Read and on motion referred to Finance Committee DR Graves leave The Mayor laid before the Council applications from from D. Johnson "" the City Physician and City Clerk, for leaves of absence which were read and on motion leaves granted as asked for. The Mayor laid before the Council a Communication asking appropriation from A. T. Brodricge Esq, Chairman of the Mayor for rebuilding Dam Committee for rebuilding the Dam, asking for an Appropriation to enable a Bureau to investigate on the matter. Read and on motion laid over to come up with an ordinance on the subject DR Francis Esq, The Mayor laid before the Council a Communication Austin Day "" from B. D. Francis Esq, President Louisiana Purchase "" Exposition, in regard to "Austin Day" at the Exposition. "" Read and on motion accepted with thanks of Council. J. L. Purnell & R M Brass By the Mayor - Petition of J. L. Purnell & R. M. Brass, to have for street work Side walk on 5th & Brazos Streets placed on their proper Grade. Read and on motion referred to Street Committee. Reports of City Officers The Mayor laid before the Council the reports of the Assessor Collector, the Treasurer, the Clerk, the Physician, the Sexton & Engineer for the month of August 1904, also that of the Marshall for July 1904, which were on motion referred to their appropriate Committees, without reading. Reports Standing Com Reports of Standing Committees Ordinance weed Alderman Hume for the Ordinance Committee to ordinance whom was referred an Ordinance to compel owners of vacant lots to keep them weeded. But on same presented a report recommending its passage On motion the report was adopted. Ordinance prohibiting Alderman Hume for the Ordinance Committee in City Cemetery to whom was referred an Ordinance prohibiting persons from working in the City Cemetery without the consent of the Sexton presented a report recommending that the ordinance be not passed. On motion the report was adopted. Reports of special Committees Paving Com -- Alderman Oltimate for the Paving Committee Made a Verbal report and stated that he would present any Ordinance later on "" Unfinished business "" The Mayor laid before the Council an Ordinance "" directing the City Marshall to open the Barton Springs road on South Austin On Motion of Alderman McLachlan & B. On motion of Alderman Bronson further Consideration of the Ordinance was postponed until the next regular Meeting of the Council, Awaiting the report of the Engineers appointed to Survey said road The Mayor laid before the Council an ordinance granting Permit the Austin Dandy Mfg. Co. permission to erect a Corrugated Iron Warehouse on lot 11 Block 43, within the fire limits The Ordinance was read the second time and passed under suspension of the rules by the following Vote Yeas Aldermen Bronson Crynes Haynes Hudson Miller Moore Redd Schneider Shelley Shumate Smith 12 Nays none. $250. No Business His Engineer report on The Mayor laid before the Council a Communication from Bridge over 6th Street the City Engineer asking for an appropriation of funds Creek. for the purpose of repairing bridge across Little Shoal on 6th Street, which was read and on motion referred to the Street Committee E. S. Lucy from the The Mayor laid before the Council a Communication Delinquent from E. S. Lucy on behalf of Certain Surety Companies Taxes for Surety Co. asking that the Council reconsider its action by which it refused to remit the interest due by Said Companies on taxes due the City Alderman Shumate moved that the Council reconsider the Vote by which it refused to remit the interest due by Said Companies, which motion prevailed by the following Vote Yeas Alderman Bronson Haynes Hudson Waddell Miller Moore Redd Schneider Shelley Shumate Smith 12 Nays none. Alderman Moore moved to grant the petition as presented by E. S. Lucy Esq. on behalf of Certain Surety Companies asking the remission of interest and penalties due by Said Companies on unpaid taxes due the City and asked that the Vote be taken separately, as to interest and penalties The Vote was then taken on the motion to remit the penalty due, and the motion carried by the following Vote --- Page break --- 216 Yeas Aldermen Crooker, Haynes, Macken, Maddox, Miller, Moore, Redd, Schneider, Shelley, Shumate, Schutt 12 Nays None The vote was then had upon the motion to remit the interest due by Said Cox and the same was remitted by the following vote. Yeas Aldermen Crooker, Hume, Macken, Moore, Redd, Shelley, Shumate 7 Nays Aldermen Haynes, Maddox, Miller, Schneider 5 Schutt Alderman Maddox offered the following resolution which was read and adopted. Austin, Texas, September 9, 1904 Resolved, that, Ashby S. James, as Attorney for the City of Austin, now holds under his Contract for Collection claims for delinquent taxes against the American Surety Co. of New York for the sum of $358.67, with interest and penalties amounting to $83.21; And against the Fidelity & Deposit Co. of Baltimore, Maryland, for delinquent taxes for the sum of $594.81 and interest and penalties amounting to $72.31; And against the National Surety Co. of New York for delinquent taxes for the sum of $594.81, and interest and penalties amounting to $72.31; And against the American Bonding & Trust Co. of Baltimore for delinquent taxes amounting to $384.01, and interest and penalties amounting to $399.86; And, Whereas, it is deemed to the best interest of the City of Austin that Said Attorney be authorized to compromise each of Said Claims by accepting from each of Said Corporations the amount of taxes alone of Said Corporations to the City of Austin in full settlement of the Claims of the City of Austin against each of Said Corporations for the delinquent taxes for the years assessed against them by the Assessor of the City of Austin and which now appear to be delinquent on the books of the Tax Collection of the City of Austin: Now, therefore, be it resolved that Said Ashby S. James, as Attorney for the City of Austin, be and is hereby authorized to accept from each of Said Corporations the aforesaid amounts of delinquent taxes due by them, as aforesaid, in full settlement, with each Corporation of the Claims against each for the taxes for the aforesaid years, amounting in the aggregate to $1, 286. 30. And that the City Clerk, Tax Collection of the City of Austin be and he is hereby authorized to issue to each of Said Corporations for receipts for --- Page break --- 217 the aforesaid years upon payment to him of the amount of taxes as aforesaid due by each of said Corporations By Alderman Shumate An Ordinance prohibiting the flasbing or repairing wooden signs on Congress avenue on Colorado, Brazos & Eleventh streets and on 6th street between East & West Avenues. Read the first time and on Motion referred to the Street Committee By Alderman Shelley An Ordinance appropriating the sum of $125.⁰⁰ for the purpose of employing a competent Engineer to make preliminary survey, plans and specifications for rebuilding the Dam. Read the first time and on motion referred to the Finance Committee and Water Light Commission By Alderman Hume An Ordinance appropriating the sum of $25.⁰⁰ for the purpose of improving the firemen's lots in the City Cemetery. Read and on Motion referred to the Fire Committee By Alderman Haynes An Ordinance appropriating the sum of $80.⁰⁰ for the purpose of paying the salaries of Dog Catcher and Assistant from Sept 15th to Oct 15th 1908 This Ordinance was read the first time and passed under suspension of the rule by the following Vote Yeas Aldermen Crooker, Haynes, Hume, A. Moore, Whalen, Redd, Shelley, Shumate & Smith Nays Aldermen Madden & Schneider 3 By Alderman Shumate An Ordinance providing for the Colonization of Common Prostitutes, or, within a Certain reservation, Read the first time & on motion referred to the Ordinance Committee By Alderman Madden An Ordinance appropriating the sum of $25.⁰⁰ for the purpose of repairing Culvert Cor & Avenue & 6th Street. Read the first time and passed under suspension of rules by the following Vote Yeas Alderman Crooker, Haynes, Hume, Madden, Moore, Muller, Moore, Redd, Schneider, Shelley, Shumate & Smith 13 Nays None.
