Regular Meeting of the City Council of Austin, Texas, May 02, 1904 Hon R. E. White Mayor, presiding Roll Called Present Aldermen Brooker, Haynes, Macken, Maddow, Miller, Moore, Nitschke, Redd, Schmeiden, Shelley, Shumate Smith, Welch. Absent Aldermen Humes On motion the minutes were approved as recorded by the clerk, without reading. Petitions, etc. Mrs G. H. Sullivan By Alderman Miller, Petition of Mrs G. H. Sullivan to refund pound asking to have certain pound fees refunded. fees Alderman Redd moved to refer the petition to the Police Committee, which motion was lost. On motion it was referred to the Committee on Claims and accounts. Citizens to abate By Alderman Smith, Petition of Citizens to abate Nuisance Nuisance on Corner 6th & Trinity Streets. Read and on motion referred to the Police Committee. S. G. Hancock to By Alderman Brooker, Petition of S. G. Hancock, for erect sign permission to erect a sign. Read and on motion referred to the Ordinance & Cemetery Committee. Reports of City Officers Reports City Officers The Mayor laid before the Council the reports of the Assessor & Collector and Engineer for the months of March and April, that of the Marshal for March and of the Clerk, Physician and Sexton for April, which were on motion referred to their appropriate Committees without reading. Reports of Standing Committees Standing Comps W & L on proposition Alderman Miller for the Water and Light Committee to G. W. Ramsay whom was referred the proposition of G. W. Ramsay to Water. furnish the City with water, presented a report stating that the power to make the contract referred to is vested solely in the Water and Light Commission. The report was adopted. Finance, Credits Alderman Maddow for the Finance Committee presented to Mrs Havell a report stating that they had carefully examined the books of the Assessor & Collector and recommended that he be allowed certain credits mentioned in said report, on account of uncollected taxes etc. On motion the report was adopted. Purchasing Alderman Shumate for the Purchasing Committee Patrol Wagon to whom was referred the matter of purchase of a Patrol Wagon etc., presented a report recommending that the contract for said wagon be awarded to A. O. Riley at $200.00, for the harness to C. P. Roe for at $35.00 and --- Page break --- 176 to G.H. Patrons for Keeping said horse and wagon and furnishing driven from a purchase of a horse. On motion the report was adopted Unfinished business Alderman Shinnate moved that the sidewalk ordinance, Side walk ord which is now on the Table and to come up under the head postponed of unfinished business be laid over until the next regular meeting of the Council, which motion prevailed. Proff D.W. Saylor being present was invited to explain true towards his claim for having Congress Avenue without widening to the Lawyers Extra st Labors - On motion a Vote of thanks was extended Proff Saylor Scanns- for his services in the Matter. The Mayor laid before the Council an ordinance appropriating the sum of $400.00 for the purpose of paying for extra Street labor & Scanns. The ordinance was read the second time, and a motion made to suspend the rule and place it on its third reading was lost by the following Vote. Rejs. to ord Coun The Mayor laid before the Council an ordinance appropriating the sum of $800.00 for the purpose of opening Street etc to Pease Park, which had heretofore been read three times Alderman Moore moved to amend same by inserting that $250.00 of the amount appropriated be taken from the Street Improvement fund, and that it be used for opening the Street exclusively, and that $50.00 be taken from the General fund, the whole to be expended under the supervision of the Park Committee. The amendment was lost by the following Vote. Yeas Aldermen Haynes Macken Maddas Mullen Moore Shelley Shinnate & Smith 8 Nays Aldermen Nitschke Redd Schneiden & Ullich 4 Alderman Maddas moved that the ordinance be re-committed to the ordinance Committee, which motion prevailed. The Mayor laid before the Council the Grazing Grazing ordinance ordinance, together with the Substitute for same offered by the ordinance Committee. Said ordinance was laid over until the next meeting. --- Page break --- 177 Judge Smith New business Got work Judge J. W. Smith, was invited to address the Council on the subject of street work near his place. After remarks by the Judge Alderman Haynes moved that the matter complained of be referred to the Street Committee and City Engineer with power to act, which motion prevailed. By Alderman Moore An ordinance appropriating $100. for streets the sum of $100. for the purpose of draining & grading work 7" Ward certain streets in the 7th Ward. The ordinance was read the first time, and on motion the rule was suspended and the ordinance placed on its second reading by the following Vote Yeas Aldermen Haynes Wackes Madday Miller Moore Nitscheke Redd Schneider Shelley Shumate Smith Whit Nay none. 12 The ordinance was read the second time Alderman Wadday moved to amend same by striking the word, "street" and inserting in lieu thereof the words "Alderman of the 7th Ward" which motion prevailed. The ordinance was then passed under suspension of the rules by the following Vote. The ordinance was passed under suspension of the rules by the following Vote Yeas Aldermen Haynes Wacker Wadday Miller Moore Nitscheke Redd Schneider Shelley Shumate Smith Whit Nay none. 12 $150. to repaint By Alderman Nitscheke An ordinance appropriating Congress Avenue the sum of $150.⁰⁰ for the purpose of repairing Congress Avenue. The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Haynes Wacker Wadday Miller Moore Nitscheke Redd Schneider Shelley Shumate Smith Whit Nay none 12 City Officers and Alderman Whit offered the following resolution which employees to pay was read and adopted; bills "Be it resolved by the City Council of the City of Austin; That it is the sense of this Council that City Officers. --- Page break --- 178 and employees should pay their bills promptly on resigning their positions. Alderman Schneider offered the following resolutions which were read and adopted: Transfer of funds Be it resolved by the City Council of the City of Austin; That the City Treasurer be, and is hereby directed to transfer from the Bonded Indebtedness account, to the afe of Sinking fund of Water and Light bonds, the sum of $82.91 being for interest July 1st 1901 to April 5th 1904, on Refunding bonds Nos 181 & 182. Be it resolved by the City Council of the City of Austin, That the City Treasurer be and he is hereby directed to transfer from the afe. of interest on bonds issued prior to May 1st 1890, to the afe of Sinking fund of Water and Light bonds of the City, the sum of $15.00 being interest due prior to July 1st 1901, on Refunding bonds Nos 1 to 8. $150. to pay salary By Alderman Maddox Ordinance appropriating ass't to Ass. & Coll. the sum of $150.00 for the purpose of paying the salary of ass't to the Assessor & Collector. The Ordinance was read the first time and passed under suspension of the rules by the following vote Yeas Aldermen Haynes Maddox Nobles Moore Nichols Red & Schneider Shelley Shunnate [Nitschke] Nays none.
