87 Regular meeting of the City Council Austin Texas, Sept 21st, 1903 Hon R.E. White Mayor, presiding Roll Called Present Aldermen Crooken, Haynes, Hume, Macken Madden, Moore, Nitschke, Redd, Schneider, Shelley Shumate, Smith, Thiele Absent Alderman Miller On motion the minutes were approved as recorded by the Clerk, without reading.
Report marshal The reports of the City Officers City, Marshal for the month of August 1903, which was on motion referred to the Committee on Police Standing Committees Reports of Standing Committees Shumate Parks. Alderman Shumate for the Committee on Parks to Bill Carleton & whom was referred a bill of Carleton & Ellingson for Ellingson work done at Peace Park, presented a report recommending that the bill be allowed & paid. On motion the report was adopted. Claims & accounts Alderman Haynes for the Committee on claims and Pcts Treece & accounts to whom was referred the petitions of Murray for salary Frank Treece and Anderson Murray for pay while they presented reports recommending that the petitions be not granted. On motion the reports were adopted. Alderman Miller entered the Council Chamber Unfinished business The Mayor laid before the Council the following Veto Message Special Message. To the Hon City Council. I return herewith an ordinance entitled "An Ordinance appropriating the sum of $530.00 for the purpose of paying for extra street labor teams and laborers to 12th Street between Rio Grande and Placed Streets, passed Sept 8, 1903, without my approval. My reason for vetoing the above styled ordinance is the fact that the vote on the final passage of said ordinance was seven for and six against the passage of the ordinance. Section 13 of the Charter of the City of Austin provides "that a majority of the members of the whole Council shall be necessary to pass an ordinance for any purpose appropriating the sum of five hundred dollars or upwards." The whole Council being composed of fourteen members,- under the foregoing Charter provision, it requires more than seven votes to legally pass the said ordinance. Sep 9/03 R.E. White Mayor

Alderman Nitschke Chairman of the Street Committee Street Com. on stated that the Committee had received the plans and Plans Sewer. specifications for the Proposed Storm Sewer into they desired to have them before placing them before the Council - That they would be presented at the next regular Meeting, and that in the meanwhile the matter of said plans specifications would be here to explain them, He further stated that the said plans specifications would be filed with the City Clerk in a few days where they could be seen by any one desiring to see them Resolution. Alderman Shumate presented the following Monumental Resolution which was read and adopted. Fountain Resolved that a Committee of three be appointed for Dylehart by the Mayor to Confer with Mrs O.P. Dylehart and ascertain her desires respecting the erection of a Monumental Water fountain which she proposes to erect in memory of her deceased husband, reporting the result of such Conference to this Council for its further action. The Mayor appointed Aldermen Shumate Macken and Moore as such Committee $150. 90 J & S N. Ry to take up Dummy line track Alderman Shumate offered the following resolution which was read and adopted Resolved that the Street Committee be instructed to direct the J & S N. Ry Co. to at once remove the Dummy line track from East 4th street to the Northern terminus of Said line - placing such streets as it traverses in such condition as is provided for in charter of Said J & S N Ry Co. Alderman Haynes moved that an Instrument belonging to the City be forwarded to the maker of Acheson for repairs, which motion prevailed. On motion the Council adjourned Jach Johnson City Clerk.
