5264 Regular meeting of the City Council Austin, Texas, Jany 16th 1905- Hon R.E. White, Mayor, presiding Roll called - Present: Aldermen Croock, Hume, Waddell, Moore, Welch, Todd, Dincan, Sheilley, Duimate, Welch 12 Absent: Haynes & Wackan 2 On motion the Minutes were approved as recorded by the Clerk, without reading. Petitions & Memorials etc. By the Mayor Petition of Mrs Mary Lee of El Paso, Tex., asking the Council to release to her right to the overflowed portion of the Gray & Brown Surveys on the Colorado River On motion of Alderman Waddell, the City Attorney was directed to notify her that the Council refused to comply with her request. By the Mayor Petition of E. Art Osler asking that a fire hydrant be placed on East Avenue & 5th Streets Read and on motion referred to the Water & Light Committee and the Chief of the Fire Dept. By the Mayor Petition of Protection Co #3, asking that the Council appropriate the sum of $122.56 to refund the Co the amount expended by them in the repair of their Hall - Read and on motion referred to the Fire Committee By Alderman Hume Petition of G. M. Welch et al, to enlarge Pound limits - Read and on motion referred to the Police Committee By Alderman Moore Petition of G. W. Thoras & Co to have Certain Streets repaired Read and on motion referred to the Streets Committee with instructions to investigate the matter and if deemed advisable to have same repaired - Reports of City officers The Mayor laid before the Council the report of the Engineer for the month of Dec. 1904, which was on motion referred to the Streets Committee. Reports of Standing Committees Alderman Trochskes for the Streets Committee to whom was referred the petition of Citizens to repair E 28th Street presented a Petition recommending that the Petition be granted, and submitting an Ordinance appropriating the money to do the work. On motion the report of the Committee was laid on the table and with the ordinance, under the head of Unfinished business. Alderman Waddell for the Finance Committee to whom was referred the reports of the Assessor and --- Page break --- 265 Collection, the Treasurer and the Clerk for the month of November 1904, presented a report stating that they had been examined and found Correct. On motion the report was adopted. Hospital Physician report Aldermen Fred & Smith the Hospital Committee to whom was referred the report of the City Physician for the month of Dec. 1904, presented a report stating that they had been examined and found Correct. The report was adopted. Ordinance – to pay officials, etc. Aldermen Hume for the Ordinance Committee to whom was referred an ordinance prohibiting the sale of intoxicating liquors, and an ordinance to pay officials etc. made a majority report, recommending that it does not pass, and a minority report recommending that it do pass. On motion the reports were laid over to come up with the ordinance. Paving to the Progress. Aldermen Shumate for the paving Committee made a Verbal report, stating progress with the paving of Congress Avenue. Unfinished business $250. for labor & teams. The Mayor laid before the Council an ordinance appropriating the sum of $250.00 for the purpose of paying for extra labor & teams. The ordinance was read the second time and a motion made to suspend the rule and place it on its third reading, which was lost by the following vote. Yeas Aldermen Crocken, Miller, Redd & Shumate & Shelley Smith & Hulit. Nays Aldermen Hume, Waaddar, Moore & Mitschke 4 $300. for gravel Speedway The Mayor laid before the Council an ordinance appropriating the sum of $300.00 for the purpose of purchasing gravel for the Speedway. The ordinance was read the second time and a motion made to suspend the rule and place the ordinance on its third reading and final passage, which was lost by the following vote. Yeas Aldermen Crocken, Hume, Waaddar, Miller, Moore Mitschke, Redd, Shumate, Hulit Nays Aldermen Schneider & Shelley & Smith 9 Aldermen Macken entered the Council Chamber. 3 $50. to repair Frost St. The Mayor laid before the Council an ordinance appropriating the sum of $50.00 for the purpose of placing in repair Frost Street. The ordinance was read the first time and passed under suspension of the rules by the following vote. Be it resolved by the City Council of the City of Austin that the following Notice, be and is hereby endorsed. Notice Austin, Texas, Dec 9: 1906 To whom it may Concern: Notice is hereby given that we, the undersigned, will apply to the Legislature of the State of Texas, when the same meets in regular session in January, 1907, for an Amendment to the present Charter of the City of Austin, said amendment being in substance, as follows, to-wit: An Amendment Providing that the City Council shall fix and determine the Necessity, Nature and extent of Street and sidewalk improvements, Construction and reconstruction of same, grade or regrading of same, paving and the kind of paving to be used, and to determine the benefits to each parcel of abutting property by reason of such improvement, repair and reconstruction, and to provide a reconstruction assessment against the portion of each of such repair and reconstruction of suchthe liens on abutting property, and to provide means for the Collection of such assessment when so made. --- Page break --- (268) Geo L. Resolution Alderman Moore moved that the Street Committee be instructed instructed to investigate and report to the Council the condition of the Street Roller and the probable cost of putting Road Roller it in good repair, which motion prevailed.
