Austin Water Company Purchase Debated at Council

Water utility acquisition under consideration – The council discussed purchasing the Austin Water, Light & Power Company's plant, with public speakers both supporting and opposing the deal. A vote to move forward was narrowly rejected (6-7).

Multiple budget appropriations passed – The council approved spending for dog catchers ($160), cemetery fence repairs ($948), water and utility payments ($927.70), and street department accounts, all passing unanimously.

Public complaints addressed – Citizens petitioned against allowing the railroad to use steam power near the dam, and a resident requested the city stop allowing horses to be hitched in front of her property.

Tax and property matters resolved – The council approved a property tax reduction request and directed the city attorney to collect unpaid hospital support funds owed by Travis County, with authority to pursue legal action if necessary.

Petitions, Memorials. ett. Pet. etc. Wm E. Krohn By the Mayor communication from Wm E. Krohn Complaining Hitching horses. of horses being hitched in front of her premises and asking in front of that same be discontinued. - Read and on motion referred premises to the Police Committee By Aldermann Schneider Protest of Citizens against the Protest Citizen Passage of an Ordinance allowing the Austin Dam against using and Suburban R.R. to use steam as a motive power Steam in Dam Read and on motion referred to the special Committee R.R. in charge of the ordinance. Alderman Maddox entered the Council Chamber Austin Brick By Aldermann Maddox Petition of the Austin Brick Co Co to open st. asking that a certain street be opened for travel Read and on motion referred to the Street Committee Shute for streets By Aldermann Maddox Petition of H.C. Shute asking that the amount of $135.00 expended by him repairing streets in Hyde Park and the Speedway, be refunded to him. Read and referred to the Street Committee Reports of City Officers Reports City The Mayor laid before the Council the reports of City officers Officers except (the Marshall) for the month of June 1902, which were on motion referred to their appropriate Committees without reading. Reports st. Com. Reports of Standing Committees Alderman Maddox for the Finance Committee to Finance on whom was referred the reports of the Assessor & Collector, Reports ass& the Treasurer and the clerk for the month of May 1902 Coll. presented a report stating that they had been examined and found correct. On motion the report was adopted. Alderman Redd entered the Council Chamber R. A. & on pet. Alderman Low for the Committee on Claims & accounts Hamilton Jones to whom was referred the petition of Mrs Hamilton asking a reduction of Valuation as fixed by the Board of Appraisers presented a report recommending that the petition be granted and the Assessor & Collector directed to issue a receipt for taxes in accordance with the report of the Committee. On motion the Committee report was adopted Alderman Stumpf for the ordinance Committee to whom --- Page break --- Ord. was referred a resolution to order an election for Alderman Election of the 1st Ward. To fill the Vacancy caused by the resignation Alderman of Alderman Gillis, presented a report recommending 1st Ward that the resolution do not pass, for the reason that within the next three months the Vacancy can be filled by the Council, without the expense of an electionOn motion the report of the Committee was adopted. Hospital Alderman Read for the Hospital Committee to whom was referred Physician & Matron the reports of the Physician & Matron for the month of May 1902, presented reports a report stating that said reports had been examined and found correct. On motion the report was adopted. Unfinished business Ord to pay for Alderman Schneider moved that the Council take up and dispose reflooring of an ordinance appropriating the sum of $929.15 to pay for reflooring Colorado River Bridge Colorado River Bridge, which motion prevailed. Alderman Waddy entered the Council Chamber. Alderman Maddox moved to lay the ordinance on the table, which motion prevailed by the following vote laid on table Yeas Aldermen Davis, Low, Maddox, Mortimer, Shelley, Shumate, Stumpf, Truett 8 Nays Aldermen Crooker, Hume, Hetschke, Read, Schneider 5 City Atty Alderman Maddox offered the following resolution, which was instructed read and adopted. to collect from Be it resolved that the City Attorney of the City of Austin that the City Commissioners Council be and he is hereby directed to demand of the County Co. for hospital of Travis County, all moneys due by the County of Travis for the support of the City Hospital from the County and if the County fails to pay the same The City Attorney is directed in the event he fails to collect the amount due from the County, without suit, to bring suit against the County for the amount due. Alderman Stumpf offered the following resolution Res to submit Resolved that the Ordinance introduced at this meeting ord to purchase to purchase the plants of the Austin Water, Light & Power Co. oil water Co and the City Water Company, be submitted to the qualified to people. Voters in the City of Austin who pay taxes upon property, real and personal in said City to ascertain whether they will consent thereto. Said election to be held as provided in the Charter of said City. Be it therefore resolved that the City Attorney be and he is hereby instructed to draw up the necessary ordinance for the holding of said election. Point of Order Alderman Maddox raised the point of order that the resolution was out of order, as the ordinance mentioned in said resolution had not as yet been presented to the Council. Alderman Shumate offered the following resolution which was read and adopted. Sprinkling Be it resolved by the City Council of the City of Austin: resolution That a Certain resolution passed at the last regular meeting rescinded of the Council, instructing the Sanitary Dept to take Charge of and sprinkle Congress avenue and 6th street in Specified Territory, be and the Same is hereby rescinded effective on or before July 20th 1902. Streets The ordinance was read the first time and on motion was referred to the Street Committee. The Mayor laid before the Council the bill of the Austin Water Light & Power Co. for water claimed to have been furnished to June 30, 1902. The bill was on motion referred to the Water Light Committee. Fire hydrants The Mayor laid before the Council a Communication from Cmms & Com the Water Light Commission, enclosing a Communication from the Chief of the A.L. Dept. regarding Fire hydrants. On motion the communications were referred to the City Engineer with instructions to investigate and report. Extra labor By Alderman Nitschke an Ordinance appropriating the Sum of $250. for the purpose of paying for extra labor Street Dept. The ordinance was passed under Suspension of the rules by the following Vote Yeas Alderman Crooken, Davis, Humme, Lowe, Waddell Mortimer, Nitschke, Redd, Schneider, Shelley, Shumate Stumph, Tullis 13 Nays none. Old water Co. On motion of Alderman, the ordinance to provide for the Ord & purchase Purchase of the Water, Light and Power Plant of the Austin Water, Light & Power Company, etc., was taken from the table and placed before the Council. Alderman Waddell moved that Jim Al Willson and others be invited to address the Council. Alderman Davis moved as a substitute that argument be dispensed with. The substitute was lost by the following Vote Yeas Alderman Crooken, Davis, Lowe, Shumate, Tullis 6 Nays Alderman Waddell, Mortimer, Nitschke, Redd, Schneider Shelley, Shumate 7 The motion of Alderman Waddell was then adopted. The Council was then addressed by Hon. A.W. Miller in favor of and Judge D.W. Doom against the passage of the ordinance. Alderman Nitschke moved to suspend the rule and place the ordinance on its second reading, which motion was lost by the following Vote Yeas Alderman Waddell, Mortimer, Nitschke, Redd, Shelley, Shumate 6 Nays Alderman Crooken, Davis, Humme, Lowe, Schneider, Stumph, Tullis 7 On motion the Council adjourned.
