Petitions, Memorials &c By the Mayor Petition of the Austin Brokerage Co, for permission to put down plank side walks Read and on Motion referred to the Street Committee By Alderman Crooken application for Committee Austin Hook & Ladder, & Colorado Hose Co #2 in regard to Hall. Read and on motion referred to the Fire Committee By Alderman Hune petition from F.A. McCuishon to correct assessment. Read and on Motion the petition was granted and the assessor instructed to make the correction as asked for. By Alderman Wacker petition of S.H. McDonald asking to have certain pound fees refunded. Read and on Motion referred to the Committee on Claims & accounts By Mayor application from the Police force J.F. Brodie asking for ten Policeman J.F. Brodie, asking for ten days leave of absence On Motion leave was granted as asked for. By Alderman Crooken petition of Ed. Gayton asking pay for extra services performed. -Read and Laid over to Done with an Ordinance on the subject Reports of Standing Committees Fire Repairs to Austin Hose Wagon Alderman Schneider for the Fire Committee to whom was referred an Ordinance appropriating the sum of $125.00 for the purpose of repairing and repainting Austin Hose wagon, presented a report recommending the passage of the Ordinance On Motion the report was adopted. Report of Special Committees Special Com on Austin Hose Co. Aldermen Crooken for the Special Committee appointed to examine public buildings regarding fire escapes presented a report making certain recommendations in regard to 9th Street firemains Hall. On motion the report was adopted Unfinished business The Mayor laid before the Council an Ordinance appropriating the sum of $125.00 for the purpose of repairing & repainting Austin Hose wagon. The Mayor laid before the Council an ordinance requiring the owners of vacant lots to keep the weeds mown down on same. The ordinance was read the Second time and on motion was refered to the City Attorney, with instructions to report at the next Meeting. The Mayor laid before the Council an ordinance appropriating the Sum of $250 for the purpose of paving Streets, Congress Avenue and Streets. The ordinance was read the 3rd time and passed by the following Vote Yeas Aldermen Eroven Haynes Willen Redd Schneider Shelley Shumate Smith Nays Aldermen Hulme Macken Moore The Mayor laid before the Council an ordinance appropriating the sum of $300. for the purpose of employing an Engineer to make survey & prepare plans & specifications for paving Congress Avenue. The Ordinance was read the Second time and on motion made to suspend the rule and place it on its third reading which motion was lost by the following Vote Yeas Aldermen Erooken Haynes Hulme Macken Moore Redd Shelley Shumate & Smith Nays Aldermen Uellen Schneider & Ulit The Mayor laid before the Council an ordinance directing the City Marshal to open the Barton Creek Road in South Austin. The report of the Engineers appointed to locate said road was read. On motion of Alderman Shumate the regular order of Business was suspended to allow him to offer a resolution. Alderman Shumate offered a resolution granting the Ladies Jubilee Committee certain privileges during the Coming Carnival. The resolution was read the first time and passed under suspension of the rules by the following Vote Yeas Aldermen Crooken Haynes Hulme Macken Uullen Moore Redd Schneider Shelley Shumate Smith & Ulit Nays None. Alderman Shelley for the Police Committee to whom was referred an ordinance amending Art 129 of the Revised Penal Code, presented a Majority report recommending that the ordinance do not pass, and a Minority report recommending --- Page break --- 221 Its passage- The reports were read Alderman Wacken moved that the majority report be adopted which motion prevailed The Council resumed regular order. Alderman Brooker moved that the Council take a recess for ten minutes to allow the Aldermen to examine the report and sketch presented by the Engineer in regard to the road in South Austin, which Motion prevailed – After recess the Council was called to order Aldermand Hume moved that each side to the controversy be allowed to address the Council for ten minutes which motion prevailed – J.B. Cochran Atty for Mr. Butter then addressed the Council. Alderman for the Citizens Committee then addressed the Council, Judge Cochran closing the debate Mr Butter submitted another proposition as a compromise – Alderman Wacken moved to accept the Compromise offered by Mr. Butter, which motion was lost by the following vote Yeas Aldermen Hume Wacken Shelley Smith 4 Nays Aldermen Brooker Haynes Miller Moore Redd Schneider Thumate Weil 8 Alderman Wacken moved that the matter be referred to the City Attorney for investigation & report which motion prevailed by the following vote Yeas Aldermen Brooker Hume Wacken Schneider Shelley Thumate & Smith 7 Nays Aldermen Haynes Miller Moore Redd & Weil 5 Alderman Miller moved to reconsider the Vote by which the Council refused to suspend the rule and place on its third reading an ordinance appropriating the sum of $300. for Engineer for plans & specifications etc for Pecan Avenue, which motion prevailed.
