White, Mayor presiding Roll called- Present Aldermen Crooken, Davis, Low, Maddox, Mortimer, Nitschke, Schneider, Shelley, Shumate, Wulff. 11 Absent Aldermen Hume & Stumpff. 2 On motion the minutes were approved as recorded by the Clerk, without reading. Petitions, memorials, &c. By Alderman Crooken- Petition of Halgren, Lundale for Halgren & permission to put in a wagon scale on 15th Street, between Lundale Lavaca & Colorado. On motion the petition was granted. wagonscale By the Mayor- Petition of I. Hall asking that certain pound I Hall fees paid by him be refunded. Read and on motion Pound fees. referred to the Committee on Claims & accounts. Reports of City Officers Semi-annual The Mayor laid before the Council the semi-annual report of Chief report of the Chief of the Fire Dept. which was read. Fire Dept On motion of Alderman Maddox Wm. W. Harrison Porter for the City Hall was granted a leave of absence for two weeks, on account of sickness in his family. Reports of Standing Committees Finance in Alderman Maddox, for the Finance Committee to whom was J.C. Pearce referred the petition of J.C. Pearce et al, asking a correction of Assessment Alderman for taxes for the year 1901, presented a report recommending that the petition be granted in so far as Same relates to Lot 10 and the east half of Lot 11, in Block N 105 The report of the Committee was adopted. Cemetery Alderman Wulff, for the Cemetery Committee to whom was Sextons report referred the report of the City Sexton for the month of August 1902 presented a report stating that same had been examined and found correct. The report of the Committee was adopted. Hospital Alderman Redd, for the Hospital Committee to whom was Physicians referred the report of the City Physician for the month of report August 1902, presented a report stating that same had been examined and found correct. & aono Alderman Schneider stated to the Council, that some time past- since the Council adopted a report made by the Committee &Hamilton on claims and accounts, upon a petition of L. P. Hamilton appealing reconsidered from the action of the Board of Equalization, which report sustained Report not the appeal and directed the Assessor & Collector, to make the adopted necessary correction and to issue tax receipt in accordance therewith. Alderman Schneider then presented and had read an opinion from the City Attorney, in which he advises the Assessor & Collector that the Council had no authority to alter valuations on the Tax rolls when same had been regularly and legally fixed by the Board of Equalization Alderman Schneider stated that the Assessor & Collector derived further instruction from the Council as to his duty in the premises Alderman Maddox moved to reconsider the vote by which the Council at a former meeting adopted the report of the Committee on claims and accounts, when the petition of L. P. Hamilton in which he appeals from the action of the Board of Equalization which motion prevailed Alderman Davis moved to reconsider the petition to the Committee on claims and accounts, which motion was lost by the following Vote Yeas Aldermen Brooker Maddox Mortimer Schneider Wilt 5 Nays Aldermen Davis Low Nitschke Redd Shelley Shumate 6. As at the request of the Police Dept. he stated that the Committee would like some instructions from the Council in regard to these claims - On motion the claims were referred to the Committee on Claims & accounts. Alderman Shumate called attention to the fact that at a former Committee meeting of the Council a resolution had been passed authorizing to entertain the Mayor to appoint a Committee consisting of three Aldermen Admiral and two Citizens to make the necessary arrangements for the Schley entertainment of Admiral W.S. Schley upon the occasion of his visit to this City, and asked that the Mayor appoint said Committee. The Mayor appointed Aldermen Shumate, Shelley & Low on the part of the Council and stated that he would announce the appointment of the Citizens Committee at a later date. buying towers Aldeman Davis stated that the Council several months fire station since had passed an ordinance authorizing the Mayor to contract for the erection of buying towers at the different hose houses and stated he would like to know of the City Engineer what action had been taken. City Engineer Sneed stated that the contract for the work had been let to run & O & Ostons but as yet he had not begun work waiting for iron, which had been ordered some time since. On motion the City Engineer was directed to call upon run Houston and insist upon his complying with his contract. Alderman Wirtzke offered the following resolution which was read and adopted. Resolution Whereas the City Council of the City of Austin by action Transfer regularly taken on March 17th 1902, accepted a certain Street to offer of D.R. Stephenson whereby the said Chas.Stephenson Stephenson offered to Convey to the City fifty feet off Hellman and addition to the City of Austin, Texas, said fifty (50) feet extending along the North side of said Block 53 from Waller Creek to Trinity Street! if the said City would convey to the said Stephenson that part of Raymond Street lying between Blocks 53 and 38 Division "B", said City, and extending from the west side of Trinity Street between said Blocks 53 and 38, west, down to Waller Creek, said addition; Therefore, Be it resolved by the City Council of the City of Austin, that the Mayor of the City be, and he is hereby authorized to execute on behalf of said City the necessary Conveyance to make said agreement effective! Upon the execution and delivery to said Mayor as the Agent of the City, of a deed in proper form, to Convey to the City title to the property described in and offered to the City in the proposition of the said Stephenson.
