Read and on motion referred to the Street Committee and Engineer, with power to act. Dayton Hardware Co. By the Mayor, Petition of the Dayton Hardware Company To refund taxes asking to have Certain taxes refunded – Read and on motion referred to the Committee on claims and accounts. Chas Bintiff in By Alderman Shumate, Communication from Bethel regard to street Hogwood atty for Chas. Bintiff regarding roadway to Pease Park. Read and referred to the City Attorney Alderman Shelley entered the Council Chamber. Reports by Officers Report of City Officers The Mayor laid before the Council the reports of the City Clerk, the City Physician and the City Sexton for the Month of March 1904, which were referred to their appropriate Committees without reading. Reports Standing Reports of Standing Committees Committees Alderman Wadday for the Finance Committee to whom was referred the reports of the Assessor & Collector Finance Officers reports of the Treasurer and the Clerk for the months of Dec. 1903 Jan. Feb & Mch. 1904 presented a report stating that they had examined same and found them correct. The report of the Committee was adopted. Park Committee on Alderman Shumate for the Park Committee to whom was opening street to referred an ordinance appropriating the sum of $300 for Pease Park the purpose of opening Street to draw West Avenue to Pease Park presented a report recommending the passage of the ordinance. On motion the report was laid over to come up with the ordinance under the head of Unfinished business. Alderman Redd entered the Council Chamber. Ordinance on Alderman Humne for the ordinance Committee to whom Sidewalk ordinance was was referred the petition of Citizens asking that the Vending Vending Ordinance by repealed or amended, presented a report recommending Certain amendments to said ordinance. On motion the report was adopted and the petition report referred back to the ordinance.

164 Ordinance on Committee with instructions to bring in an ordinance Swinging Signs Covering the recommendations of the Committee. Alderman Hume for the Ordinance Committee to whom was referred an ordinance prohibiting Signs on certain Streets of the City of Austin, presented a report recommending the passage of the ordinance, with certain amendments. On motion the report was laid over to come up with the Ordinance under the head of unfinished business. Claims & accounts Alderman Haynes for the Committee on claims & accounts to vs. petition of W. Herman whom was referred the petition of Bro. W. Herman asking pay for logs claimed to have been killed by the Pound Master, presented a report recommending that the petition be not granted. On motion the report was adopted. Bursley on Sexton's Alderman Ulit for the Bursley Committee to whom report was referred the report of the City Sexton for the month of Feby 1904, presented a report stating that same had been examined and found Correct. On motion the report was adopted. Citizens Committee on Wm. Trael in behalf of the Citizens Committee to widening side walks confer with the City Council in reg. to side walks on Congress Avenue, presented a report stating that they were not ready to make their report as yet and be asking further time in which to report. On motion their request was granted. Unfinished business Unfinished business The Mayor laid before the Council the ordinance Side walks ordinance amending the sidewalk ordinance, which was on motion of Alderman Maddas laid over awaiting the report of the Citizens Committee. Swinging Signs The Mayor laid before the Council, an Ordinance Ordained prohibiting Signs on certain Streets in the City of Austin, together with the report of the ordinance Committee proposing certain amendments. On motion the Amendment proposed by the Ordinance Committee was adopted. Amendedo, Alderman Shumate offered the following amendment – "Section 2. Any person violating any provision of this ordinance shall be declared guilty of a misdemeanor and shall upon conviction be fined in a sum notless than five or more than ten dollars." The Amendment was adopted by the following Vote Yeas Alderman Brooken, Haynes, Hume, Macken, Maddox, Miller, Moore, McCulloch, Redd, Shelley, Shumate, Smith, Ulit. Nays None.
