Bribery Charges Over Water Company Purchase

Corruption Allegations Investigated: Council members charged that Alderman Crooker was offered $100 in exchange for voting to purchase the city's water, light, and power plant without a public vote. After investigation, the council found the charges "not sustained."

Water Company Purchase Approved: Despite controversy, the council voted 8-5 to approve purchasing Austin's water, light, and power plant from the old water company, with the matter not submitted to taxpayers as some members wanted.

Suburban Railroad Proposal Rejected: Council rejected an ordinance that would have allowed the Austin Dam Suburban Railroad to operate using electricity or steam.

Minor Infrastructure Funding: Council approved small appropriations for street repairs ($250 for extra labor) and repairs to the South Austin Fire Hall ($25).

Regular meeting of the City Council Austin Texas, August 04, 1902 Hon R.E. White, Mayor presiding Roll Called Present Aldermen Crooker, Davis, Hume, Love, Maddox, Mortiman Nitsenke, Schneider, Shelley, Shumate, Stumpf, White – 12 Absent Alderman Redd – 1 On motion the minutes were approved as recorded by the clerk, without reading. Memorials, Petitions etc. Pet-tins By Alderman Shumate, petition of Mrs J. Davis, asking the J.V. Davis Council to purchase a roadway through her premises in South Austin. for Street Read and on motion referred to the Street Committee. Alderman Redd entered the Council Chamber. Reports of City officers Officers The mayor laid before the Council the reports of City officers reports for the month of July 1902 (except that of the Marshal) which were on motion referred to their appropriate Committees without reading. Reports of Standing Committees Finance Com Alderman Maddox for the Finance Committee to whom was report referred the reports of the Assessor & Collector, the Treasurer and City officers the Clerk for the month of June 1902, presented a report stating they had examined same and found them Correct. The report of the Committee was adopted. Alderman Stumpf, one of the Ordinance Committee to Ordinance whom was referred an ordinance To Provide for the purchase Com on of the water, light & power plant of the Austin Water, Light purchase old & Power Company, presented a report recommending the Water Co. passage of the ordinance with an Amendment submitting plant the matter to a vote of the Taxpaying Citizens. Alderman Maddox, one of the said Committee presented a report recommending that the passage of the ordinance and further that it be not submitted to a vote of the people. The report of Alderman Stumpf was designated as report No 1 and that of Alderman Maddox as report No 2. Alderman Stumpf moved the adoption of report No 1. Alderman Maddox moved as a substitute for the motion of Alderman Stumpf to substitute report No 2. The foregoing change is made by Aldermen Stumpf & Hume were read. Pease One hundred dollars for a quit-claim deed to a Certain piece of property if he would make execute and deliver a quit-claim deed to such property it being a piece of land which had been sold under execution and purchased by L. M. Crooker, and also Vote for the passage of said Ordinance; that prior thereto the said Alderman Crooker advised both of us that he was going to Vote to Submit said ordinance to a Vote of the Taxpayers and after said offer was made to him he announced to us his determination to Vote for said ordinance without submitting it to a Vote of the Taxpayers. Joseph Stumpff J. L. Hume. Alderman Waddas moved that the Council now proceed to investigate the charges preferred by Alderman Stumpff & Hume. Alderman Schneider moved as a Substitute that the whole matter be laid over until the next regular meeting of the Council, and that a Committee be appointed to investigate the charges as preferred by Alderman Stumpff & Hume – which motion was lost by the following Vote. Yeas Aldermen. Hume, Low, Schneider Nays Aldermen Crooker, Davis, Waddas, Mortimen, Hibschke, Redd, Committee to Shelley, Shumate, Stumpff, Tulich- 10 Investigate Alderman Mortimen moved that the Council go into charges Committee of the whole for the purpose of considering the charges preferred by Alderman Stumpff & Hume which motion prevailed by the following Vote. Yeas Aldermen Crooker, Davis, Hibbs. Low, Waddas, Mortimen, Hibschke, Redd, Shelley, Shumate, Stumpff, Tulich 12 Nays Alderman Schneider. 1 Alderman Shelley, President of the Council in the Chair. The charges were read! Alderman Davis moved that further action be postponed until the next regular meeting of the Council, or until a special meeting of the same should be Called to Consider said charges Lost. Alderman Crooker made a Statement to the Council. Mr. Buroggerhoff was invited to make a statement, which he declined to do. Alderman Johnson moved to adjourn charges not Alderman Waddas moved that the Committee rise and sustained. report back to the Council, that the charges preferred by Aldermen Stumpff & Hume were not sustained, which motion prevailed by the following Vote Yeas Aldermen Waddas, Mortimen, Hibschke, Redd, Shelley, Shumate, Tulich- 7 Nays Aldermen Davis, Hume, Low, Schneider, Stumpff 5 Not Voting, Alderman Crooker. 1 Mayor White resumed the Chair. --- Page break --- A Alderman, reported that the Committee of Report #2 the whole had under consideration the Charges made adopted by Alderman Strumff, and, that he was directed to report to the Council that after investigation they had decided that the charges were not Sustained. Alderman Maddox renewed his motion to Substitute report No 2 for report No 1, which motion prevailed by the following vote Yeas Alderman Crocken Maddox Mortiman Nitschke Redd Shelley Shumate Tuleh 8 Nays Alderman Brooks Davis Hume Low Schneider Strumff 5 Alderman Schneider moved to amend the report by adding thereto "provided that the matter be submitted to the Vote of the people." Alderman Maddox raised a point of order, against the amendment stating that a similar amendment had already been voted upon and defeated. Suburban The Mayor laid before the Council an ordinance granting An Ordinance the Austin Dam Suburban R.R.Co the right to operate its Killed railroad by electricity or steam, upon Certain Conditions, together with the majority and minority reports of the Ordinance and Street Committees on same. Alderman Maddox moved the adoption of the minority report, which recommends that the ordinance do not pass, which motion prevailed by the following Vote Yeas Alderman Maddox Mortiman Nitschke Redd Schneider Shelley Shumate Tuleh 8 Nays Alderman Crocken Davis Hume Strumff 4 Alderman Schneider moved to reconsider the vote by which the Council adopted the minority report, and to lay the motion to reconsider on the table, which motion prevailed. Zillmanth On Motion of Alderman Shelley, leave of absence was Svc. leave granted Assistant Assessor-Collector Zillen for two weeks, Commencing on the 10th Inst. City Atty Brooks On Motion by Attorney Brooks was granted a leave of Leave Absence from Aug 15th to Sept 20th 1902. On Motion Alderman Schneider was excused from further attendance at this Session of the Council. Atty for City Judge Doom for the Attorneys for the City in the Case of in case of Bartholomew Reciever vs the City of Austin stated that any Bartholomew had succeeded in having bills of exceptions etc; approved City asked for by the Judge, and asked for further instructions as to what they instructions should do in the Case, now that the City had determined to purchase the plant of the old water Company. On motion the Attorneys were directed to proceed with the Case and to perfect the appeal. On motion the Council adjourned. Jno Johnson City- Clerk.
