Shumate & Ulit- 10 Nays none The ordinance was then read the third time & passed by the following voteYeas Aldermen Crooker, Low, Maddox, Mortimer, Nitschke, Redd, Schneider, Shumate & Ulit. 9 Nays Alderman Shelley, 1 J & K. R. R. By Alderman Maddox a resolution directing to wit to the City Engineer to remove obstructions in Iron and Cypress or Third Streets between Crockett and Fannin Streets. The Resolution was passed by the following vote. Yeas Aldermen Crooker, Low, Maddox, Mortimer, Redd, Schneider, Shelley, Shumate, & Ulit 9 Nays Alderman Nitschke 1 On motion of Alderman Shelley the City Clerk was granted a leave of absence for three days beginning on the 21st Inst.
