'382 Regular Meeting of the City Council Austin, Texas, July 3rd/905 Hon W.D. Shelby, Mayor, presiding. Roll Called Present Aldermen Crowley, Crooker, Cumes, Haynes Wacker, Miller, Moore, Petri, Powell, Redd, Shumate, Smith Von Rosenberg & Wilhelm -14 Absent - none. On motion the minutes were approved as recorded by the Clerk, without reading. Petition re J. Garrett to refund Pound fees Alderman Petri, Petition of J. Garrett to refund Pound fees. Read and on motion referred to the Committee on Claims & accounts Officer Reports Reports of City Officers The Mayor laid before the Council the reports of the Assessor & Collector & the Clerk for the month of June 1905, which were referred to their appropriate Committees without reading. Reports of Standing Committees Alderman Rosenberg for the Fire Committee Fire North Austin Hall accepted presented a report stating that North Austin Fire Hall had been completed and accepted and that said Hall had been turned over to the Committee The report of the Committee was adopted. re A. J. A. Kane for damages Alderman Petri for the Claims & accounts Committee, to whom was referred the claim of J. A. Kane for damages, presented a report recommending that the Petitioner be allowed the sum of $50.oo in full of all damages. The report of the Committee was adopted. Alderman Shumate for the Poverty Committee presented the following report, which was read and adopted. Austin, Texas June 27th 1905 To the Hon W.D. Shelby, Mayor & City Council of the City of Austin, Texas Gentlemen: Paving Cassidy claim We, your Street Paving Committee, heretofore appointed under the authority of the City Council by the Mayor, beg leave to report, that under an ordinance passed on the 10th day of March 1905, usual notices to James Cassidy, Mrs. Shockley, Lucy Cassidy, Clarence Horan, Jeff Horan, Mr. Rice, Secretary of the Presbyterian Loan Fund, Galveston, Texas, and Mrs. Cassidy, Administratrix of the estate of Sarah Cassidy deceased, to meet with said Paving Committee on the 17th day of June, 1905, and notified them as individual and as administratrix and as parties interested in

the hereinafter described property to appear before Said Committee on the 17th day of July, 1905, to offer any objection they may have as to why the bid and Contract of Brown & Dabney has not been accepted as true work of paving Congress Avenue and, especially, in front of the South 26 feet of Lot No.5, Block No.70 of the City of Austin, fronting east on Congress Avenue 26 feet. And to agree with said Committee to the proportionate share of Costs to be borne by the said above described property, of whom the above named persons are either the owners or have an interest for such paving of said Congress Avenue; And at said meeting no valid objection was offered as to why said Contract should not be adopted, and it appeared to the Committee that the reasonable proportionate share of Costs to be paid by the said above named owners for such paving, is $215.00 The, therefore, recommend that, unless the above named owners and those interested in said estate ratify and adopt this action in ascertaining such proportionate share to be paid by the said State (estate) within ten (10) days from this date, the City Attorney may be instructed to institute the necessary proceedings in accordance with the ordinance above referred to. The investigation shows to the Council Clerk the residence of the above named parties as follows: James Cassidy, Mrs. Stocks, Golding, Cassidy live in Travis County, Texas; Jeff Horan's residence is in Waco, Texas; Maud Horan's residence is unknown; J.W. Riddell, as Secretary of the Presbyterian Loan Fund, owners some interest in said property and his residence is Galveston, Texas; Lud Lucy Cassidy, administratrix of the estate of Sarah Cassidy, lives in Travis County, Texas. The mayor laid before the Council an ordinance providing for the redemption of certain property heretofore sold to The City - The ordinance was read the second time and a motion made to suspend the rule and place it on its third reading, which motion was lost by the following vote Yeas Aldermen Armstrong, Crooker, Dumes, Walden, Welker and Smith Nays Aldermen Haynes, Moore, Powell, Redd, Shumate and Van Rosenberg & Wilhelm Yeas Aldermen Walden, Schneider & Goeth were excused from vote in the Council Chamber.

384 Expense of election The Mayor laid before the Council an ordinance, appropriating the Sum of $188.25 for the purpose of paying the expenses of an election held June 20th 1905, The ordinance was read the third time and passed by the following VoteYeas Aldermen Armstrong, Crooker, Dumes, Haynes, Macken, McIllen, Moore, Petri, Powell, Redd, Shumate, Smith VonRosenberg & Wilhelm 14 Nays none Dog Catchers Salaries By Alderman Haynes An ordinance appropriating the Sum of $14.35 for the purpose of paying the Salaries of the Dog Catcher and his Assistant for the month of June 1905. The ordinance was read the first time and passed under dispension of the rules by the following VoteYeas Aldermen Armstrong, Crooker, Dumes, Haynes, Macken, McIllen, Moore, Petri, Powell, Redd, Shumate, Smith, VonRosenberg, Wilhelm 14 Nays none Claim Mr. Reed An motion by Alderman Goeth was invited to address the Council on the claim of Mr. Reed against the City. After remarks by Mr. Goeth the claim was on motion of Alderman Crooker, referred to the Committee on Claims & Accounts. Resolution, partial By Alderman Dumes Resolution authorizing the assessor payment on taxes to accept partial payments from the titles who are delinquent for taxes for more than two years, and where the property has been deeded to the City of Austin for more than two years, as follows. Viz. 1/4 in 30 days, 1/4 in 60 days, 1/4 in 90 days, and the balance in 120 days. The resolution was readRuled out of order Alderman Haynes made the point of order that the resolution was out of order, in that an ordinance should not be amended or changed by a resolution. The Mayor declared the point was well taken and the resolution out of order. $50. To put iron on By Alderman Dumes an ordinance appropriating the private wagon sum of $50.00 for the purpose of putting iron on private wagon. The ordinance was read the first time and a motion made to suspend the rules and place it on its second reading, which was lost by the following VoteYeas Aldermen Armstrong, Crooker, Dumes, Macken, Moore, Petri, Shumate, Smith, VonRosenberg, Wilhelm 10 Nays Aldermen Haynes, McIllen, Powell & Redd 4 The ordinance was read the second time, and on motion of Alderman Powell was referred to the Police Committee By Alderman Haynes An ordinance permitting owners of Real estate purchased by the City of Austin at foreclosure sale for taxes due the City to redeem the same.

Miller, was invited to address the Council on the ordinance. After remarks by Col. Miller Alderman Cunes moved that the ordinance be referred to the ordinance Committee, which motion prevailed by the following Vote Yeas Aldermen Armstrong, Cunes, Haynes, Macken, Miller, Petri, Powell, Smith, & Wilhelm 9 Nays Aldermen Crooker, Moore, Redd & Shumate & 5 Von Rosenberg

H. Mallory granted to report at the next meeting, which motion prevailed leave of absence On motion J. H.
