To the Hon Mayor and City Council & Oct 18th 1902 of the City of Austin Report Gentlemen: City Atty In accordance with the direction of a resolution Claim of your body, I have negotiated with the County Judge and against Co members of the Commissioners Court of Travis County Hospital for the purpose of reaching, if possible, a settlement of a claim of the City against the County for money alleged to be due the City for maintaining and operating the City and County Hospital The result of such negotiations is that the County refuses to pay any part of the claim mentioned, while its claim against the City for repairs to the Congress avenue bridge across the Colorado River and for alleged repairs to the approaches of said bridge is still on. In accordance with the further direction of said resolution, I have drawn and am ready to file a petition in proper form such against the County on claim first above mentioned. On motion the report and recommendation of the Committee was adopted. Unfinished Business side walk The Mayor laid before the Council an ordinance providing for ordinance a system of side walks of the City of Austin, together with the report of the Streets Committee on same and a substitute ordinance offered by the Committee. Alderman Nitschke moved to adopt the substitute offered by the Committee in lieu of the original ordinance, which motion prevailed. The substitute was read for information. Alderman Weiser moved to suspend the rule and place the ordinance on its second reading, which motion was lost by the following vote: Yeas Aldermen Crooken, Low, Maddas, Mortimer, Nitschke, Redd, Shelley, Shumate, Tulich 9 Bole ordinance Nays Alderman Schneider, Stumpp 2 The Mayor laid before the Council an ordinance regulating the removal of poles from certain streets in the City of Austin. Alderman Maddas moved to amend the ordinance by striking out the words "first street" and inserting in lieu thereof the words "Colorado river" which amendment was adopted. Alderman Schneider moved to amend by adding after the last word in section 2, the following, Viz: "Provided nothing in this ordinance shall be construed as preventing the Council from ordering the removal of poles from any street, under any circumstances where it would have that right without the passage of this ordinance." The amendment was adopted. On motion of Alderman Schneider the Call was suspended Alderman Madday moved to suspend the regular order of business and take up a report from the Mayor, Treasurer and Finance Committee, which motion prevailed. Alderman Madday presented the following report from the Mayor and Finance Committee. To the City Council of the City of Austin: Report of Mayor The the Mayor and Finance Committee of the City of Austin, Treasurer & Texas, beg leave to report that we, with the City Treasurer, have Finance Com. from time to time exchanged Refunding bonds of the City exchange of of Austin, for Water and Light bonds and Funding bonds bonds. of the City of Austin the number of said old bonds funded, and the number issued in lieu thereof as shown on the tabulated statement of Hon A. P. Hilliard City Treasurer hereto attached and made a part hereof. The bonds exchanged are as follows. The resolutions were read and adopted Alderman Nitschke moved to reconsider the vote by which the Council, at the last meeting, passed an ordinance Pole ordinance requiring the removal of poles from certain streets of the Cityreconsidered. Which motion prevailed Alderman Nitschke moved to amend the ordinance by adding after word "and" in line 3. the following, "Viz all such poles except trolley poles on Rail roads situated."
