Regular Meeting of the City Council Austin, Texas, January 02, 1905 In the absence of the Mayor and President of the Council the Council was called to order by the Clerk. Nominations for temporary Chairman being in order Alderman Haynie was nominated & elected. Alderman Shelley President of the Council entered and assumed the chair. - Roll Called Present Aldermen Brooker, Haynie, Wackon, Waddell, Miller, Moore, Todd, Schneider, Smith, Swift, Weh 11 Absent Aldermen Hume, Nickels, Shumate 3 On motion the minutes were approved as recorded by the clerk, without reading. Alderman Shumate entered the Council.
Reports of City Officers The Chair laid before the Council the reports of the City Clerk & Physician for the record of Dec 1904, which were on motion referred to their appropriate Committees without reading. Reports of Standing Committees Alderman Waddell for the Finance Committee presented a report submitting coupons paid which was read and on motion referred to the Special Committee heretofore appointed to verify said and if found correct to destroy said coupons. Alderman Schneider for the Fire Committee, presented a verbal report stating that they had made a contract with Chas Schurm to repair 8th St Fire Hall Alderman Hume entered the Council chamber New Business By Alderman Waddell An ordinance appropriating the sum of $108.35 to refund to the Water & Light Commission that amount collected by the City from the City treasurer as interest on deposits of the said Commission - The ordinance was read the first time and passed under suspension of the rules & the following voteYeas Aldermen Brooker, Haynie, Hume, Wackon, Waddell, Miller, Moore, Road, Shelley, Shumate, Smith, Weh 12 Nays none On motion Alderman Shumate was excused from further attendance at this session of the Council By Alderman Waddell An ordinance appropriating the sum of $23.10 for the purpose of paying Commission formerly on Coupons for the Dec 1904 interest The ordinance was read the first time and passed under a suspension of the rules & the following vote

While Mayor, and Board of Aldermen of the City of Austin! Gentlemen: Your special Committee to whom was referred reports of Finance Committee of May 16, July 11th 1904, and January 2nd 1905 for the payment of Interest and the Exchange of Water, Light bonds described in said reports beg leave to report that we have verified the same and destroyed the bonds and coupons in the presence of the City Council The Finance Committee L. The Finance Committee offered the following resolution which was read and adopted Resolved by the City Council of the City of Austin, That the City Attorney of the City of Austin be and he is hereby ordered to institute suit for the forfeiture of the franchise of the Austin Electric Street Railway Company, Unless that Company shall within five days from this date furnish to said City Attorney satisfactory evidence of the letting of a contract for paving their right of way, as provided by their franchise on Congress Avenue active work on the same of said right of way in accordance with plans and specifications now on file in the office of the City Clerk of the City of Austin Alderman Haynes offered the following resolution.

The Engineer to notify RR Co to place main tracks in condition
Be it resolved by the City Council of the City of Austin, that the City Engineer be and he is hereby directed to notify the Manager of the Austin Electric Ry. Co. + other Railroads to at once fill in and place their right of way on proper grade on all streets of this City especially 6th Street in accordance with the terms of their franchise.
