Were appointed as the special Committee The Mayor laid before the Council a petition from Citizens of the of 1st Ward of the City, asking the Council to elect Mr. J.M. Crawford to the position of Alderman from said ward to fill the Vacancy Caused by the resignation of Alderman J.F. Ellis. Alderman Redd presented a petition from Citizens of said ward asking that Mr. V.S. Miller be elected as Alderman from said Ward to fill said Vacancy. City Attorney Brooks was called upon for his opinion as to the authority of the Council to fill the Vacancy by an election by the Council. He stated that the Council was without authority to elect, the Vacancy having occurred more than six months before the general election Messrs. Sullivan and Dennis, Citizens of the first Ward upon invitation addressed the Council. After which the petitions were both withdrawn. Reports of City Officers Reports City The Mayor laid before the Council the reports of City Officers for Officers the month of Sept 1902, which were on motion referred to their appropriate Committees without reading. Reports of Standing Committees Rept Street Alderman Nitschke for the Street Committee to whom was Committee referred the petition of Fred Vonkuenning, asking that certain street Vonkuenning work be done, presented a report stating that the work had already been done. On motion the report was adopted. Rept Robt. Alderman Nitschke for the Street Committee to whom was Phillips for referred the petition of Robt Phillips for damages, presented a damages. report, stating that they had given the matter careful attention and from all the evidence they thought that Mr Phillips had sustained serious damages, and that they had received a proposition from him to accept $500.- as his damages$200.- of which was to be paid in cash and the remaining $300.- to be paid on or after Jany 1st 1903, which proposition they recommended the Council to accept. Therefunt of the Committee was adopted. Sidewalk Alderman Nitschke for the Street Committee to whom was ordinance referred an Ordinance providing for a system of side walks for the City, presented a report stating that they had, had the same under consideration, and recommended the passage of a substitute offered for same by the Committee. On motion the report was laid over to be taken up under the head of New Business. New Alderman Nitschke for the Street Committee to whom was Ordinance referred an Ordinance requiring the removal of ables from certain streets in the City - Presented a report and submitting a substitute for said ordinance. and recommending the passage of the substitute. On motion the report, with the substitute offered by the Committee, were laid over to come up under the head of New Business.

714 Finance Alderman Waddas for the Finance Committee to whom was officers. reports referred the reports of the Assessor and Collector, the Treasurer, and the Clerk for the month of August 1902, presented a report stating that they had been examined and found correct. On motion the report of the Committee was adopted. Ex. a. on bills Alderman Dow for the Committee on claims and accounts on Hacks & St. Aigler to whom was referred the bills of Drs J. B. Hill and St. Aigler for Medical services rendered paupers, presented a report recommending that they be paid. Cemetery Alderman Welk for the Cemetery Committee to whom was Burial Bds referred a resolution instructing the Cemetery Committee Paupers. to inquire into the advisability of procuring burial grounds for Colored Paupers, presented a report recommending that the Purchasing Committee advertise for bids for burial of Colored Paupers, and that the matter of purchasing grounds for that purpose be deferred for the present. On Motion the report of the Committee was adopted Purchasing an Alderman Shumate for the Purchasing Committee reported that Hauling Paupers. they had advertised for and received bids for hauling paupers to the City Hospital, and a majority of said Committee recommended the acceptance of the bid of V.O. Huff at 50¢ where the party was able to sit up and ride and at $1.50 where an Ambulance was used. A Minority of the Committee was in favor of rejecting all bids Alderman Davis moved to adopt the Majority Report, which motion prevailed New business Supt. Thompson By Alderman Waddas. An Ordinance appropriating the sum Bonding of $70.00 for the purpose of paying additional salary allowed Supt. Thompson! The ordinance was read the first time and a motion made to suspend the rule and place it on its second reading, which motion was lost by the following Vote Yeas Alderman Brooken Davis Howe Low Mortimer Wischka Redd Shelley Tulch 9 Nays Alderman Waddas, Alderman Shumate 3 Salaries By Alderman Waddas. Ennonment Alderman Maddax offered the following resolution which Sum Harlan was read and adopted. supt. Pub.Bldgs. Whereas the Honorable Samuel Harlan of Austin, is an applicant for the position of Superintendent of Public Buildings and grounds. And whereas he is well known to the citizens of Austin as thoroughly competent to fill that position and has filled it for several years with credit to himself and has succeeded as none of his predecessors have done in adorning and beautifying the Capitol grounds and thereby greatly improving the appearance of our City. Now, therefore, be it resolved by the City Council of the City of Austin that they most heartily recommend him for said position to the favorable Consideration of the honorable.

4th, 5th, 7th, 8th, 9th, 10th and South side of 11th streets, 10 feet on each side. On all other streets, as follows, Viz: On streets 25 to 30 feet wide, a walk of three feet on each side. On streets 30 to 40 feet wide, a walk of 5 feet on each side; On streets 40 to 50 feet wide, a walk of 6 feet on each side; On streets 50 to 60 feet wide, a walk of 10 feet on each side; And on all streets not otherwise provided for which are 60 feet wide and over, one fourth of the distance between property lines shall be set off on each side of the streets for side walks and grass plats - leaving one half of the distance for passages of Vehicles; and on such Vehicle passage ways, there shall be no poles, trees or other obstructions, except street car poles in centre of Congress Avenue. Section 2. That in the execution of all future street improvement, the rules hereinbefore prescribed, shall be strictly observed; and all ordinances, and parts of ordinances in any wise Conflicting herewith, are hereby repealed. The Mayor then laid before the Council the report of the Street Committee upon an ordinance requiring the removal of poles from certain streets of the City; together with a substitute for said ordinance, submitted by the Committee with their report. The substitute was read and on motion was adopted in lieu of the original ordinance. Alderman Schneider moved that the matter be Postponed until the next regular meeting and that the ordinance be published in the Printed proceeding of the Council which motion prevailed. The following is the ordinance An ordinance Pole ordinance An ordinance requiring the removal of poles from certain streets of the City of Austin. Be it ordained by the City Council of the City of Austin: Section 1. That all Telegraph, Telephone, Electric light, Trolley, or other poles for the support of wires at present erected on situated on Congress Avenue from First street to Eleventh street and on each street from Guadalupe street to East Avenue, shall be removed from time to time as may be directed by the City Engineer and Street Committee, but no order shall be given for the removal of said poles by said Engineer and street Committee until thirty days before permanent work is begun on the streets from which said poles are directed to be removed; and, provided, that the street Car Companies may construct iron bracket poles between main track poles shades and of such construction as may be provided by said Engineer and Street Committee. Section 2. The City of Austin hereby reserves the right to cut wires on the poles which are placed in the streets, under the terms of this ordinance.
