Austin Streets & Dam Rebuilding Plan 1905

Street Paving Project: Council approved an ordinance to fund street paving on Congress Avenue by assessing costs to property owners whose properties border the street.

Dam Reconstruction Plan: City leaders proposed leasing the city's water and light plant to a private company for up to 30 years to raise money for rebuilding a damaged dam on the Colorado River.

Public Vote Required: Before any lease deal could happen, Austin voters would decide the fate of the plan in a special election scheduled for April 3rd, 1905.

Rate Protections Added: Council included a safeguard requiring that any lease contract must include maximum rate caps to protect consumers from price gouging on water and electricity.

293 Called a meeting of the City Council Austin, Texas, March 10, 1905. Hon. R.G. While, Mayor presiding Roll Called Present: Aldermen Crooks, Haynes, Kume, Watson, Moore, Nitschke, Todd, Schneider, Shelley, Shumate, Smith & Wilks. 12 Absent: Aldermen Madden & Maddox 2 The following Call of the Council was read Austin Texas March 10th 1905 To the Hon R.G. White, Mayor: Call of Council: We the undersigned Aldermen request that you Call a special meeting of the City Council to meet in the Council Chambers at 8 P.M. March 10th for the purpose of considering two subjects Ist The ordinance in regard to street paving 2nd The resolution and proposed Charter Amendment looking to the rebuilding of the Dam. H.K. Haynes E.W. Moore J.P. Nitschke J.M. Shumate & others The above request is granted and the Call of the Council ordered, at the time and place specified, and the Marshall directed to serve the Aldermen as required by law. R.G. While, Mayor Austin Texas, March 10th 1905 I hereby certify that the following named Aldermen have been served with a true copy of the above Call by having the same read to them in person H.K. Haynes, E.W. Moore, J.P. Nitschke, J.M. Shumate J.W. Wilks, W.D. Shelley, Joe Watson, Geo. Kume, Jno. [illegible] Smith, L.M. Crooks, J.P. Schneider, W.H. Todd Alderman Waxen & Alderman R.W. Maddox being absent from the City, a true copy of the above Call was served by leaving a copy of same at their place of residence. S.H.Montgomery, City Marshal Paving Ordinance... By Aldermany Shumate an ordinance to provide a means for fixing and determining the assessment of benefits and of the proportion of amount of cost to be paid by abutting property, or owner thereof for to be done on Congress Avenue in the City of Austin The ordinance was read the first time and passed upon suspension of the rules by the following Vote Yeas Aldermen Crooks, Haynes, Kume, Watson, Moore --- Page break --- (294) Hitsville Judd Schneider Shelley Shumate Smith Welton - 12 Nays None Alderman Haynes for the Special Committee to whom was referred the Resolution of rebuilding the Dam made a Verbal report stating that the Committee had Carefully Considered the Same, and offered the following Resolution and recommended its adoption Resolution Resolution Whereas, the Special Committee, Composed of Citizens, asking for change of Nominees for the new water Light Commission, and Members of the City Council, and an Amendment to the City unmeans of rebuilding the Charter of the City of Austin, providing for a means the Dam of rebuilding the dam across the Colorado River in the City of Austin, and providing for a lease of Said dam or plant for Such reasonable time, for the purpose of paying for the rebuilding of Said dam! Now, therefore be it resolved by the City Council of the City of Austin that they, as the City Council of the City of Austin, do join in and recommend to the Legislature the passage of the proposed amendment to the City Charter of the City of Austin, which empowers the City of Austin to lease the water power plant and water works system of the City of Austin to Some private person, firm or Corporation for a limited period of years, in order to obtain funds with which to rebuild the dam: provided, however, that the period of years for which Said property Shall be leased Shall not exceed years; and provided that consent of the bond holders is first had Resolved further, that the City Council do have the proper Notices published as required by law, requesting the Legislature to make Said Amendment The Resolution was read. Alderman Shelley moved to fill the blank, as to Number of years the lease is by inserting "30", which motion prevailed Alderman Schneider offered the following amendment "That any Contract on lease of the water or Light plant Shall be submitted to a vote of the tax payers of the City before it Shall be enforced. Alderman Shelley offered the following as a substitute for the Motion of Alderman Schneider "That the Mayor be and he is hereby directed, in his proclamation for a general election to be held April 3rd 1905, to Submit to the Voters of the City, the proposition as to whether or not the proposed Amendment to the Charter authorizing the lease of the water & Light Plant of the City and that the City Clerk in preparing ballots and other --- Page break --- election supplies for provide the necessary for Carrying out Such proclamation" The substitute was adopted. Alderman Shelley offered the following amendment which was read and adopted "add to end of Section 1 provided the Council shall fix Maximum rates to be charged in any contract leasing Such plant" The resolution as amended was then adopted by the following vote Yeas, Aldermen Crocker Haynes Kimble Kuellen Moore Mitchelle Shelley Shumate Smith Wulff 10 Nays, Aldermen Redd + Schneider 2 Alderman Mitchelle moved to amend the resolution by striking in line 16. the figures "50" and inserting in lieu thereof the figures "25" which motion prevailed. Alderman Haynes moved that the special Committee to whom was referred the matter of rechecking the Sain be continued and that they have charge of the matter until further action of the Council which motion prevailed. Alderman Shelley presented a form of Notice to be Notice in charge of [illegible] furnished asking the Legislature for a change of the of charter [illegible] Charter in accordance with the resolution just published passed which form was adopted and ordered published as required by law.
