Austin's 1904 Street Work & Stock Herding Rules

Plumbing Standards Debated – A proposed plumbing ordinance sparked disagreement and was sent back to the ordinance committee for further review rather than being voted on.

Municipal Expenses Approved – The council allocated $1,260.93 and $93.18 for paying approved accounts in general and street department operations.

Social Services & Maintenance – The mayor was authorized to arrange transportation for a sick Mexican family to Corpus Christi, and a new ordinance required vacant lot owners to cut and burn weeds to maintain city cleanliness.

204 Regular meeting of the City Council Austin, Texas, July 18, 1904 Hon R.B. White, Mayor, presiding. Call Called – Present Aldermen Brooker Haynes Hune Wilson Moore Nitschke Red & Schneider Shelley Shumate Smith Ulich Absent Aldermen Wacker & Woolford On Motion the minutes were approved as recorded by the Clerk, without reading. Petition Petitions, memorials &c Policeman Gibson By Alderman Smith, Application of Policeman for leave of absence Gibson for ten days leave of absence. On motion Same was granted. Alderman Shumate moved that the Mayor and Mayor & Ch'm Charity Chairman of the Charity Committee be authorized to from to furnish procure transportation for a sick Mexican and his Transportation to sick family to Corpus Christi, which motion prevailed. Mexican Reports of City Officers The Mayor laid before the Council the reports of the Reports City Officers Marshal & Engineer for the month of May 1904, which were referred to their appropriate Committees without reading. Reports Standing Committees Reports of Standing Committees Streets & Sidewalks Alderman Nitschke for the Streets Committee, to Work 7th Ward whom was referred an ordinance appropriating the sum of $75.00 to complete work in the 7th ward, presented a Verbal report, recommended that the Ordinance be Amended so as to take the money from the "Street Improvement Fund" instead of the "General" fund" and that the amount be reduced from $75.00 to $50.00. The report was adopted. Finance on official Alderman Haynes for the Finance Committee, to reports whom was referred the reports of the Assessor & Collector, the Treasurer & the City Clerk for the month of May 1904, presented a report, stating that same had been examined and found correct. On motion the report of the Committee was adopted. Cemetery and Sexton Alderman Ulich for the Cemetery Committee, to reports whom was referred the reports of the City Sexton for the months of May & June 1904, presented a report stating that same had been examined and found correct. Unfinished business Unfinished business Ordinance in St. the The Mayor laid before the Council an ordinance 7th Ward appropriating the sum of $75.00 for the purpose of completing Street work in the 7th ward The ordinance was read the second time Alderman Nitschke moved to Amend Same by striking --- Page break --- aut in the caption and body of the ordinance the words "Seventy five" and inserting, in lieu thereof the word "forty also, by striking out the word "General" and inserting in lieu thereof the words, "street improvement", which amendments were adopted, and the ordinance as amended, passed under suspension of the rule by the following Vote Yeas Aldermen Crooker, Haynes, Hume, Miller, Moore, Nichols, Redd, Schneider, Shelley, Shumate, Smith, Wilt — 12 Nays None Alderman Macken entered the Council Chamber. Plumbing Ordinance The Mayor laid before the Council the Plumbing ordinance together with the substitute for same offered by the ordinance Committee. Alderman Schneider moved to lay the ordinance and substitute on the table, which motion was lost by the following Vote Yeas Aldermen Haynes, Hume, Miller, Nichols, Schneider, Wilt — 6 Nays Aldermen Crooker, Moore, Redd, Shelley, Shumate, Smith and the Mayor 7 Alderman Shumate moved that the substitute be read in full, which motion prevailed by the following Vote Yeas Aldermen Crooker, Hume, Miller, Moore, Nichols, Redd, Schneider, Shelley, Shumate, Smith, Wilt — 11 Nays Aldermen Haynes 1 Alderman Shumate moved to adopt same. Alderman Crooker moved to refer the ordinance and substitute back to the ordinance Committee, which Motion prevailed. Bentons Creek The Mayor laid before the Council an ordinance Road directing the City Marshal to open a certain road in South Austin, together with the Majority and Minority reports of the Police Committee on same. The Mayor stated that the question before the Council was the substitution of the minority report of the Police Committee for that of the Majority. After discussion by the friends of both propositions the Vote was taken and the report of the Minority Substitute for that of the Majority by the following Vote Yeas Aldermen Crooker, Haynes, Miller, Nichols, Redd, Schneider, Shumate, Wilt – 8 Nays Aldermen Hume, Macken, Moore, Shelley, Smith 5 Alderman Shelley moved that further consideration of the Refusal to atty ordinance be postponed and the whole matter be referred to the City Attorney for investigation as to the legal rights of the City in the premises, which motion prevailed. Alderman Haynes moved that the City Attorney be --- Page break --- 206 requested to report on same at the next regular meeting of the Council which motion prevailed. New business Herding Ordinance By Alderman Miller An ordinance prohobiting the Herding of Stock, within the City limits North of the Colorado River The ordinance was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Crooked Haynes Hurne Macken Miller Moore Nitschke Redd Schneider Shelley Shumate Smith West Nays none Alderman Crooked stated that he had been requested by the members of Protestion Ass'n #3 to ask when the Committee on repairing their hall would probabely be ready to report. Alderman Schneider from the fire Committee to whom the matter had been referred stated that the Committee had been attending to the same and would report as soon as they had properly fixed it up.
