Regular meeting of the City Council Austin, Texas, October 02, 1905 Hon. Wm. Shelley Mayor, presiding Roll Call Present Aldermen Armstrong, Crooker, Ourost, Haynes, Macken Wilson, Moore, O'Connor, Powell, Shuleates, Smith, Von Rosenberg and Wilson Absent Alderman Redd On motion the minutes were approved as read by the Clerk, without reading. Petitions, Memorials etc. Citizens at work Rainey street By Alderman Wilson. Petition of citizens to have certain work done on Rainey street. Read and on motion referred to the Street Committee. Mrs. M.E. Leonard's Ordinances. By Alderman Smith. Petition of Mrs. M.E. Leonard to have certain pound fees refunded. Read and on motion referred to the Claims and accounts Committee. J. Mackenridge Fire Hydrants By the Mayor. Petition of J.F. Mackenridge asking to have a fire plug put in just South of the Colorado Bridge. Read and on motion referred to the Hon. Water and Light Commission. Reports City officers Report of City Officers The Mayor laid before the Council the reports of the Assessor & Collector and City Clerk for the month of Sept 1905, which were on motion referred to their appropriate Committees, without reading. Reports Standing Committees Fire Comm. Fire Hydrants Reports of Standing Committees Alderman Von Rosenberg for the Fire Committee presented a report submitted by a letter from the Texas Fire Prevention Association addressed to the Chief of the Fire dept. regarding fire hydrants in the City, and recommending that the matter have prompt attention. The letter and report were read and laid over to come up with an ordinance on the subject. Fire Comm. Chemical Tanks. Alderman Von Rosenberg for the Fire Committee presented a report calling attention to the fact that Protection No. 3 had been removed from its wagon, the chemical tanks placed on same by the City Council, without consulting or obtaining the consent of the Council or Fire Committee. Alderman Crooker moved that the matter be referred to a special Committee of three for investigation, which motion prevailed. Alderman Smith moved to reconsider the vote first taken by which the matter of Chemical tanks was referred to a special Committee, and that the matter be referred to the Fire Committee, which motion prevailed.

430 Police outlaw. ordinance Alderman Powell for the Police Committee to whom was referred an ordinance preventing the Keeping of hogs within the limits of the City of Austin, presented a substitute. for said ordinance, and recommended the adoption of the substitute. On motion the report was laid over to come up with the ordinance under the head of Unfinished. Business Charity Com. Alderman Moore Chairman of the Charity Committee Transportation for poor reported that he as said Chairman had instructed the CityWoman Clerk to furnish transportation for an aged Lady to Galveston that his reason for so doing. On motion the action of Alderman Moore was approved. Alderman Redd entered the Council Chamber. Unfinished business Unfinished Business Hog ordinance The matter of laid before the Council an ordinance prohibiting the Keeping of hogs within the City limits, together with the substitute for said ordinance presented by the Police Committee - The ordinance was read the second time and on motion of Alderman Redd for further consideration of same, was postponed until the next regular meeting of the Council. New Business New Business Alderman Smith offered the following resolution which was read and adopted. Be it resolved by the City-Council of the City of Austin: Gulf Refining Co That the Gulf Refining Company is hereby authorized to construct roof on construct the roof of its warehouse for the storage of oil building and oil products, authorized by resolution of the City Council approved September 28. 1905, of flint Coat on gravel instead of galvanized iron. Extra St. Labor Teams By Alderman Smith an ordinance appropriating the sum of $250. ºº for the purpose of paying for extra street labor and teams - The ordinance was read the first time and passed under suspension of the rules by the following vote Yeas Aldermen Armstrong, Crooker, Duncan, Haynes, Wallace, Millican, Moore, Petri, Polwell, Redd, Shumate, Smith, Voer Yeas. 14 Nays None. Alderman Crooker offered the following resolution which was read and on motion referred to the Street Committee. Engineer to place Resolved that the City Engineer be authorized to have Iron bars over storm suitable iron bars placed over inlet to sewer at the Sewer Temporary Deposit on the North side to be paid out of the regular street appropriation. Alderman Smith presented the verbal report of the City Engineer of the M.K.&T.R.R. Co. in regard to certain work near their depot grounds. Franchise matters Alderman Smith moved that the City Attorney be directed to draw up an ordinance, vitiating the franchise of the M.K.&T.R.R. Co. in so far as work required by said franchise to be done, has not been done, which motion prevailed. W.E. Russell On motion of Alderman Smith, Sanitary Inspector Leave absence W. E. Russell was granted a leave of absence for 10 days beginning Oct 15th 1905. Paving Cong. ave. Knauning The Your Paving Committee, heretofore appointed paving on 6th st under authority of the City Council and by the Mayor, beg leave to report, that under an ordinance passed on the 10th day of March 1905, and approved the 1st 11th day of March 1905, we, on the 17th day of September, 1905 issued to Messers Onesler & Robinson, agents of Heidsaick, administrator of the Est of J.F. Knauning, deceased, notice to meet with the said Paving Committee on the 25th day of September, 1905, notifying him, as agent of J. Haacke, administrator of the estate of J.F. Knauning, deceased, to appear before said Committee on the 26th day of September, 1905 and to offer

432 in objections they might have as to why the bid and Contract of Brown & Dabney Should not be accepted as to the work of Paving East Sixth Street and, especially, in front of Lot No. 7 in block No. 68, City of Austin, and to agree with the Said Committee as to the proportionate share of costs to be borne by the Estate of Said I. H. Hawkins for Such Paving of Said East Sixth Street. And at Said Meeting No Valid objection was offered as to why Said Contract Should not be adopted and it appeared to the Committee that the reasonable amount and proportionate share of costs to be paid by the Said I. H. Hawkins estate for Such Paving is $829.00 We, therefore, recommend that unless the agents of Said estate ratify and adopt this action in ascertaining Such proportionate share of to be paid by the estate within ten days from this date, that the City Attorney be instructed to institute the necessary proceedings in accordance with the ordinance above referred to. Shelley, Mayor, and City Council of the City of Austin Gentlemen: Est of Jacob Koppel Paving on 8th St We, your Paving Committee, heretofore appointed under the authority of the City Council and by the Mayor, beg leave to report, that under an ordinance passed on the 10th day of March, 1905, and approved the 11th day of March, 1905, We, on the 19th day of September, 1905, issued to Nelson Davis, Charles Hask and R. P. Bull, executors of the Estate of Jacob Kapple, deceased, notice to meet with the Said Paving Committee on the 25th day of September, 1905, notifying them, as executors of the estate of Jacob Kapple deceased, to appear before Said Committee on the 25th day of September, 1905, and to offer any objections they might have as to why the bid of Brown & Dabney should not be accepted as to the work of paving East Eighth Street and, especially, in front of the west half of Lot No. 10 in block No. 67, City of Austin, and to agree with the Said Committee as to the proportionate share of costs to be borne by the Said estate of Jacob Kapple for such paving of said East Eighth Street.
