Alderman Moore moved a call of the Council which was seconded and the Marshal directed to bring in the absentees. On motion of Alderman Powell the Council took a recess for 10 minutes At the end of the recess the Council was Called to order.

372 Gentlemen: Your Police Committee to whom was referred the charge against Officer J.A. Sholok, beg leave to report as follows. That on Oct 8th inst., Said Officer was arrested and a charge filed against him for disturbing the peace by wilfully assaulting and striking his wife, and that his Honor the Mayor very promptly and properly suspended him from duty, pending investigation by your Committee. Your Committee in open Session heard before them Several credible witnesses, Neighbors of the accused, and all the evidence showed that the domestic relations of the accused were very unpleasant and that in this case there were mitigating circumstances in favor of the accused, the wife being the aggressor and refusing to appear before your Committee. While the evidence does not show that he did wilfully assault or strike his wife, it does show, and he admits that on strong provocation he did strike or slap her in defending himself from attack, instead of unconditionally surrendering as a dutiful husband should have done. Therefore we have to recommend that he be reprimanded to wit he suspended for an act of insubordination, unbecoming an officer and husband, and that he be suspended from duty for ten days from Oct 9th inst., with the understanding that on the filing of another like Complaint he will be discharged.
