Police resignation and staffing changes: A city policeman submitted his resignation and was replaced; the council also voted to terminate the dog catcher position, reducing that salary budget from $160 to $120

Segregation ordinance proposed: Alderman Shelley introduced a controversial ordinance requiring Austin's street railway companies to provide separate coaches for white and Black passengers, referred to the Police Committee and City Attorney for review

Street improvement projects approved: Council authorized multiple street infrastructure projects including repairs to W. 12th Street ($150), a drainage ditch on Corral Street ($94.50), and a fire hydrant for the Austin Electric Railroad Company

Gas plant franchise petition: A request from Cox & Goedgen for a gas plant franchise was referred to the Water and Light Commission for review

Minor financial approvals: Various small expenditures were approved, including a $50 land purchase for street purposes and a $17 refund to a citizen for an erroneous payment

92 Regular Meeting of the City Council Austin, Texas, October 05, 1903 Hon R. G. White, Mayor, presiding Roll Called Present Aldermen Croviken Haynes Howe Waaken Maddox Miller, Moore, Red & Schneider, Shelley, Shumate, Snook White Absent Alderman Nitschke 13 On motion the minutes were approved as recorded without reading Petitions etc. Petitions, The Mayor laid before the Council a petition from Cox & Goedgen for W. L. Goedgen asking a franchise for a Gas Plant Gas franchise Read and on motion referred to the water and Light Commission Citizen first street By the Mayor Petition of Citizens first street work on W. work W. 14th St. 14th Street. Read and on motion referred to the Street Committee Lieut Oglebay for By the Mayor Petition of Lieut Oglebay asking use of hall for permission to use a part of the Hall in Heard Armory Artillery Hall for an armory for the Austin Co. Light Artillery Co. Read and on motion referred to the market Committee, City Engineer Reports of City officials Reports City Officers The Mayor laid before the Council the reports of City officers, except that of the Marshal, for the month of Sept 1903, which were on motion referred to their appropriate Committees, without reading Reports Standing Committee Reports of Standing Committees Schneider for finance Alderman Schneider for the Finance Committee to Reports City officers whom was referred the reports of the Assessor and Collector for the Treasurer and the Clerk for the months of June, July & Aug 1903, presented a report stating that they had been examined and found correct. On motion the report was adopted. Shelley, Reports of Alderman Shelley for the Police Committee, to Marshal whom was referred the reports of the City Marshal for the months of Dec 1902, Feby, March, April, May, June, July & Aug 1903, presented a report stating that they had been examined and found correct. On motion the report was adopted. Whitt report Cim Committee Alderman Whitt for the Cemetery Committee to whom was referred the report of the City Sexton for the month of Aug 1903. presented a report stating that it had been examined and found correct On motion the report was adopted. Unfinished business The Mayor laid before the Council an Ordinance Ordinance Street appropriating the Sum of $150.00 for the purpose of Coro 12th St repairing W. 12th Street from Rio Grande to Blanca st The ordinance was read the Second time and on Motion was laid on the table, Subject to Call. New business On Motion of Aldenman Crocker Mr. Elleyer Elleyer addressed was permited to address the Council on the subject Council of street improvements Aldenman Moore offered the following resolution which was read and adopted. Resolution N. T. & T. Be it resolved by the City Council of the City of Austin I. & S. N. R. R. to grade that the City Engineer is hereby ordered to have Street the N.T. & T. and I & G. N. R. R. Cos grade their tracks where they Cross Congress Ave so as to make Said Street passable at Said points. The Mayor laid before the Council the following Communication Austin, Texas, October 5, 1903 Resignation of Hon R. C. Whalley Mayor, and Harry Montgomery, City Policeman Owens. Marshal of the City of Austin Texas. Gentlemen: I hereby tender to, my resignation to you, resigning the position of Austin by Policeman of the City of Austin and respectfully ask that the Same be accepted. Very Respectfully, W. H. Owens. accepted On Motion the resignation was accepted. The Mayor laid before the Council a Communication communication from from the City Engineer, suggesting certain street City Engineer Street improvements. Read and on motion referred to Work the Street Committee. Aldenman Nitschke entered the Council Chamber. Aldenman Waddox Called to the table an ordinance B. S. S. – W. 12th appropriating the sum of $150.00 for the purpose of repairing W 12th Street from Rio Grande to Blanca Streets A Motion was then made to Suspend the rules and place the ordinance on its third reading which was lost by the following Vote Yeas Aldenman Crocker, Haynes, Ruesler, Ross, Shelley, Shumate, Smith, & Thielit – 8 Nays Aldenman Hume, Nitschke, Waddox, Moore. Nitschke & Schneider. – 6 --- Page break --- 94 Salaries Dog-Catchers By Alderman Maddas an ordinance appropriating the sum of $160.⁰⁰ for the purpose of paying the Salaries of dog Catchers for the months of Sept. & Oct. 1903The Ordinance was read the first time and a motion made to suspend the rule and place it on its second reading, which motion prevailed by the following Vote: Yeas Aldermen Crocker Haynes Hume Macken Maddas Miller Moore Nitschke Redd Schneider Shelley Shumatte Smith West 14 Nays none. Amended. The Ordinance was read the second time. Alderman Nitschke moved to amend same by striking out in the Caption & body of the ordinance the figures "$160.⁰⁰" and inserting in lieu thereof "$120.⁰⁰" which motion prevailed. The ordinance was then passed on suspension of the rule by the following Vote: Yeas Aldermen Crocker Haynes Hume Macken Maddas Miller Moore Nitschke Redd Schneider Shelley Shumatte Smith West 14 Nays none. Ord. to notify Alderman Maddas moved that the City Clerk be directed to Notify the Dog Catcher and his Assistant that their Salaries would cease after the 15th of Oct. 1903 which motion prevailed. Ordinance Separate By Alderman Shelley an ordinance requiring Street Coaches on Street RR. Railway Companies, all lessees, Managers and receivers of Street Railways operated or doing business within the corporate limits of the City of Austin to provide Separate Coaches for white and negro passengers etc The ordinance was read the first time Alderman Maddas moved that it be referred to the Police Committee & City Attorney Alderman Shumatte moved as a substitute that it be referred to the ordinance and that the City the substitute was adopted by the following Vote: Yeas Aldermen Crocker Haynes Hume Macken Moore Nitschke Redd Schneider Shelley Shumatte Smith West 12 Nays Aldermen Maddas Miller 2 Alderman Haynes moved to reconsider the Vote just taken which motion prevailed. On motion of Alderman Haynes the ordinance was referred to the Police Committee & City Attorney. $50. Approp. for Land for St. By Alderman Miller an ordinance appropriating the sum of $50.⁰⁰ for the purpose of purchasing a strip of Land for Street purposes. The ordinance was passed under suspension of the. --- Page break --- 95 rules by the following Vote Yeas Aldermen Crooken Haynes Hume Wacken Maddox Miller Moore Nitschke Redd Schneider Shelley Shumate Smith Weil Nays None. 14 Cleansing ditch Corral By Alderman Moore An ordinance appropriating Street and sum of $94.50 for the purpose of paying balance of work on ditch on Corral Street. The ordinance was passed under suspension of the rules by the following Vote Yeas Aldermen Crooken Haynes Hume Wacken Maddox Miller Moore Nitschke Redd Schneider Shelley Shumate Smith Weil Nays None. 14 $17.00 Refunded to By Alderman Shelley An ordinance appropriating John W. Maran. the sum of $17.00 for the purpose of refunding to John W. Maran that amount erroneously paid to him. The ordinance was passed under suspension of the rules by the following Vote Yeas Aldermen Crooken Haynes Hume Wacken Maddox Miller Moore Nitschke Redd Schneider Shelley Shumate Smith Weil Nays None. 14 $50. to Contract By Alderman Schneider An Ordinance appropriating W. B. Douglas the sum of $50.00 for the purpose of paying balance to W. B. Douglas The ordinance was passed under suspension of the rules by the following Vote Yeas Aldermen Haynes Hume Wacken Maddox Miller Moore Nitschke Redd Schneider Shelley Shumate Smith Weil Nays Alderman Crooken 13 1 Austin Electric R.R. Co. The Mayor laid before the Council a communication for fire hydrants from Robb Bruce Supt Water Light plant of the City enclosing an application from R. W. B. Superintendent of the Austin Electric Railroad Company asking for a fire hydrant Corner Preston & 20 Streets upon certain conditions - Read and on motion the petition was granted. Alderman Nitschke for the Street Committee presented the following report. Austin, Texas, Oct 5, 1903 Hon R. E. White Mayor, and Board of Aldermen of the City of Austin, Texas. Gentlemen: We beg to hand you herewith the plans, specifications etc. of G. B. A. Harris for a channel ditch on the avenue etc. in the City of Austin. I would ask the Mayor and Street Committee is instructed to advertise for bids for the construction of said ditch. --- Page break --- 96 in accordance with said plan & specifications Respectfully submitted. Alderman Shelley moved as a substitute that the report be laid over until the next regular meeting of the Council.
