Austin Builds Sidewalks, Fire Company Dispute

Sidewalk System Approved: The city council passed an ordinance establishing a comprehensive sidewalk system for Austin after debate and a close 7-6 vote, marking a significant infrastructure investment for the growing city.

Fire Company Merger Rejected: After a contentious debate that required the marshal to seat two aldermen for using inappropriate language, the council tabled a petition from West Austin Fire Company seeking to merge with the city's fire department, referring it back to the fire commissioners.

Cemetery and Street Repairs Funded: The council appropriated $500 for cemetery repairs and approved $250 for extra labor and teams needed for street maintenance and improvements.

City Treasurer Resigns, Replaced: Long-time City Treasurer H.P. Hilliard resigned effective immediately due to a business engagement, and William H. Holts was unanimously elected as his successor.

726 Regular Meeting of the City Council Austin Texas. November 03, 1902 - Hon A.P. White, Mayor, Presiding Roll Called Present Aldermen Crocker Davis Dunnewold Gladdas Kistner Aedd Shelley Shummate Stumpf West Absent Aldermen Mortimer Schneider On motion the minutes were approved as recorded by the Clerk without reading. Petitions, Memorials etc. Get Briskill By Alderman Shelley Petition of Irvin Daniel Manager of the Hotel to put Briskill Hotel, asking permission to put in a line of pipe in pipe in alley running west of the Hotel and to the WATERdepartAlley On motion the petition was granted Reports of City Officers Reports City The Mayor laid before the Council the reports of the City Officers Officers (except that of the Marshal) for the month of Oct 1902 which were on motion referred to their appropriate Committees, without reading Reports of Standing Committees Report finance Alderman Waldar for the Finance Committee to whom Com. off report was referred the reports of the Assessor & Collector, Clerk and Treasurer for the month of Sept 1902, Presented a reportstating that they had examined same and found them correct – The report of the Committee was adopted Police Rest Alderman Shelley for the Police Committee to whom was Pound Master referred a resolution authorizing the City Marshal to employ an Assistant Pound Master, presented a report recommen-ding that the resolution do not pass. The report was adopted W. A. B. Jones Alderman Lown for the Committee on Claims & accounts to whom Taxes was referred the petition of Ben. B. Jones Sr. asking that the Council remit interest & penalty on taxes for the 1899, presented a report stating that the Council was without authority to grant the request. The report was adopted. Cora. M. Whitten Alderman Lown for the Claims & accounts Committee to whom Taxes was referred the petition of Mrs A.S. Whitten asking for correction of Assessment for the year 1902, presented a report recommending that the petition be granted and that the assessor & Collector be directed to change his roll and issue a receipt in accordance with the request. The report was adopted Era Phiers Alderman Lown for the Claims & accounts Committee to whom Taxes was referred the Petition of Jno. H. Chiles appealing from the action of the Board of Equalization, presented a report stating that the Council was without authority to grant the petition. The report was adopted Eva Diviser Alderman Lown for the Claims & accounts Committee to P. M. Sham [illegible] whom was referred the petition of Henry Sham & Schapairis Asking & have certain pound fees paid to them refunded --- Page break --- 727 presented a report returning the petitions with the recommendation "davins of the Mayor that they be granted- The report was adopted. Alderman Schneider entered the Council Chamber. Cemetery Alderman Veith for the Cemetery Committee to whom Sexton report was referred the report of the City Sexton for the month of Sept 1902, presented a report stating that same had been examined and found Correct- The report was adopted. Sanitary claim Alderman Snow for the Sanitary Committee to whom was ag. May's Co referred the claim of A. J. Ways for damages, presented a report recommending that the claim be allowedThe report was adopted. Hospital reports Alderman Reed for the Hospital Committee to whom was Physician and referred the reports of the City Physician and Matron of the Matron Hospital for the month of Sept. 1902, presented a report stating that same had been examined and found CorrectThe report was adopted. No Fire Comms The Mayor laid before the Council the reports of the Board of Cabiners & Fire Commissioners upon the application of Chas. Cabiness & Gains, building Geo. Gaines asking permission to erect certain buildings within permits the five limits, which were not in accordance with the ordinance on the subject. They recommend that the applications be not granted. On motion the reports were adopted. N. Fire Com The Mayor laid before the Council the report of the Board of West Austin Fire Commissioners upon the application of the West Austin Fire Co Fire Company for permission to become a part of the Austin Fire Dept. recommending that the petition be not granted. On motion the report was laid on the table to come up with the report of the Committee on the part of the Council on the same petition. Alderman Mortimer entered the Council Chamber. W. Austin Alderman Stumme for the Special Committee on the part Fire Co of the Council to whom was referred the petition of the West Austin Fire Company for permission to become a part of the Austin Fire Dept. presented a report recommending that the petition be granted. Alderman Stumpf moved to adopt the report of the Board of Fire Commissioners. Alderman Shelley moved as a substitute to adopt the report Mortimer of the Committee on the part of the Council. Schneider After considerable discussion, in which language was Apologize to used by Alderman Mortimer & Schneider which was Council objected to by Alderman Maddox as unparliamentary and both of the Aldermen were on motion directed to be seated by the Marshal and required to apologize to the Council for the language used. The Ordinance was read the second time, and a motion made to suspend the rules and place it on its second reading, was lost by the following Vote Yeas Aldermen Brovken Dowd Low Mortimer Nitsche Reed Shelley Shumate Stumpf Nays Aldermen Huns Maddox Schneider Shumate Stumpf Teidt Bolo ordinance The Mayor laid before the Council an Ordinance requiring, postponed the removal of poles from Certain streets in the City with an Amendment offered by Ald.man Nitsche On motion further Consideration of the ordinance was postponed until the next regular meeting of the Council New business Ordinance to By Alderman Maddox An ordinance providing for the Vacate street Vacation of that portion of Sabine Street, embraced Blind Asylum between 18th & 19th Streets etc. The ordinance was read the first time and on motion was laid over until the next regular meeting of the Council, and was ordered printed in the Minutes The following is the ordinance An Ordinance Providing for the Vacating of that portion of Sabine Street embraced between 18th & 19th Streets, and prescribing the terms of such provision Be it ordained by the City Council of the City of Austin! That that portion of Sabine Street embraced between Blocks 67 and 71. And between 18th & 19th Streets, City of Austin be and is hereby Vacated, and the Board of Trustees of the State Blind Asylum are hereby granted as against the City of Austin the right to enclose use, and erect buildings on said portion of said Street: Provided however this ordinance shall not become effective for any purpose until said board of Trustees shall have repaired and put in good condition for travel that portion of Red River Street embraced between 18th & 19th Street to the satisfaction of the City Engineer and Street Committee which satisfaction shall be evidenced by a statement in writing to that effect to be filed with the City Clerk. Austin Texas Nov. 3. 1902 To the Hon R. E. White, Mayor, and the City Council of the City of Austin Gentlemen: Hilliard I hand you herewith my monthly report City Treas. showing the condition of my accounts with the City of Austin resignation up to date. In submitting this report, I beg to advise you that it is the last which I shall probably submit and I cannot pass over this opportunity to thank you for the many acts of courtesy extended to me during my incumbency as City Treasurer. A business engagement will necessitate my removal from Austin and I hereby and herewith tender my resignation as Treasurer of the City of Austin effective tonight begging for you in your individual capacity, and for you as representatives of the city which for some years has been my home, and wishing for that city the peace and prosperity which you have labored so hard to secure for it; I beg you to believe me Sincerely Yours. H. P. Hilliard Hilliard Alderman Waddow moved that the resignation of City resignation Treasurer Hilliard be accepted and that a Committee of accepted three Aldermen, together with the Mayor and City Attorney be appointed to check up his accounts and to turn over the office to his successor, which motion prevailed. The Mayor appointed Aldermen Waddow Shelley and Hume as such Committee Alderman Shelley offered the following resolution which was read and adopted unanimously by a rising vote. Resolution Be it resolved by the City Council of the City of Austin re: resignation That in accepting the resignation of the Hon H. P. Hilliard as of Hilliard City Treasurer of the City of Austin this body deems it proper to express its appreciation of the high standard of business ability and personal integrity which Mr. Hilliard has brought to the discharge of the duties of his official position: And we hereby express the deep regret which we feel at the loss which the City sustains from his resignation Be it further resolved that in his removal to his new field --- Page break --- 780 of business and usefulness our City looses not only a valuable officer but a useful and esteemed Citizen; and we hereby tender him our sincere good wishes both for this body and the entire Citizenship of the City of Austin for his future success and happiness. Be it resolved further that the Clerk of this Council be instructed to send an engrossed Copy of these resolutions to Mr. Hilliard. Alderman Maddow moved that the Council now proceed to the election of a City Treasurer to fill the vacancy caused Mr. Holts elected City Treasurer. by the resignation of Treasurer Hilliard, which motion prevailed. The Mayor declared nominations for City Treasurer to fill out the term of Treasurer Hilliard, now in order. Alderman Shelley nominated William H Holts Alderman Davis moved that nominations close, and that the clerk be directed to Cast the entire Vote of the Council for William H Holts, which motion prevailed. The clerk Cast 13 Votes for William H Holts for City Treasurer and the Mayor declared him duly elected as City Treasurer of the City of Austin, to fill out the term of Mr Hilliard resigned. $250. for extra labor By Alderman Wilks An ordinance appropriating. the sum of $250, for the purpose of paying for extra labor and teams. The ordinance was passed under suspension of the rules by the following Vote Yeas Alderman Crooker Davis Horne Low Maddow Mortimer Wilks Cooke Redd Schneider Shelley Shumate Wardman Welch 13 Plans for Storm Sewers Engineer to prepare & submit Alderman Shumate offered the following resolution which was read and adopted. Be it resolved by the City Council of the City of Austin, that the City Engineer be and is hereby instructed to prepare and present to the Council at its next regular meeting final plans for Contemplated Storm sewers and permanent street improvements The resolution was adopted - Order to adopt Alderman Mortimer moved that the Council adopt the profile grade and heretofore submitted to the Council by the City Engineer, which motion prevailed On motion the Council adjourned Jas.
